      A-119/121: Wednesday, April 15, 1866, The widow & heirs of James S. Duncan vs. Allen Reed, Nancy Reed & others. This cause coming on to be further heard on this the 15th day of April 1868, upon the pleadings, exhibits and proof in the case and it appearing that on 14 March 1857 James S. Duncan sold and conveyed to John L. Smith & J?.N?. Carlack a tract of land in the 2nd Civil Dist. of Scott Co., adj. SW corner of a 50 acre tract that included Huntsville, crossing Flat Creek, and William D. Field's line of 50 acre tract, crossing the creek at the mill, crossing the Paint Rock Road, Beach Run, excluding a small fraction owned by J?.C. Cain supposed to be 9 acres, excluding a small fraction owned by J.N. Carlock supposed to be 2 acres, and it appearing that J.N. Carlack is dead and left surviving his widow Nancy M. Carlack and two minor children, William C. and John L. Carlack, and Richard Pemberton by petition became a party to the suit and seeks to recover the land, and the cause has been settled and adjusted between the said R. Pemberton, John L. Smith, and the guardian ad litum & sol of the minors, and Pemberton has paid to the said Smith & to the solicitor & guardian ad litum of said minor children $125 and the Chancellor being of the opinion the settlement and compromise is most conclusive to the interest of the minors, therefore ... decree the compromise is confirmed and the title to the land is herby divested out of said John L. Smith and said Nancy M. Carlack & her minor children viz William C. & John L. Carlock and into Richard Pemberton. (FHL film 926,282; SLC 10/5/2011)

Hurt as securities conditioned that she will hold said James Sexton harmless as against her children who are parties to this record claiming the land belonging to them and which she had conveyed to said James Sexton.
