      Z-374: No.545. Joseph C. & Elizabeth Large to Charles Dement. Claiborne Co. TN. This agreement this day entered into between Joseph C. Large and his wife Elizabeth Large of afsd and Charles Dement of Rutherford Co. in said state, that said Elizabeth Large wife of the said Joseph C. Large, is the legitimate daughter of Abner Duncan and Rachel Dunkin, the said Rachel Duncan the mother of said Elizabeth Large having been a daughter of Joshua Ward, brother to the late William Ward of Rutherford Co. TN and the said Rachel Duncan, the mother of said Elizabeth Large being the same person mentioned and called in the will of the late William Ward as one of three daughters of Joshua Ward a brother of the testator, and the said Rachel being now dead, it is supposed by said Charles Dement that the said Joseph C. Large and his wife Elizabeth hath some interest in the estate of said testator William Ward arising and accrue by the will of said William Ward and by the death of said Rachel Dunkin. And the said Charles Dement being anxious and desirous to purchase such interest as the said Joseph C. Large and Elizabeth Large now have in all the estate both real and personal which was of the late William Ward decd. of Rutherford Co. TN, now be it known ... that we the said Joseph C.       Comments by Barbara B.: Dr. William Ward will was written Sept. 21, 1832 and an inventory was taken of his estate April 28, 1836. He apparently had no children (at least none living). He left to his wife Mary (Robertson) and to nephew Thompson Ward son of his brother James and to the three daughters of his brother Joshua: Rachel, Rody and Sealy. Apparently his will left half of the estate to his blood heirs and his wife could dispose of half to her heirs after her death. There were divisions of property by chancery court well after 1850 as Dr. William Ward had a large estate.
      In researching the Ward family of the area, no evidence has been found that Joshua and James, brothers of Dr. William, ever lived in Rutherford county. An 1852 deed in Campbell Co. TN reveals that grandchildren of Benjamin Ward Sr. were releasing interest in estate of Dr. Wm Ward who was a brother of Benjamin Ward Sr. The g-children lived in Anderson Co. and were children of Benjamin Ward Jr. It has not been established if Benjamin Ward Sr. actually ever lived in Anderson Co.
      It has not been determined where Abner Duncan and Rachel Ward married or lived. I have not done any Duncan research in Rutherford Co. as my interest is in the Ward family and time was limited on my trip to the county. Since we don't know where Joshua Ward lived or when he died, this Abner Duncan may be an E. TN family. (MAD: see Washington Co. VA)

      9-64/65: Marshall Duncan, formerly of Edmondson Co. KY but residing at present in Rutherford Co. TN, being in a low state of health, declare the following to be my last will and testament. First, I give to my wife Mary Ann Duncan all the property I now have of every description in either of the states mentioned, to be used or sold as she may think best, for the support and maintainance of herself and for raising, maintaining and educating all my children. Second, I also give to my said wife the interest I now have or may hereafter have in the dower of my mother Dorcus Duncan of Rappahannock Co. VA, the proceeds and profits of which she is to use in the same way and for the same purposes mentioned in the first devise, until my youngest child shall arrive at full age, and then the said dower I wish divided share and share alike between my said wife and all my children.       Record Book 9, pg.215: 21 Sept. 1832, William Ward of Rutherford Co. TN; all my estate except the property hereafter given to my nephew Thompson Ward, should be kept together in the possession of my wife Mary Ward for her benefit, then equally divided, 1/2 when divided to my said wife Mary Ward to dispose of as she wishes at her death; to my nephew Thompson Ward son of my brother James Ward, 7 negroes as follows, Ben a negro man I bought of Risk?, Polly his wife and her 5 children namely Coleman, Pane, Marlin, Eliza & Sarah, and all their future increase; I also give the 1/2 of my property above given to my said wife Mary Ward during her life, to be equally divided at her death between my brother Joshua Ward's three daughters Rachael, Rody, & Sealy, and Thompson Ward son of my brother James Ward. Appoint wife Mary Ward sole executrix. Wit. J.D. Donnelson, Robert Booth, B. Randolph. No court date given, nearby documents recorded Jan. 1836 and June 1835.
      (Bonnie: Rachel Ward Duncan's children initiated a power of attorney for a Levi Waterman to represent them in Chancery Court; if I can now prove that Rachel Ward Duncan and Squire Ward who married Winney Duncan in Washington Co. VA were brother and sister, I will know who Squire Ward's father was. This probate case went on for 15 years or more; William Ward was a large landowner in Rutherford Co., having come in 1804; the inventory takes nearly 20 pages to list, and he owned some 1500 acres plus about 50 negros.)

