Information from the Law Book Southwestern Reporter Vol 12
Case of Thomas P. Rutledge and wife Elizabeth
 
Miller Vs Foster Supreme Court of Texas June 28 1889
Testor (Thomas P. Rutledge) devisaed his estate to his wife for 21 years, 
after which it was to be owned by his children: but if the wife should die without children by him, it was 
to go to the plaintiffs. Upon the death of Teastor's (Thomas P. Rutledge) children the wife was to have the 
property for life. Testor died (Thomas P. Rutledge) leaving an only child, a son, (William F. Rutledge) , 
who died in infancy. but prior to the death of the son the widow had the will set aside, making 
the son and the executor parties defendant in the suit. Held , that as the son,
 who was entitled to the first estate of inheritance, and the widow who was a
 tenant for life and for years, were both parties to the suit, plaintiff became  parties by the rule of virtual representation, and were bound by the judgement  through not actual parties to the suit.
 
Action by Thomas H. Miller, W. A. H. Miller, and Mary F. Nichols joined by 
her husband, A. J. Nichols against William L. Foster, James C. Foster, Phillip 
Foster and Minnie Foster, to try the title to an undivided one half interest
in  a quarter of the league of land in Gonzales County.
 a certain will executed by Thomas P. Rutledge who was the first  husband of
Mrs. Eliza A. Foster,
deceased, wife of W. L. Foster and the mother of the defendants: that said 
will was executed June 7 1848
at which time the said Thomas P. Rutledge had a small amount of property, 
and no children; that afterwards a child was born to him in lawful wedlock 
before his death, named William M. Rutledge who survived him several years: 
Thomas P. Rutledge died Jan 10 1850 that in 1852 in a certain suit wherein W. L. 
Foster
and wife Eliza A. (formerly Rutledge, were plaintiffs and Alsey S. Miller 
the executor named in the will,
and William M. Rutledge, were defendants. The said will of Thomas P. 
Rutledge was declared null and void, the same was set aside and it was ordered  by
the court that the said Eliza A. Foster, as relict of said rutledge deceased 
and the said William M. Rutledge his minor child be entitled to take all the 
property of said deceased, jointly between them.
Plaintiffs filed their supplemental petition July 7 1877.
In controversy was the community property of Thomas P. Rutledge and Eliza  A.
rutledge at the time of Rutledge death, Jan 10 1850. that his wife was 
enceinte by said Rutledge when the will was made, and a child was born July 23 
1848, and died July 14 1854.
That plaintiffs are the children of Alsey Miller, to whom Rutledge devised 
his property under the contingencies mentioned in the will that was probated 
April 29 1850.
Alsey S. Miller, father of the plaintiffs executor, that the mother of 
plaintiffs and wife of said Miller was the sister of said Eliza A. Rutledge.  That
on July 1850 Eliza Rutledge married W. L. Foster one of the defendants and 
and the other Eliza E. Rutledge Foster children.
Eliza Rutledge Foster died 25 Feb 1881, son W. M. Rutledge died July 14  1854,
that the plaintiff T. H. Miller was born march 18 1848, W.A.H. Miller born 
Jan 1 1846, and Mrs. M. F. Nicholls
born March 1 1843. (These are children of Alsey Miller)
Mrs. M. F. Nicholls married W. V. Ramsey July 21 1861 who died Nov 1 
1869,and then she married
A. J. Nicholls.Oct 26 1871,
Foster testified that  the defendants had been in possesion of the  land
since 1850 as a homestead, when
he married Eliza A. Rutledge.
Eliza had paid the taxes on the same except the first year when they were 
paid by Alsey Miller the executor,
that A. S. Miller lived about 5 miles from the land and raised his family 
there.
Defendant Foster lived at the Miller place when he married Eliza A.  Rutledge.
The families were intimate, Alsey Miller wife and Eliza Rutledge being 
sisters.
This court case was  on page 119 thru 124, a lot is repeat of the will 
information, and family information,
page 120
that Thomas P. Rutledge  late in 1849 and long after the birth of his  child
left on a visit to Tennesse and died on his return passage on Jan 10 1850. 
and Alsy S. Miller  with whom his business was left found the will
amongst his papers , felt it his duty to probate the will and living in 
Gonzales Co. Texas will was filed.
29 Apr. 1850.   also Appointed  S. B. Conley guardian ad  litem for the
minor, W. M. Rutledge .
 


Roz, regarding these William Rutledges, consider this: 

The 1900-1910-1920 censuses of Upshur County, TX include a William
Rutledge and his wife Martha.  The 1920 census lists William with the
middle initial, "N."  The 1900 census has his birthdate as  Aug 1862,
and all three have his place of birth as Arkansas.

Looking back, there was a William N. Rutledge in G. W. Rutledge's
household on the 1880 census of White River, Independence County, AR.
William was 18, born AR.  Both parents born TN.  G.W.'s father born NC.

