      P-768, (2 documents), #07028, 28 Feb. 1828, Agreement between John Tod of Town of Bedford and James Duncan of Yellow Creek; Tod will convey all his right and title in the old Hopewell Works held by Tod by Sheriff's deed and sold in Jan. last as the property of William Lane, to hold to him the said Duncan in fee simple, Tod will not be responsible for the title of said property nor any part of it, but will give a quit-claim deed only, yet Tod will allow or pay the full amount of what shall be necessary to patent the parts not yet patented. Duncan is to pay to Tod $7,400, vizt, $2,000 1 May 1828, same on 1 May 1829, same on 1 May 1830, and residue $1,400 on 1 May 1831, with lawful interest .... There is to be no obligation to pay the money or any part on account of defect of title; if the purchase money is not paid, Tod shall have possession of the property, and Duncan agrees that he will give it up without dispute. /s/ John Tod, James Duncan; wit.       P-768, (Next document), #07029, 3 Nov. 1829, Agreement between James Duncan and John Tod; that James Duncan has made an assignment of all his interest in the Hopewell Iron Works "bot" of John Tod, to his brother Jos. W. Duncan; Tod agrees that if James Duncan procures a reassignment from said Joseph that Tod (if William Lane consents) will cancel and annul a single bill of said Joseph W. Duncan and Paul Morrow dated 5 May 1829 for $3,252 payable to Tod; James Duncan to make up the arrearages; mention of article between Tod and Duncan of 28 Feb. 1828. Wit. L?.M. Barclay, F.B.       B-435: #914, Per warrant 24 Aug. 1785 to Joseph Hurse? for 100 acres and another of same date to William Carlile for 300 acres and another to Charlotte Carlile for 300 acres and another for 400 acres to David Carlisle and another 20 Aug. 1785 for 300 acres to John Jaques and another of 20 Aug. for 300 acres in the little cove in Air Township to John Linn, all of which were entered by James Hamilton and Thomas Duncan and warrants taken out and purchase money thereon paid, and warrants are intended to be taken out for 300 acres in names of John Wilkins, John Fry and Samuel King for 600 acres in the same Twp., now I do declare the said James Hamilton, Thomas Duncan, and myself are equally the proprietors of the said warrants and applications, to hold as tenants in common. 14 Oct. 1785. /s/ David Carlisle. PA, containing 400 acres and allowance of 6% &c surveyed for George Dansdill and Matthew Duncan 19 May 1806 on warrant dated 3 July 1794 adj. lands now of James Kempe and Robert Campbell on the south and other lands of the said Keebaugh on the West and lands now belonging to the heirs of Judge Tode? deceased and others on the North East, it being the undivided half part of the same tract of land lately sold by the heirs of Judge Tode deceased to the said Keebaugh; and Rev. Duncan M.D. and Catherine his wife and Martha Duncan, Mary Duncan and Sarah Duncan, children and heirs at law of Matthew Duncan late of Greenvillage? in the County of Franklin, deceased, do hereby appoint James Meginnis of Dublin Township, Huntington Co. our attorney to sell our undivided half part of a tract of land in Dublin Township, Bedford Co., which descended to us from our said father and which we lately held as tenants in common with the heirs of the Honob. John Tod deceased, and all other land which we own or have any right in or title to in Bedford Co. at such price as he may deem just, and we authorize him to make a deed to the purchasers of the land so it may be recorded. /s/ John N.       X-421/422: John Mower & Dr. Geo. H. Keyser to Wm. C. Kent. 16 Feb. 1848, John Mower and Dr. George H. Keyser of Borough and Co. of Bedford, PA, Trustees of Mrs. Ann H. Duncan, to William C. Kent of City of Philadelphia, for the indebtedness of Joseph W. Duncan to the following named persons & firms of the City of Philadelphia, viz, Wood Abbott, H?o. Waln & Leaning, James Kent & Lantee, and W.E. & J.G. Wheelan, whose claims against him amount to about $2,000, and for the further consideration of $1 to them in hand paid, ... they the said John Mower and George H. Keyser, by deed of trust 11 June 1847 executed to them by John Cessna Esq. & wife Ellen J, conveying to them for certain purposes the property hereinafter