      Bedford Co. TN, 4 Nov. 1850, appeared William Duncan, aged 56, resident of Rutherford Co. TN; he was a private in the company commanded by Capt. Henry Welch in 5th Reg. of VA Volunteer Militia commanded by Col. McLannahan, in War declared by US against Great Brittain in June 1812; that he volunteered at Harrisonburg, VA, on 14 July 1814 for 6 months; that he continued in actual service for 6 months and was honorably discharged at Norfolk, VA, 29 Jan. 1815; that he has lost his certificate of discharge but which time of service will appear from the muster rolls of said company & the pay rolls. /s/ Wm. Duncan.
      Bedford Co. TN, 29 March 1855, appeared William Duncan, aged 61, resident of Rutherford Co. who was a private in company commanded by Capt. Henry Welch, 5th Reg. VA Militia commanded by Col. McClanahan; volunteered in Rockingham Co. VA on or about 14 July 1814 for 6 months, discharged at Norfolk VA on 29 Jan. 1815; he received Warrant No. (blank) for 90 (80?) acres under act of 25 Sept. 1855 which was sold and transferred. Applies for additional bounty land under act 3 March 1855. /s/ Wm. Duncan; wit. David A? Evans, Augustus H. White, residents of Bedford Co. who know Wm. Duncan.
      Rutherford Co. TN, 23 March 1871, appeared William Duncan, age 76, resident near Fosterville, Rutherford Co., TN, not married; he served 60 days in military service of US in War of 1812; he enlisted in Capt. Henry Welsh's Co., Col. McLanahan 5th VA Regt., at Harrisonburg, Rockingham Co. VA, on 14 July 1814; discharged at Fort Nelson, VA, on 29 Jan. 1815; his time was spent in Fort Nelson in the Artilery Service; he never received any bounty land, was in the service about six months. /s/ William Duncan; wit. Wm. Witson/Mitson, F. Henry?. Form letter from Pension Office to request evidence of enlistment of Wm. Duncan, Claim No. 4101, in War of 1812.

      Pg.907, Hardeman Co.: C.A. Duncan. Among the early settlers of Hardeman Co. was William B. Duncan, a native of SC, who came to this county on a hunting expedition in 1814. He was so well pleased with the country that in 1820 he returned, bringing his family, among whom were Henry W. and Thomas. The former is spoken of in another sketch. Thomas was born in Rutherford Co. TN in 1807. He married Mrs. Nancy Gray, born in 1797. To this union 5 children were born, 4 of whom lived to be grown. Mr. Duncan was a farmer and a Democrat. He died in 1858. His wife's death occurred in 1855. Both were members of the Methodist Church. The Duncan family is of Scotch-Irish descent. The only living son is Calvin A., our subject; was born October 25, 1836, in Marshall Co. MS where his parents lived a short time. His early life was spent on a farm. ... At the age of 18 he began his career as a farmer. In 1861 he enlisted in Co. G of 10th ARK Infantry, Confederate service. ... He was disabled for 9 months, and for 13 months held a prisoner. ... In 1871 he married Miss Sallie Andrews, born in 1852. They have no children, but are raising two orphans. Both Mr. and Mrs. Duncan are active and liberal members of the Cumberland Presbyterian Church. For 45 years Mr. Duncan has been a resident of Hardeman Co. ... stanch Democrat.