The household of William and Martha on both the 1900 & 1910 censuses of
Upshur County, TX, include a son, Willie, born Dec. 1892, AR.  I suspect
this was William T., who with his wife, Clara Bell, were enumerated on
the 1920 Upshur County census (Soundex).  William T. was 28, b. AR, and
Clara Bell was 22, b. MS.  They had a child, Donnie, who was listed as
"s" [son], age 5, born TX. 

As indicated earlier, William N.'s parents according to the 1880 census
of White River, Independence County, Arkansas, were G. W. and Eliza.
Odds are Eliza's maiden name was POWELL.  The same 1880 census record
includes Parthenia Powell, m-i-l, 60 GA GA GA.  [Of course, there is
always the possibility Parthenia married again after giving birth to
Eliza, thus having a change in her last name].

Oddly enough, there was another William Rutledge, born about the same
year and state - 1862, AR - who was in White River, Independence County,
AR, and later in Upshur County, TX.  That would have been William A..
Is that William Arch/Archie/Archibald your ancestor?  It appears William
N. and William A. (both born ca. 1862-AR) may have been first cousins.
That's if it is true their fathers, George W., and Nathan Franklin, were
brothers.

Pat,

These are from a branch of our tree.   Almost all of the Rutledge's who
located in Collin Co., TX were descendants of our John M. "Jack" Rutledge
who settled there with la large family.    I have done etensive research
linto this line and have researched all of the birth, death & marriage
records on this family in Collin Co., Records.

I have not yet gotten to the census for Collin Co., so thius information may
help me as I reconstruct each family.  Thanks for posting

Okay, I need to place this information.  I feel it will fall somewhere under George Washington Rutledge's wing.
Longview New obit claims the son of George Griffin Rutledge Sr and Mary Ann Stout died Sat Aug 26, 2006. Son's name, John Lamar Rutledge, age, 38. Born, March 31 1968 in Dallas. His father had died August 11 of the same month. He was injured in an accident in 1986 and his parents cared for him from then on. His brother, George Jr and wife, Brenda live in Hernado, Mississippi. They must have a son named Cody, mentioned as the only nephew. He was buried in Blytheville, Arkansas. His father's ashes were to be interred with John. This George Sr was born March 16 1940.

 Edward Levi Rutledge, age 84, of Pleasanton, Texas passed away Monday,
 March 29, 2004 at his residence. He was born in San Antonio, Texas on
 January 7, 1920. His worked as an electronic technician.
 He is survived by his wife, Alma Rutledge of Pleasanton; a son, Charles
 Edward Rutledge, San Antonio; a daughter, Bobbie Ann Parker, Devine; a
 brother, William Rutledge of Portland, Oregon; three sisters, Manetta
 Merriman, Poteet; Oma Dell Burch, Medina; and Opalee Kight, Poteet;
 eight grandchildren - Tobie Gail Saiz, Tammy Jean Contreras, Tina Rose
 Rutledge, Charles Edward Rutledge Jr., Donald Parker, Carrie Lynn
 Sinskie, Cathy Ann Mosley and Cindy Lane Jacobs; and 17
 great-grandchildren.
 He was preceded in death by a brother, David Rutledge Jr.; and his

James and Yvonne  Buchanan of Dallas, Texas, announce the engagement of their
 daughter, Juliette Rose Buchanan, to Mark Stephen Rutledge of  McKinney,
Texas. He is the son of Dr. Harley and Ruth Rutledge of  Cape Girardeau. 
Buchanan received a bachelor of music degree from Peabody  Institute of Johns
Hopkins University, master of music from Rice  University, and is currently a
doctoral candidate at the University  of Houston. She is on the faculty at
Baylor University and is  principal harpist with Plano Symphony in Plano, Texas.
 
Rutledge is a 1980 graduate of Central High School, and received  a bachelor
of science degree in physics from Southeast Missouri  State University. He is
North American sales manager with Summit  Microelectronics Inc. in San Jose,
Calif. 
A June 11 wedding is planned at St. Pius X Catholic Church in  Dallas.
           


The IN Rutledge family is very interesting.  My William b 1795 (1850 census
and prior census agree) I understood in TN.  However I find him in Jennings Co.
IN in 1820 and then in 1830 in Harrison Co. IN.  He is in Buchanan Co. MO
Rush Twp. for the 1850 census having with him children born in IN and MO.  I
believe he married Diantha Trindell in Jennings Co she was a widow maiden name I
believe was Eastman.  I later find no wife with Wm in MO though he had a son in
1846-7 there so I assume she died before the census of 1850.  The two
youngest sons are found with E. D. and Buerll Eastman in TX in 1860.  I have done
this off the top of my head but if there is a chance there is a connection I will
be happy to check dates etc. and post more completely.  Ginny in Wyoming

Edward M. Rutledge, should be Edward N. Rutledge, died 11-18-1925, not in Anderson Co. where he lived but in Lovelady, Texas, where the train wreck occurred.  He was my grandfather.  He was the engineer on a train which tried tip off a handcar on the track.  Something he had done a million times, but a bar wedged under the engine and tipped it over.  He was the only one killed.  Sort of a freak accident.  He was 70 years old and had been employed by the railroad since he was 18.  His twin brother, Edgar S., was also an engineer and was killed in a train wreck in Mexico several years before Granddaddy Rutledge.  The "N" stood for Nelson.  Edward Nelson Rutledge. 
 
