Pg.21 & 22, will of SARAH COBB: I Sarah Cobb of Bedford Co. TN, being of sound and deposing mind and memory, do make and constitute this my last will and Testament.
First It is my will and desire that my funeral expenses and all my just debts be paid, out of any money which may first come into the hands of my Executor.
Secondly I give and bequeath to my niece, Nancy Duncan wife of William Duncan, for her sole and separate use during her natural life, a negro woman by the name of Alay, and her two children George and Jo, together with the future increase of said Alay, and at the death of said Nancy Duncan to her children to be equally divided between them.
Thirdly I give and bequeath to my Grand Niece Mary Powers, daughter of Benjamin Powers, a Negro girl named Lucy aged about four years.
Fourthly I give and bequeath to my friend Daniel Hooser, a Negro boy named a Stephen, aged about nine years.
Fifthly I give and bequeath to David Jenking Whiteside, infant Son of my friend Thos. C. Whiteside a negro boy by the name of Willis - aged about fourteen years.
Sixthly I will and devise my tract of land, being the tract on which my sister Polly resided at the time of her death, to my Niece Polly Kimbro, wife of Allen Kimbro - for her sole and Seperate use, benefit and enjoyment during her natural life, and at her death, to her children, and their heirs &c.
Seventhly It is my will and desire that all the Negroes & their increase, willed and bequeathed to me by my sister Polly Elking- Shall be sold by my Executors as soon after my death as they deem advisable- upon a credit of twelve months at Public Sale, and I will and direct that the proceeds of said Sale when collected, Shall be Equally divided between my brother Phillip Elkins- And the children of my brother William Elkins- and my sister Tabitha Elkins that is to say- Phillip Elkins shall receive one third part of said proceeds- and the children of my brother William one third part thereof and the children of my Sister Tabitha one third part thereof- It is However to be understood, and I so will, that the child or children of any of said children who have already died, or may hereafter die leaving children, shall receive the share of his, her, or their parent.
Eighthly It is my will and desire that my faithful old Negro woman Sarah, and Ame, shall live with my niece Polly Kimbro upon the land devised to her, or shall have a right to live with any person they may select who will support and clothe them comfortably for their services.
Ninthly It is my will and desire that all the balance of my property and effects of every description including the proceeds of the sale of any perishable, shall be applied in the first place to the payment of any debts, funeral expenses, or any other expenses incurred in the administration of my estate, and should there be any surplus remaining after the payment of the same, It shall be equally divided between my brother Phillip, and the families of my Brother Phillip, and the families of my brother William, and sister Tabitha- in the manner stated in the seventh item of this will.
Lastly I constitute and appoint my friend Daniel Hooser, and Thomas C. Whiteside Executors of this Will.

Pg.265: 27 Aug. 1850, decree of court: that James H. Cobb died some years ago, and by will he devised to John W. Cobb a negro woman Liza and her children Amanda, Vina, Margaret, Strowder, Jacob & Eli, who are now in possession of John W. Cobb, and left the remainder to his widow Sarah Cobb; that Sarah Cobb disputed the will and prefers the provisions made by the laws of TN for her support instead of the bequests of the will; that the testator owned the following slaves Ned, John, Lewis, Willis, Stephen, George, Amy, Alcinda, Malinda, Ann, Alsey, and Lucy in addition to the others left to John W. Cobb which are now in possession of the administrator, of which the widow Sarah Cobb's share has been allotted to her; that John W. Cobb the admr. settled his estate with the court, that he has exhausted all the assets of his estate in payment of debts, that he is due $454.47 as admr., and that it is necessary to sell one of the slaves to pay the amount; order to sell one of the slaves.

