At a special term of the Circuit Court of Harrison Co. held 10 Jan. 1860, George Hoffman and Flora his wife late Flora Lee against Prudence Duncan, Hugh H. Lee, Gertrude Lee, Edwin S. Duncan, Earnest Duncan, Gay Duncan, James J. Duncan & Floride C. Duncan, Dfts. James Deven, Samuel Sheets, Gideon D. Camden Jr. and Luther Haymond, heretofore appointed commissioners to make partition of the real estate of Edwin S. Duncan decd among his widow, heirs and distributees, having filed their report of partition among the papers of this cause on 5 Oct. 1859, and the complainants having filed their exceptions thereto, and the cause coming on again to be heard on the bill, answers, replications, depositions and exhibits, ... was argued by counsel. On consideration whereof it is adjudged, ordered and decreed that Prudence Duncan, widow of said Edwin S.       52-492: George Hoffman & wife vs. Hugh H. Lee & others, Circuit Court held 19 March 1864; in chancery. William E. Lyon, J.R. Wright and John Stealey, three commrs. appointed to make partition among heirs of Edwin S. Duncan decd of that part of real estate which he died seized as was assigned to his widow Prudence Duncan as dower in his land, returned their report of partition, which being seen and inspected and no exceptions being taken, it is decreed it be approved and confirmed. That Flora Hoffman one of heirs hold lot on Gnatty Creek, lot 1 on plat made 22 April 1861 containing 70 acres; also a parcel near Clarksburg, part of graveyard field, containing 1 acre, being lot 3 on the plat. That Gertrude Despard have land on West Fork River, 65 acres known as Hickman place, lot 1 on Plat B, and one acre part of Graveyard field lot 2. That Hugh H. Lee have the brick house and lot on Turnpike Street in Clarksburg containing 4 acres & 16 poles, and the southern end of the graveyard field containing 7-1/2 acres. That John J. Duncan have land on Gnatty Creek 149-1/4 acres lot 5? (dark copy) and two acres. That Edwin S. Duncan have lot 3 on Gnatty Creek embracing the dwelling house, containing 69-1/2 acres, and lot 5 of the graveyard field, 1-1/2 acres. That Earnest Duncan have lot 4 (acres not given) and lot 4 of the graveyard field, 3/4 acres. That Gay Duncan have Lot 2 on Gnatty Creek, 42-3/4 acres, and lot 1 in graveyard field of 1-1/2 acre.       52-495: William Dunkin vs. Elizabeth Dunkin & others, Decree in Chancery, WV; circuit court held 28 Feb. 1870; this cause came on again this day to be finally heard on the papers heretofore read, and the report of Robert Minor, George T. Faris and J.N. Wilkinson, the commissioners appointed to assign dower and make partition of the land in the bill and proceedings mentioned, and said report being seen and inspected by the court, and there being no exceptions thereto, the court approves and confirms the same. It is therefore ordered and decreed that the defendant Elizabeth Dunkin the widow of William Dunkin decd. do hold for and during her natural life and for her dower in the land in the bill and proceedings mentioned, of which the said William Dunkin died seized, the 195-3/4 acres of land mentioned and described in the plat and report of the commissioners, bounded as follows: beg. at a black oak, ... to an old line, to a stone by a road, stake in the old line in the road. It is further ordered that the defendant James Dunkin do hold in severalty and in fee, free from the claims of the plaintiff and the other defendants, Lot No. 1 in the plat of the Commissioners, bounded ... stake on an original line next to land owned by Leonidus Johnson, corner of the widow's dower, containing 110 acres and 15 poles. The defendant John Dunkin do hold ... Lot No. 2 bounded ... beg. corner of the entire tract, by ridge road, ... an original line, containing 100 acres and 12 poles. The defendant William Dunkin do hold Lot No. 3 bounded beg. on the bank of Simpson Creek ... corner Lot No. 4, containing 97-1/4 acres and 17 poles. The defendant Amanda Dunkin do hold Lot No. 4 adj. ... above the shaft of the tunnel east end, ... corner Lot No. 3, ... near Dillon's house ... containing 90 acres and 23 poles. The defendant Elizabeth Dunkin the daughter of William Dunkin decd. do hold ... Lot No. 5, adj. a stake on the rail road, corner to Lot No. 4, ... containing 107 acres. The defendant Ann Dunkin do hold ... Lot No. 6, adj. Lot No. 1 and the widow's dower, an old line between said Dunkin and Gov.