We are going on vacation and I will get off the list for a while.

ANNOTATED ADOPTION RECORDS, 1862-1933
Genealogists know the importance of examining deeds.  Even so, few  people
realize that the older Texas deed books record adoptions.  Prior to  1850,
people wanting to adopt a child in Texas had to get a special law passed  by the
state legislature.1  On 16 Jan. 1850 the Texas legislature passed  "An Act to
Prescribe the Mode of Adoption."2  That law required adoptions  to be recorded
at the courthouse in the same manner as deeds. 
Adoption  by deed was not unique to Texas.  Similar laws existed in Alabama,
Georgia,  Iowa, Louisiana, Pennsylvania, and perhaps other states.3 

The 1850  law did not end the legislature's involvement with adoptions. 
Until at  least 1861 that body occasionally passed laws authorizing adoptions.4  
These acts differed from those prior to 1850 in that they did not complete the
 adoption, but instead authorized persons to adopt children following the 
existing procedures.  Apparently these laws were required because either  the
adoptive parents or the children failed to meet the criteria expected under  the
1850 law, although none of the acts examined states that  directly.

The Texas constitution adopted in 1869 specifically prohibited  the passage
of special laws "regulating the adoption of children, emancipation  of minors,
and the granting of divorces."5  Some time passed before the  constitutional
ban removed adoptions from the consideration of the  legislature.  At least as
late as May 1870 statesmen were still introducing  bills to permit persons to
adopt.6  Texans eventually learned that  legislative adoptions were no longer
permitted, though.  The constitution  of 1876 contains a prohibition similar
to that in the 1869 constitution which is  still in effect today.7

In Texas, adoptions continued to be recorded like  deeds until 1931.8 

 


The answer to that is yes, and no.  My Rutledge line ended with my great
grandmother Margaret Sonora Rutledge Weese.  She was born in MO (Buchanan Co.) to
Loyd Amos Rutledge and Martha Vineyard Rutledge in 1852 m. in Donephan Co. KS
in 1871 to David Weese and homesteaded with David in Lincoln Co. KS.  David d.
young and is buried near their homestead near Westfall, Madison Twp. Lincoln
Co. KS.  She married briefly to an Underwood but according to what she told my
Mom he wanted her land and she wouldn't give it up.  So the rest of her life
it provided for she and her four daughters.  She moved once more with her
daughter Jennie Alice Weese Skinner and her husband Alfred E.Skinner to Boulder
Colorado.  She is buried in the Skinner lot there she died in 1925.  Jennie died
young of TB so Sonora helped raise Jennie's three girls.  One was my Mom.
So now you know more than you wanted to about my Rutledge.  Sonora had
several brothers and Jean Bennett and I have worked hard on them.  We may have found
two brothers or possibly three of Loyd Amos" in TX but to run that down I
will need to check notes. 
As to the Kate" kids they are the children of my youngest sister who lives in
Denver.
One thing that might be of intrest is the strange names Wm Rutledge f/o Loyd
Amos gave his sons.  One was Jackson, then my Loyd (spelled that way), Cicero,
Adrian, Jerrell (spelled that way or Gerreld), and Justice.  I think I have
found the last three in Travis Co. in 1860.  The two youngest are listed with
the Eastman families simply as J. and Justice.  Adrian I found on a census. 
I think these folks went further west in TX in the area of Tom Green Co. and
then possibly north into the pan handle.  Any possiblities?  Ginny
 


Ok... a few more notes that I just ran across regarding this Robert C.
Rutledge. He was b. 1921-1922 in Texas. He was the son of  Robert C.
Rutledge Sr., & Elmer G. (possibly Elener). Robert C. Sr. was born March
1898 in Norman, Cleveland Co., Oklahoma. Elmer G. was born ca 1901 in Texas.

Robert C. Rutledge Sr., a watchmaker,  was the son of William & Cora L.
Rutledge.  Cora was born in Kansas, and was living with Robert & Elmer
in Harris Co., Texas in 1930. William was born July 1859 in Missouri.
Cora was born ca 1874 in Kansas.
William & Cora were in Norman Township, OK in the 1900 census.

Atascosa County is in Texas just "south of San Antonio on Interstate Highway
37 in the Rio Grande Plain region of south central Texas. Jourdanton, the
county seat, is located on state highways 16 and 97 in central Atascosa
County thirty-three miles south of San Antonio and 100 miles northwest of
Corpus Christi."