TN on the waters of Rock Creek, being part of a 5000 acre tract granted by NC to John Nelson and by him conveyed to Thomas Davidson, and by descent and subsequent conveyances, conveyed to said William Davidson, containing 208 acres, being the same part heretofore contracted to be sold to said Josiah Duncan by D.W. McRee, and for the conveyance of which the said D.W. McRee as attorney for William Davidson executed a title bond 10 July 1814, beg. on an ash being the two mile tree on the east boundary line of said 5000 acre tract, and being also Richard Hills NE corner, then ... A. Tally's SE corner, then ... with Tally's & W. McGregor's S boundary ... Simeon Marsh's N boundary, then with said Marsh's & Richard Hill's N boundary line to the beginning, containing 208 acres, warrant title. /s/ William Davidson by his attorney in fact James K. Polk. Bedford Co. TN, 4 Nov. 1850, appeared William Duncan, aged 56, resident of Rutherford Co. TN; he was a private in the company commanded by Capt. Henry Welch in 5th Reg. of VA Volunteer Militia commanded by Col. McLannahan, in War declared by US against Great Brittain in June 1812; that he volunteered at Harrisonburg, VA, on 14 July 1814 for 6 months; that he continued in actual service for 6 months and was honorably discharged at Norfolk, VA, 29 Jan. 1815; that he has lost his certificate of discharge but which time of service will appear from the muster rolls of said company & the pay rolls. /s/ Wm. Duncan.
Bedford Co. TN, 29 March 1855, appeared William Duncan, aged 61, resident of Rutherford Co. who was a private in company commanded by Capt. Henry Welch, 5th Reg. VA Militia commanded by Col. McClanahan; volunteered in Rockingham Co. VA on or about 14 July 1814 for 6 months, discharged at Norfolk VA on 29 Jan. 1815; he received Warrant No. (blank) for 90 (80?) acres under act of 25 Sept. 1855 which was sold and transferred. Applies for additional bounty land under act 3 March 1855. /s/ Wm. Duncan; wit. David A? Evans, Augustus H. White, residents of Bedford Co. who know Wm. Duncan.
Rutherford Co. TN, 23 March 1871, appeared William Duncan, age 76, resident near Fosterville, Rutherford Co. TN, not married; he served 60 days in military service of US in War of 1812; he enlisted in Capt. Henry Welsh's Co., Col. McLanahan 5th VA Regt., at Harrisonburg, Rockingham Co. VA, on 14 July 1814; discharged at Fort Nelson, VA, on 29 Jan. 1815; his time was spent in Fort Nelson in the Artilery Service; he never received any bounty land, was in the service about six months. /s/ William Duncan; wit. Cataloged under Civil War, 1861-1865, pensions, indexes; does not say if Confederate or Federal, but probably Federal. Negative film, some cards much too faint or dark to read, some cards blurred or faded, particularly the service unit and the dates of application. Most of the very faint or dark cards were in a slightly different format, with space for years enlisted and discharged which were sometimes filled in. Many of these were for service in later years, although one or two were for service ca 1866.
Name of soldier, alias, name of dependent widow or minor, service (military unit or units), date of filing, class (invalid or widow or minor or other), Application #, Certificate #, state from which filed (sometimes blank), attorney (sometimes blank, MAD: did not usually copy), remarks. Sometimes the "Invalid" or "Widow" class had an "s" added to it before the application #; occasionally the area for the service information included a circled "S". The minor's name was frequently that of the guardian rather than the minor.
The military unit was frequently the Company Letter, the Regiment Number, sometimes US Vet Vol Inf. (US Veteran Volunteer Infantry), L.A. (Light Artillery), H.A. (Heavy Artillery), US C Inf (US Colored? Infantry), Cav. (Cavalry), Mil. Guards, V.R.C. (?Volunteer Reserve Corps?), etc. Sometimes there were several service units given.
Cards appear to be arranged by the last name, first name, middle initial if any, and state (including "US") of service.

DUNCAN, GEORGE WEBSTER, teacher, author, and general agent University publishing company, was born October 12, 1866, at Rockwood, Franklin County; son of Thomas Alford and Margaret (Hargett) Duncan, the former a private in Company L., Fourth Alabama cavalry regiment, C.S. Army; grandson of Robert and Martha (Hargett) Duncan, the former a native of Tennessee, and of Richard and Elizabeth (Hartis) Hargett, all of Rockwood; great-grandson of William and Ruth (Gregory) Duncan, of Pendleton District, S.C., who removed to Warren Co. KY, later to Bedford Co. TN, and finally, in the first quarter of the 19th century located in North Alabama. The Scotch ancestor of the American branch of the Duncan family was the Rev. William Duncan of Dumfrieshire, Scotland, who was a martyr to the Presbyterian faith and who on January 2, 1665, at the age of fifty-two years lost his life on the sands of Dumfrieshire in the reign of Charles II. The original American emigrant of the Duncan family settled in Westmoreland Co. VA, January 23, 1722. Mr. Duncan was prepared for college in a private school at Russellville, taught by Prof. ....

His parents, natives of NC, were Meredith and Elizabeth (Tucker) Smith, who moved with their children to TN. The parents died in Bedford Co. TN; had eight children; the youngest was David Tucker Smith who married Elizabeth Trollinger of Bedford Co. TN. One daughter of David Tucker and Elizabeth (Trollinger) Smith was Rebecca Smith, b.
