      54-286: 29 Sept. 1855; whereas John Dunkum of Albemarle Co. by will which has been advanced to probate, desired his executors, out of any money which might be due the estate or out of the proceeds of property sold, to purchase for his wife Margaret Dunkam and his two youngest daughters Elizabeth B. Dunkum and Jane R. Dunkum, a house and lot not exceeding $2?000 in value, and after his wife's death to sell the house and lot and divide the money equally among his children and grandchild as the other part of his estate; and whereas neither of the above daughters desire the house and lot be purchased and the widow is willing provided she is allowed to receive a child's part, or one seventh of the $2?,000 authorized to be invested, this sum to be held by her in fee simple in lieu thereof; and whereas all parties interested under the will prefer that the said $2,000 instead of being invested in the house shall be at once divided so as to give the said Margaret Dunkum widow of said John Dunkum one seventh part and to each of the children of John Dunkum one other seventh and to Emma Edge the granddaughter of John Dunkum the remaining seventh to be taken and received by them respectively at once and held in like manner with all other estate given them by the will; Now therefore this agreement in consideration of the premises the parties interested in the will of John Dunkum who are of full age, namely the said Margaret Dunkum his widow, the said Elizabeth B. Dunkum, Theodore N. Sellers and the said Jane R. his wife, William Pitt and Martha Ann his wife, Chester Bullerd and Mary A. his wife, and James D. Dunkum, mutually agree each with the other that the house and lot not be purchased but that the $2,000 shall be divided in the manner hereinbefore indicated, that is, so as to give said Margaret Dunkum one seventh part thereof, to said Elizabeth B.       54-288: 29 Sept. 1855; whereas John Dunkum of Albemarle Co. by his last will ... decreed that the portion of his estate willed to his granddau. Emma Edge should be held by his executors in trust for her use and benefit until she marries or arrives at age of 21 years and then to be delivered to her as her absolute property, but if she died before marrying or before arriving at age 21 then it would be divided in the same manner and among the same persons as the proceeds of the house and lot in the same will, that is to say, among the children and grandchild of the testator, and who by agreement the $2,000 to be invested in a house and lot ... to be divided, and one seventh to the said Emma Edge to be held by her in like manner with the other property given her by the will; and whereas Philip Edge has qualified as executor of John Dunkum and will be entitled to legal commissions which will be considerable; the legatees of the estate want to settle the estate, and Philip Edge is willing not to charge the commission but will receive $500 in full for his service as executor, and the legatees convey to Philip Edge their right to the estate of Emma Edge if she dies before marriage or arriving at 21; Now therefore in consideration of the premises the undersigned Theodore N. Sellers and Jane R. his wife, William Pitt and Martha A. his wife, Chester Bullard and Mary A. his wife and James D. Dunkum, ... to Philip Edge ... their interest under the will of John Dunkum to the share willed to Emma Edge and also to the one seventh part of the $2,000; and Philip Edge will not charge the full amount of commission to which he is entitled by law as executor of John Dunkum decd, but only the sum of $500 from the estate. 29 Sept. 1855.