Although I've been told that these Rutledges came from the West Virginia
area and my father was of the West Virginia clan, no connection has been
made. There is another Cemetry in nearby Wilson county, Fairview Cemetry,
that has Rutledges related to mine but they are cousins from a more recent
timeline. There are also "Tackitt" family members in Fairview. Small world.
The Tackitts are from WV and some are buried in the same Wv cemetry that my
grandparents are in. Perhaps one day we can connect those long-distant dots.

According to an article in "Atascosa County, TX History", some
descendants of William believe his father was Richard Rutledge, "who
left Abbeville, SC and moved to AL, where he died in 1854".

"Times Record News", newspaper on April 12, 2005.

              Johnny A. Rutledge

   Johnny A. Rutledge, 81, died Sunday, April 10, 2005 in Wichita Falls.

    Funeral services will be held at 2 p.m. Wednesday, April 13, 2005,
in the chapel of Hampton Vaughan Crestview with Bro. Atkins, of
Southwest Baptist Church officiating.  Arrangements entrusted to Hampton
Vaughan Crestview.

    Jonny was born April 17, 1923 in McCurtain, Okla, to the late
William and Martha Ann (Nixon) Rutledge.  He served his country in the
United States Navy, and later retired in 1987 from the U.S.Post Office.
On Nov. 2. 1944, he married Betty J. Bailey in Ardmore, Okla. Prior to
working at the Post Office, Johnny enjoyed a long career in real estae
and home development, and was an avid golfer. 

     Survivors include his wife of 60 years, Betty Rutledge of Wichita
Falls, three children, Randy Rutledge and his wife Dawn of Wichita
Falls, Kathy Lubrano and husband Philip of Fort Worth, and William
Rutledge and wife Kacy of Wichita Falls; one sister, Dorothy McMillan of
Tulsa, Okla.; two brothers, Shedrick Rutledge of McCurtain, Okla., and
Faye Rutledge of Taft, Calif.; eight grandchildren, Shannon, Erika,
Travis, Sarah, Matthew, Joseph, Michaela, and Clay; and one
great-grandson, Bryan.

   Visitation will be held from 6 to 7 p.m. Tuesday, April 12, 2005, at
Hampton Vaughan Funeral Home.

    Memorial contributions may be made to Hospice of Wichita Falls.

 I suspect "most" of the Rutledges in the Atascosa County Cemetery
 descend from William Calvin Rutledge. W. C. was born in SC about 1792,
 and married Rachel Williams in GA or AL (Dallas County?). Their sons
 were Garrett M., William R., John J., and Elisha C., all born AL. These
 Rutledges came to TX in the early 1850's.

 Garrett M. Rutledge (1824-1921) reportedly died in Fairview, Wilson
 County, TX, and was buried in Atascosa County; William R. (1835-1919);
 John J. (1831-1920) died in Poteet, Atascosa County, TX; Elisha C.
 (1840-1915) died in Zavala County, TX.

RUTLEDGE, PAUL LAWRENCE, SR. (1904-1961). Paul Lawrence (Red) Rutledge, Sr., educator and community leader, son of Sam A. and Catherine C. (Warren) Rutledge, was born at Hempstead, Texas, on September 19, 1904. His parents were one of the pioneer black families to settle the area of Bishop, Texas, around 1911. Catherine Rutledge taught school for forty-two years. Paul Rutledge received his elementary education in the public schools of Round Rock and Bishop. He completed his secondary education at the Junior-Senior Academy, Prairie View Normal, and graduated with B.S. and M.S. degrees in agricultural education from Prairie View A&M in 1931. He later earned an M.A. from that institution. He also studied at Tuskegee Institute and Atlanta University. During his college career at Prairie View, he served as president of the class of 1931 and was a member of the debating team and an honorary society. Rutledge began his teaching career at Domino, Texas, in 1931. He served as princip!
 al and vocational agriculture teacher at Flint Hill (1933-37) and Green Bay (1937-42) high schools in Anderson County. He helped organize the Anderson County Teachers Association in the 1930s. He joined the Texas Education Agencyqv in Vocational Agricultural Education in 1942 as supervisor of Area 2, a post he held until his death in 1961. In the early 1950s Rutledge helped secure National Education Association affiliation for black educators. Rutledge joined the Baptist Churchqv at an early age and was a member of Mount Pilgrim Baptist Church Tucker Community at the time of his death. He was a member of the American Woodmen, Camp 66, Palestine, Texas. On September 24, 1933, Rutledge married Johnnie L. Cephas (1908-1994) of San Marcos. They had three sons. Paul L. Rutledge, Sr., died on December 28, 1961, and was buried in Magnolia Brotherhood Cemetery near Long Lake, Texas. In 1993 members of the Anderson and Houston county historical commissions dedicated a Texas Historic!