described, and per the written consent & desire of Mrs. Ann H. Duncan attached hereto, have granted ... to the said William C. Kent and his heirs all the house and lot of ground known as the "Exchange Hotel" on the NorthWest corner of Pitt and Richard Streets in the Borough of Bedford, Co. & state afsd, and number 179 in the general plan of the town, which became vested in the Hon. Peter Schill, who with Eleanor his wife by deed 22 March 1837 conveyed to Joseph W. Duncan as whose property the same was levied on by the Sheriff of Bedford County who sold to John Cessna Esq. by deed dated 8 June 1847, and all the right (etc.) the said John Mower and George H. Keyser had to the same; to the said William C. Kent, in trust for the use of the said Wood Abbott &c?, Maln & Leaming?, James Kent & Lantee, and W.E. & J.G. Whelan, merchants of the City of Philadelphia, in proportion to the amounts of their claims, so that the rents, issues and profits thereof shall be received by him or such person as the creditors shall appoint; reserving to William C. Duncan to Trustees, to sell &c. 14 Feb. 1848, Whereas by indenture 11 June 1847, executed by John Cessna Esq. and Ellen J. his wife, that the said John Cessna and Ellen J. for the consideration therein expressed did convey to John Mower & George H. Keyser of Borough of Bedford, a certain house and lot of ground situate on the corner of Richard & Pitt Streets in the Borough of Bedford, numbered 179 in the general plan of said Borough, in trust for the sole and separate use of Mrs. Ann H. Duncan the wife of Joseph W. Duncan, so that she alone or such person as she shall appoint shall take and receive the rents, issues & profits thereof, and so that her said husband shall not in any manner in ... therewith, reserving to the said John Mower & George H. Keyser the power to sell the premises ... as the said Ann H. Duncan may direct ...; that it is now proposed to sell and convey the property to William C. Kent of the City of Philadelphia in trust for Wood, Abbott &c, Waln & Larming, James Kent & Lantee, & W.E. & J.G. Whelan, merchants in Philadelphia, for the purpose of paying to them in proportion the several claims which they hold against the said Joseph W. Duncan ... now Ann H.       X-494/495: Samuel Carn Shff to John Cessna Esq. 8 June 1847, Samuel Carn Esq., High Sheriff, of Bedford Co. PA; that Hon. Peter Schell now for the use of John H. Brigg Esq. & Julia A. his wife & Isabella S. Tod (lately) in the County Court of Common Pleas of Bedford Co. ... August term 1844, by judgment of said court, recovered against Joseph W. Duncan as well as a certain debt of $2,164.73, and $4.40 to the said Hon. Peter Schell, use of John H. Briggs Esq. & Julia A. his wife and Isabella S. Todd were adjudged in the same court for the debt and costs aforesaid, and by a writ of fieri facias 3 May 1845, and to John M. Vicker then Sheriff directed, he was commanded to sell goods and chattel, lands and tenaments of the said Joseph W. Duncan to pay the debt ... he seized the tenemant in the Borough of Bedford on the NorthWest corner of Pitt and Richard Streets, three story brick hotel and two story stone kitchen with basement story attached two large stables, ...the said defendant having failed to fully pay the money ... did on 26 April 1847 exposed the premises to sale and sold the same to John Cessna Esq. of Bedford for $3000, the highest bidder. /s/ Saml.       Y-197/199: Robert Duncan's Executrix to David Stoler. 2 June 1833, from Ellen Duncan of Borough of Carlisle in Cumberland Co. PA, sole and only executrix of will of Robert Duncan late of the Borough of Killaning in Armstrong Co. PA, by John Stewart her attorney in fact, appointed by letter of attorney 18 October 1830, to David Stoler of Hopewell? Twp. in Bedford Co. PA; that John Penn and Richard Penn Esq. by deed 8 April 1803 by their attorney John R. Coats Esq. granted the said Robert Duncan a tract of land then situate and supposed to be in the County of Huntingdon now situate in Bedford Co. PA, being part of the proprietor's manor of "Highlands" containing 475 acres 135 perches and also a certain other part of the said manor "Highlands" containing 142 acres 7 perches; that the said Robert Duncan in his lifetime by article of agreement