Articles of Agreement 28 March 1811, Dr. James Gustine and wife Mary Anne, Matilda Duncan, Samuel Duncan, James Duncan on behalf of Stephen Duncan and Amelia Duncan, of the one part and Thomas Hagan of Borough of Carlisle, Merchant, of the other part; for $2000 PA money to be paid by 1 July next have sold to said Thomas Hogan all that certain stone house and part of a lot of ground on High Street in Borough of Carlisle adj. James Duncan on the West containing 22 feet in front and running in depth to the end of the lot, the breadth of said house on Front which is 22 feet. It is agreed that the house and part of the lot of ground is to be conveyed in fee simple to said Thomas Hagan free of any priviledge of an alley across any part of the lot in possession of the said James Duncan or of any communication with the Reblich Square across said part of the lot in possession of said James ... the privilege being released to said James Duncan and to be merged and done away on payment of $100 to be paid to the said heirs by the said James ...       U-507/508: 25 Oct. 1811, Bond of Elizabeth Patton of West Pennsborough Twp, Cumberland Co., widow, and James Duncan of Borough of Carlisle in afsd co., to Robert Lusk Esqr. of Mifflin Twp in said county Esqr. for $1500. That an argument in a suit or suits pending in Court of Common Pleas in Cumberland Co. in which Robert Lusk was plaintiff and executors of John Patton are defendants, the following agreement was made, that the amount of principal and interest in the suit is retained by defendants and the defendants agree to give security approved by the court and to indemnify Robert Lusk and account to the legatees of William Patton, and to give to Robert Lusk a release from the guardians of Mary Patton for her distributary part under the will of said William Patton, and pay the costs of all the suits ...       U-671/672: 9 April 1812, John Boden, Sheriff of Cumberland Co., deed poll to David Duncan; that Lewis Peters in the County Court of Common Pleas of Cumberland Co. PA, at January term 1811 by judgment against Stephen Duncan for a debt of $138.70 and $48.06 to the said Lewis Peters for damages, and afterwards on 10 Aug. 1811 directed me to levy the debt and have the money by first Monday of November next; by writ of Fierie Facias seized lot in town of Shippensburgh in the main street adj. house of Joseph Duncan on East and James McGonigal on West, with a log stable thereon, ... sufficient within the term of seven years to satisfy the debt & damages, remained unsold for want of buyers, and afterwards ... on 12 Jan. 1812 directed me to have the money by the first Monday of April then next, on 23 March 1812 sold the house and lot to David Duncan for $161, the highest bidder, this a deed to David Duncan. /s/ John Boden, Shff.       AA-252/253: 19 April 1813, Walter Bell of Borough of Carlisle and James Duncan of same borough, ... tract of land in Mifflin or Hopewell Township ... 110 acres, ... release about 38 acres (too faint) about 7 acres and wishes to reserve the orchard and buildings ... containing about 15 acres, leaving ...; the said Walter Bell to sell to James Duncan the afsd balance containing about 40 acres at the rate of $7 per acre, the said James to patent the same, the said land is to be surveyed off as soon as possible and as soon as the quantity ascertained the said Walter and wife are to execute a good conveyance in fee simple, the said James is to pay the consideration money and Walter allows the said James to retain as much as will discharge the balance due on a deed in his hands at the suit of William Moores Exr. & for the use &c against said Walter but supposed to be between $60 and $70, and the residue of the consideration money is to be applied in part payment of a judgment of said James Duncan against said Walter Bell and the said James agrees on receiving a conveyance for the aforesaid 60 acres to release the lien of his judgment from binding the lands sold Wm. & Jesse? Kilgore and also the land of Ebenezer M. Robinson? and Samuel Hanna so that the residue of said Judgment should fall upon the other property and lands of the said Walter without disturbing the sales made to the aforesaid Kilgore and the said Ebenezer McElwain & Samuel Hanna. Agreement between Mary Duncan, widow and relict of William Duncan Senr. late of West Pennsborough Township, Cumberland Co., decd, of first part, and Joseph Duncan, John Alexander Duncan, David Duncan and Francis Fulton, guardian of Sarah Ann Duncan, Mary Elizabeth Duncan and Nancy Jane Duncan, the minor children of William Duncan the younger decd of the second part, and William Boyd acting executor of the will of said William Duncan the elder decd. of third part; that Mary Duncan, widow, agrees to grant and quit claim her right to any and all bequests, legacies, etc., under the will or at Common Law to the estate both real and personal which her late husband the said William Duncan died seized or possessed, a formal release to be executed by her as soon as the money and annuity hereinafter mentioned are paid and secured, and the release is to ensure the benefit of the said Joseph, John and David and the said Sarah Ann, Mary Elizabeth and Nancy Jane in proportion to their respective interest under the will of William Duncan the elder decd; the parties of the second part agree that Mary Duncan shall receive out of the estate the sum of $80 in cash if she shall require it, ... for keeping house, and that she be provided with support out of the real estate until the same be sold, or the sum of $100? yearly from such time as she shall support herself. She may live elsewhere ... The principal sum after the death of said Mary to be paid to the said parties of the second part in proportion to their respective interests in the estate of said testator under his will.