Jack County Texas, 1920 Census

I was looking for a great-aunt (Minnie Zema Rutledge) in Jack Co, TX --
didn't find her, but lo & behold!  Found my great-grandfather!  Never even knew he
lived in Jack Co!  His name is actually Alvah, but wife and child are right
(child is my grandfather who does seem to have been born in OK...!)

From book:  Story of Bell County, Texas:  Volume 1, published by Bell County
Historical Commission, 1988: Submitted by John H. Light, Jr.: pages 339-340:

JOHN BOWLES
   John Bowles was born in Virginia, the son of John and Fannie Bowles.  His
father was one of the Tennessee Volunteers under Andrew Jackson in the
Campaign against the Creek Indians and was wounded at the Battle of Horseshoe
Bend.  He recovered and went with Jackson to New Orleans in 1814 where he was
one of the few American fatalities.
   In 1822, John went to Itawambi County, Mississippi, where he married
Millie Caroline Pate.  In 1849, he moved his family to Texas, purchasing land
in Bell County where he helped organize the county and was active in
community affairs.  His expression "Well, hog my cats" earned him the
nickname John "Hog My Cats" Bowles.
   In 1852, John and his son, James Frank, prospected for gold in California.
 Returning to Bell County in 1855, John moved his family to the Uvalde area
where he assisted in the organization of that county.  He later moved to
Indian Territory on the Sabinal river.
   Bowles had many experiences fighting the Indians, the last incident on
October 28, 1859, when he was ambushed while moving stock to a new pasture. 
The Indians shot him with three arrows, lanced and scalped him.  John's son,
Doke, participated in the pursuit of the Indians over more than 200 miles. 
All the Indians but one were killed and Doke Bowles retrieved his father's
scalp, saddle-rope, bridle and the scalps of four children.
   John Bowles' body was found on Guide Hill and a large stone monument marks
the spot today.  The body was buried in the Patterson Cemetery, where his
wife and daughter, Mariah Patterson, are also buried.
   The 13 children of John and Millie Caroline Bowles were:
   1. Nancy Adeline, born 1825, married Dr. Gustavus Kilgore and had four
children,  They lined in Savoy, Arkansas.
   2. Hiram R., born 1827, married Elizabeth Townsend in Bell County on July
13, 1853.  He died in 1874 in Bell County.
   3. James Frank, born August 14, 1828, married Margaret Martin and they had
six children.  He prospected for gold in California and Arizona where he lost
his leg as the result of a gunshot wound sustained in a fall from his mule.
He was buried in Boot Hill Cemetery in Tombstone, Arizona in August 1880.
   4. Priscilla, born 1830, married John Webb in Mississippi and raised her
family there.
   5. John B., born 1831, never married and was killed by Mexicans at
Presidio Del Norte, Mexico.
   6. Frances "Fannie", born May 13, 1832, married James Townsend in January
1847 in Mississippi.  They raised 14 children in Bell county.
   7. Jane, born 1833, married Joseph Townsend and raised their family in
Bell County.
   8. William B. "Doke", born 1834, married in Mississippi to Amanda Ware, He
died December 7,1902 in Pueble, New Mexico.
   9. Greenville "Pete", born February 28, 1836, married Amanda A. Brown in
Uvalde County in 1856. He died in 1898.
   10. Caroline, born July 2, 1837, married John McDowell on August 26, 1858
in Bell County.  Buried in McDowell Cemetery.
   11. David Crockett, born March 10, 1839, married Martha Ann Jordan on
October 15, 1857in Bell County.  Died December 9, 1918 and is buried in
McDowell Cemetery.
   12. Emmaline, born February 9, 1840 and married Joseph G. Brown. Had two
children . Died in Uvalde County.
   13. Mariah Elizabeth, born February 9, 1842, married George Washington
Patterson in 1857 in Uvalde County.  They had nine children.  Both died in
1904 and are buried in Patterson Cemetery.
   There are seventh and eighth generation descendants of the Bowles family
in Bell County.

All this is sooooo close to where you say Jesse P. Bowles bought land.  What
year was it?  I don't know who my John Bowles sibblings were but Jesse sounds
like a likely suspect.  You may want to search the locations in the John
Bowles story.

As for the Richard Rutledge, I'm not sure about him but if I had a year and
town or county I might try my buds on the Rutledge list.  Many of them are
relentless searchers and dedicated to searching every corner for any Rutledge
information, even when they know it is not their line.

    Since this is on file at the Bandera Co. courthouse and the TX Land
Office, I can send for Jesse's document.  I'll put it on my list of things to
do.
    I don't know who J. Bowles is, above.
    But when I look on a TX map, I see that your Uvalde Co. has part of a
county line in common with Bandera...so there certainly could be some
connection here.  What...is anyone's guess.
    And yes, I've read about Hog My Cats Boles/Bowles.  How could I forget a
name like that?  I think that Mina Townsend Bates is also one of yours. 
Jeez, those Bowles folks of yours got stuck on the Townsend family!  I don't
know how you can figure it all out.  Two of my Bowles women married a couple
of Dickson men from TX, and there are only two of them and I have a hard time
understanding who was who.
    When I look at the birthdates of all those children, I know for a fact
that after 1825, Millie Caroline Pate Bowles never had a minute to herself.
    So now you can sic your Rutledge researchers on Richard RUTLEDGE in
Bandera Co. Texas  I won't have a date, as one isn't given, nor is a town.  
There might not have been any settlements around anywhere at the time, as
these are the original land grants we'll be looking at.