between him and the said David Stoler 19 March 1804 agreed to sell to David Stoler a certain part of the said manor of "Highlands" conveyed to the said Robert Duncan, supposed to contain by certain corners and distances 145 acres and 109 perches but which is now ascertained to contain in the said distances and boundaries 152 acres and 12 perches and allowance, and David Stoler has since occupied and had in his possession at the price of $2.50 per acre; NOW the said Ellen Duncan as executrix by her attorney in fact, and in consideration of the sum of $196 paid by the said David to the said Robert Duncan in his lifetime in account of said contract, and the further sum of $100 like money paid by the said David in 1818 to James Duncan who was surety of the executors of the said Robert Duncan deceased, and the further sum of $335.88 paid by the said David Stoler to the said Ellen Duncan, the said Ellen Duncan, sole executrix of the will of Robert Duncan having died in the year 1807, grant to David Stoler all that parcel in Hopewell Twp, Bedford Co., being part of the said manor of "Highlands" containing 152 acres and 12 perches, as agreed, adj. land of Samuel Broade?, crossing a road, lands of Abraham Kerns, lands of John Stoler, ... her the said Ellen Duncan as widow and relict of the said Robert Duncan, deceased, ... /s/ Ellin Duncan by her attorney in fact John Stewart. PA, to John Baynton and Samuel Wharton of the City of Philadelphia in the said Province, merchants, for £100, two tracts of land and improvements near Bedford Settlement in Cumberland Co. afsd, further the late purchase made of the Indians by the Honorable the Proprietories of said Province, further described ... one of said tracts located and improved by John Cessac? Junr. of said county, yeoman, is said to be adjoining the lands of Charles Parks and William Roberts and near the WCarder's? Mountain which tract is said to contain 200 acres more or less, location and improvements thereon made the sd. John Cessne? by his deed pole of 26 March past for £40 sold to said Daniel Duncan ... and the other of them on the ?? Road that leads from Fort Bedford to Fort Cumberland, located and improved by said John Cessne, bounded by lands of Andrew Steel? alias Andrew Steel on the NE and on the West by Thomas Jones alias Thomas Jones which tract of land said to contain 200 acres more or less, location and improvement made by him the said John Cassnec?, he by his deed poll of 27 April past for £40 sold to said Daniel Duncan the said two tracts of land containing by computation 600 acres of good and tillable land, together with buildings, gardens, etc., the said two tracts containing together 600 acres ... to hold one undivided moiety or equal half part of the two tracts hereby granted to said John Baynton, the other moiety to the said Samuel Wharton ... /s/ Daniel Duncan. Kerns on upper corner of fence of land belonging to said Duncan purchased of J. Steele, to top of mountain ... corner near the River. In consideration, William Lane is to have his choice at the end of a month either to take $1 per acre in Bar Iron, $5 or wood leaf of 12.00 cords granted to him, per agreement 17 May 1827 in hands of Jno. WHEREAS said Hugh Denison decd. died intestate seized of the above several tracts of land in Providence Twp. which descended per law of Intestates to the widow and children (to wit: Bailley Denison, Jane Denison, Rebecca Denison, Horatio Denison, Mary Denison and Agnes Amanda Denison) of the said Hugh Denison decd; and the widow (formerly Mary Denison now Mary McMullin having married John McMullin) in connection with her husband and two of the above heirs, viz, Bartly Denison and Jane Denison, had attained their majorities, by deed 4 Feb. 1832 granted their right etc. (and also all the estate of the above named minor children whose releases are to be obtained as soon as they attain legal age) to the above tracts of land to James Reesides of City of Philadelphia, and whereas another of the heirs, Horation Denison, having since then attained his majority released on 19 April 1834 his interest to James Reesides, NOW this indenture that James Reesides and wife Mary for $9,000 to Andrew Duncan, all the above mentioned and described several tracts of land. /s/ Jas.