Thanks for the Land Grants URL and info.  There were Rutledges in Texas early
on - some mine and some from other lines (I think).  I had searched through
alot of land grant briefed info on line way back in about 98, or as my
children say "years ago, Mom, get up to date".  It's nice to know they are
now easier to find.

I will send all this to my Rutledge List cohorts and see if I can find out
who this Richard Rutledge in Bandaras County is.  Since John "Hog my Cats"
Bowles b.1802 had a son, James F. Bowles b.1828  & he had a son, James M.
Bowles b. 1853 Bell Co. TX who had a daughter, Mary Ann Bowles b.1872  that
married my James Carter Rutledge and then Richards were born in each
generation since, who knows, it may be some help to someone out there in
Rutledge land.

This is alot to read, but desparate searchers do that for fun.  Sometimes a
brick wall crashes and the sun comes shinning through.

Noticed you were researching in Ohio.  By any chance, do you have any
Rutledge's in Amesville, Athens Co, OH; Gratiot, Muskingum Co., OH; Mt.
Sterling, Muskingum Co., OH; Westland Township, Guernsey Co., OH; Pleasant
Plains, Warren Co., OH or surrounding areas?  The time line would be from
somewhere around 1827 - 1900's.   Thanks for checking.

Hello all, My name is Dene and I am new to your list.  I am looking for info on my GG grandparents.  William C. ROBERTS born Dec 24, 1828 in Tennessee, died June 9, 1882 in Jacksboro, Tx.  Married Emely Jaine RUTLEDGE Sept 29, 1849 in Gibson County TN. Emma was born about 1835 in TN, died June 14, 1918 in Jacksboro, TX. William and Emma had several children born in TX, including Elza Henderson Roberts, my great grandfather.  About 1879 the family moved to Jack County TX.  There they had 3 more children.  Most of the family stayed in Jack County after they were grown.  I have info from William and Emma's family from Marrage to present.  What I need is past info.  I hit a brick wall on the Roberts side, and thought the Rutledge might be easier..  I think that may have been a joke.

If anyone could help me, or tell me where to look, I would be very grateful.  I am willing to share any info that I have.

Henry Rutledge was born in TN 1836 and died 1894 and was buried in
Colter Cemetery, Mimosa, Lincoln Co, TN .  His children were:

   1.  Billy Rutledge 1861 -1929 married Donnie (Donie) Brown 1870 -
      latter part of 1960.  He is buried at the State Line Cemetery
      (Alabama and Tennessee Highway 231/431)

We need to check dates of birth and death since several had the same names,
but I believe Hamilton C. Rutledge was a son of John M Rutledge. Ham was
born on Jan 11, 1848 in KY. He died Jan 22, 1934 in McKinney, Collin Co.,
TX. B.R. Rutledge is, I believe, Burley Rutledge, son of William and Alcey
(Willis) Rutledge.

At this point, I believe this William Rutledge was a son of John M Rutledge,
but I lack smoking gun proof on this point. William came from Cumberland Co
KY. He married Alcey Willis in Celina, TN on Feb 23, 1848. I believe Alcey
had a brother named Burley Willis, who served with her husband William in the
same company during the Civil War. Burley gave affadavits to help William
and Alcey prove claims for pensions, and I would assume they named their son
after Burley Willis. Most of my info on Wm and Alcey comes from war pension
files, obits, and info from descendants of this family who live in TX.

I have more on this family, and would be curious to see more on your Collin
Co. folk.. The ones I have data on had strong TN ties (Wm and Burly Willis
served in a TN Cavalry Unit and lots of the Willis family was in TN. One
confusing problem I've noted with county data from southern KY, like
Cumberland, and northern TN counties like Overton, is the Scott Line issue.
Often the data on my kin indicates they moved from KY to TN and back every
census. But it appears what actually happened is the state line moved back
and forth over them as KY and TN argued an error made in a boundry survey..
I'm not sure now that they actually moved at all...

Anyway.. let me know if you'd like more on these folk... I can send you an
attachment with more complete data.

One last point.... do you know if your Collin Co kin had ties to the Joseph
Rutledge Jr line of Walker Co. AL? I'm looking at the probability that John
M Rutledge was a son of Joseph Rutledge Jr.... the elusive Jack Rutledge
that is mentioned in Walker Co AL history, but nobody seems to have data
on.... John M went by the name Jack or Jackie and other clues lead me to
think he may be Jos Jr's son. I'd be interested to know if your folk have AL
ties...it might lead to info that the two groups were related.... John

Sorry I mislead you. The Thomas Henry Rutledge buried at Wilson Chapel
is the son of John Jane Gaw Brown Rutledge. I know this because I
have copies of a letter and 4 post cards written between TH and his
mother Jane Rutledge in Pierce City, Mo. I have his death certificate
and it states he was born in Missiouri in 1850--no parents names were
listed because of a feud between the Browns, Gaws and Rutledges in
Jackson County, TN. Thomas Henry was the youngest son born of that
marriage. I also have a 5X7 photo copy of 5-6 adults that were listed
as children of Jane Gaw B Rutledge at the time of her death. (No date to
confirm the year but about 1874, more or less).

The other Rutledges I mentioned, I took photographs of every Rutledge
headstone and forwarded this information to the Ruts list with a cc to
Ron and Daryl Gardner. It was through them I learned BR's name was
Burley, but since this wasn't my line, I just wanted to let somebody
know of these vast family of Rutledges buried in McKinney's Wilson
Chapel Cemetery.

If you would like for me to send you a copy of the headstones of
particular Rutledge relatives of yours, send me your address and I will
be happy to forward this picture to you!

I believe these Rutledges descend from David Weldon Rutledge (ca. 1790 NC - ca. 1844 Rutherford Co. TN) and wife Angelina Williamson (ca. 1799 VA - 18.. Cape Girardeau Co. MO).
L. M. is probably David's son Ludie Monroe (20 Mar 1820 Rutherford Co. TN - 6 May 1870 Fannin Co. TX). Monroe m/1 Rebecca L. Crowder (4 Jan 1822 VA - 1852 Marshall Co. TN), and they had 6 ch. Monroe m/2 Margaret Virginia Aldridge (7 Apr 1834 TN - 17 Mar 1899 Sulphur Co. OK).
William is probably Monroe's son William Edward (27 Mar 1840 Rutherford Co. TN - 1...). William married Sarah J. Netherton (18..-1...). I don't know if this is correct, but one source suggested William was a twin, but the dates don't match any other children I have for Monroe.
John is probably Monroe's son John Joel (25 May 1842 Hickman or Rutherford Co. TN - 25 Dec 1907 Kiowa Co. OK). John m/1 Mary E. Mollie Minton (22 Jun 1850 TN - 27 Dec 1878 Cook Co. TX), and they had 4 ch. John m/2 Martha Alice Phillips (1 Jan 1862 Valley Creek TX - 29 Jan 1929 Duncan OK).
I don't have any info on S. Rutledge.

RUTLEDGE, Grady L.
Query: Looking for family of my g-grandfather, Grady L. Rutledge.
Family Bible says he was born 10 February 1854. He married Eliza E. GROOMER abt. 1876 in north central Texas and they had two children, William Alfred, b. 07 February 1877, and Grady Anderson, b. 02 May 1878.
Grady L. died a few months before son Grady A. was born.
The 1880 Grayson Co., Texas, census has Eliza living with her parents, Jacob and Frances GROOMER, and says father of her boys was born in Illinois. William Alfred died 24 February 1889 in Grayson or Montague Co., Texas, apparently victim of the same epidemic that killed Jacob GROOMER and two of his daughters in February and March of that year.
Grady A. married Mattie Lively QUESENBERRY 23 June 1907 in Denton Co., Texas. They had three children, Mary Florence, Grady A. Jr., and Lela Mae, who married and stayed in the general north central Texas area.
Surnames: JUDD, FELTY, STORY (mine).
What we think: Oral family history has it that Grady L. was born in Jacksonville, Illinois. The family apparently moved to north central Texas shortly after the Civil War ended; there's a vague rumor of some unfortunate incident involving Grady L.'s father and a black man. My mother remembers her grandmother (Eliza) referring to her late husband as Lon but we don't know for sure what the L stands for. I'm reasonably sure he was a farmer.

I haven't been able to find a child named Grady, Lon, or anything similar in the 1860 census of Morgan or surrounding counties in Illinois, nor in 1870 anywhere near Grayson Co., Texas. Kathleen Harrington:

John, a confederate veteran, attended several confederate soldier reunions in OK and TX. In conf file he has an X over his head, in rutledge2 he is 3rd from left bottom row.

James Carter RUTLEDGE was b: 2 Dec 1862 in TX and married Mary Ann BOWLES in Montague Co. Texas and they raised their children there.

Hello, all. I'm looking for parents/siblings/descendants of Anderson Rutledge, b. abt. 1821 in KY, d. aft. 1890 in Texas (Cooke Co.?). He married Sarah Emery 30 Sept. 1847 in Highland Co., Ohio; they had 8 children: Catherine, Laura, Morgan (all born in Ohio), Alonzo Grady (my gggrandfather), Roland, Hazard, Melvina, and Francis C. (all born in Illinois, probably Pike Co. or Jacksonville area). (I think Anderson's mother was named Elizabeth, as the 1860 census shows an Elizabeth Rutledge, age 54, b. KY, living with the family.)

Anderson served in the 99th Illinois Volunteer Infantry during C.W. Sometime between 1870 and 1880 the family went to north Texas. Anderson's second wife, as shown on the 1880 Grayson Co., Texas, was named Nancy, and he married a woman named Elizabeth Chapman in Grayson Co. in 1881. Anderson was in Cooke Co. for the 1890 Veterans Census and I can find no record of him after that. If anyone has any information on this family I would greatly appreciate hearing from you.

Don, personal note: In Tennessee State Civil War Surveys of 1929, there was listing of Confederate Veteran: ARMEL Gaw, s/o Elias and Jane Rutledge Gaw.

There was one question to CSA veterans on their parents lineage asking their names. Armel responded his mother's parents' names were Thomas and Matilda Rutledge!

Maybe Question #14, what occupation did your father and mother have? Armel replied, Father, plowed and hooed, Mother cooked, cleaned and washed, did some spinning in her spare time. What were their parents name?? Thomas and Matilda Rutledge!

WOW!!! Received interesting email yesterday from Marie Rutledge of Lithonia, GA who identified my Joseph Rutledge picture on Don Kelly's site as her Joseph. Seems as if that same picture was hanging in a home in Troup Co., GA, built by her Joseph in 1851-3. This same picture of Joseph has been copied and handed down in our family since the 1850s. Two of our branches had copies. Anyone have more detail on this RUTLEDGE line: 1) - James and Sarah of VA had at least 3 sons b. 1740s: 2) William 2) Joseph bc 1743 VA, md. Mary Paschal, 11 children 3) Thos, Nancy, Docus, Joseph Jr., Robert, James, Blanks, J. Paschal, Spencer, Berry, Polly. 2) James bc 1745 maybe in SC, md. ?, several children, he died 1823 Wilkes Co., GA. 3) James b. 1774 SC, m 1807 Susannah Sherrer of Wilkes Co., GA. m/2 1849 Emaline Granberry. Jas. died 1853 Harris Co. GA. 4) Joseph b. 1811 Wilkes Co., GA md. Jane Booker/Brooker, raised family in Troup Co., GA. Jos. died there in 1892. Joseph picture also possessed by other descendants: former Dr. Felix Rutledge (b. Chambers Co AL) of Houston TX, and the Roziers of Atlanta. Boy are we confused! William Rutledge, married Mary (name unknown) and bought land in Surry
Co, NC in 1771. William and Mary had 5 sons: William, James, John,
Isaac, and Joel. Their third son, John, born in either 1768 or 1798 and
died in 1833, was also born in Surry County and is buried in Lincoln Co,
TN. He was married to Catherine Steelman, born in 1782, died 1840-1850.
They were married in 1827, probably just as the family was moving from
NC to Tennessee. They had 9 children.

William D. Rutledge married Mary Howell, and they were listed in the
1840/1850 census of Shelby County, TN and in the 1860/1870 census of
Independence,AR. He was a merchant and they had 8 children.

Nathan Franklin Rutledge, the 6th child, was born April 22, 1837 in
Tennessee and was married to Nancy Parbena Davis, born November 7, 1839
in North Carolina. They were married Feb 24, 1858. They had 1 daughter
before mvoing to Independence Co. AR, where they were farmers. A total
of nine children were born to this union.

1. Mary Jane, married O.C.Owens in February 1859. She was later married
to Robert Sturdivent, Robert Smith Clark and Ballard day. There were 6
children.

2. William Arch. (born May 5, 1861, did Dec 22, 1950), maried Sarah
Ophelia Durham. They had 6 children.

3. Joseph D. (born April 2, 1864, died May 9, 1883).

4. Irene Electra (born September 22, 1866), married William Isaac Davis,
and had 6 children.

5. Charles Nathan, (born December 10, 1868) mar Lucy B. Speirs and they
seven children.

6. Thadeshia Catherine, (born September 3, 1872), died Feb 2, 1873.

7. Albert Andrew, (born 1874, died Dec 24, 1924), mar Annie Lee
Campbell, and they had four children.

8. Bertha Clara Clementine, (born June 10, 1879, died Feb 24, 180), mar
Al B. Lansdale and they had eleven children.

9. John Allen, (born September 14, 1879, died April 10, 1973) married
Ella Mae Waller, and they had six children.

Alsobrook, a descendant of Nathan and Nancy's second child, William
Arch. ......I also remember Aunt Clara very well. She lived to be one of
Upshur County's oldest residents. She had 11 children and died at age
103. I would also like to mention CHARLES RUTLEDGE, #7 Mimosa Dr, Rome,
GA. 30161, who is a distant cousin, as one who has completed extensive
research on the Rutledge family. He has traveled to Gilmer and worked
with Rosalyn Rutledge Alsobrook on our family tree.
