      11-458: 23 July 1823; that by Act of the Ohio Legislature 25 Feb. 1820, William Creighton Junr. was appointed trustee for the heirs of Nathaniel Massie decd. late of Ross Co. OH, he refused to serve, Cadwalader Wallace of Ross Co.       19-269/271: That at a Court of Common Pleas of Adams Co. OH at March term 1835, Amos Dunkin, administrator of estate of Charles Osman decd, petitioned the court against Margaret Osman and Sally Ann Osman the heirs of said Charles Osman decd and Emily Osman the widow of said Charles Osman, showing that he had administered the personal property or estate of the decedent and after paying the expenses of the last sickness and funeral charges and the costs of administration, there was not personal property sufficiesnt to pay all the legal claims of the decd, and asked for authorization to sell the only real estate which the decd. had acquired the legal title to, to pay the debts and claims against the estate; the tract (neighbors not given) is 50 acres on the waters of Scioto Brush Creek in county aforesaid excepting the right of dower of Emily Osman the widow for her life; the court agreed, the administrator should by the oaths of Parker Truitt, John W. Timmonds and Jacob Easter, 3 freeholders of county aforesaid, cause the lands to be valued and appraised; that at the March term of said court 1836, the freeholders appraised the land at $75, the court ordered the administrator to sell the whole tract subject to the widow's dower; at the July term (1836) the administrator reported on the sale; that he advertised the land on 6 April (1836), and sold on 11 June to Gordon Derrough the highest bidder for $50, being 2/3 the appraised value.             John Spahr, James Morrison and Peggy his wife late Peggy Spahr, Mattarn Spahr, Reason Spahr, Dunkin Spahr, Samuel Spahr, Sarah Spahr, (Bill Fisher comment: Children of John Dunkin Sr.'s daughter Sarah Dunkin who married Mattarn Sphar II)
            Amos Dunkin, Samuel Dunkin, the two minor children of Elizabeth McLaughlin, names unknown, John Dunkin, Thomas Dunkin, Joseph Dunkin, Joshua Dunkin, the minor child name unknown of Sarah Hemphill (Iris Grimmett comment: Children of Herecules; These are all names listed in the will of Hercules),
            Henry Young and Elizabeth his wife,
            and Joshua Dunkin (Iris Grimmett: son of John Sr.)
            and other unknown heirs, if any, of said John Dunkin, Senior, deceased, including Henry Spahr and Betsey Spahr and Polly Spahr, if still living,
            defendants; stating that in virtue of a contract with certain of his said co-heirs and their ancestors, heirs of said John Dunkin, Senior, deceased, and on general equitable principles, the said petitioner was entitled to a compensation for supporting and maintaining Margaret Dunkin, who was the widow of said John Dunkin, Sr., deceased, and mother and grandmother of said petitioner, John Dunkin, and of said defendants.
            That said John Dunkin, Sr., deceased, died siezed and possessed of certain real estate in said petition and hereinafter, and said real estate was equitably and by contract subject to the payment of said petitioner, John Dunkin's just claim for the support and maintenance of said Margaret Dunkin; and said petitioner prayed that said real estate might be sold and the proceeds or the necessary part thereof be applied to the compensating of said petitioner in the premises. On which petition such proceedings were had, that said court at the September Term thereof, AD 1845 being satisfied that said defendants had previously to the Term than last preceeding been legally notified of the pendency and prayer of said petition; and the minor defendants having by their guardian ad litem, answered said petition, and the adult defendants having failed to answer said petition, thereupon, at September Term AD 1845, of said Court, said petition was taken for confessed as against said adult defendants.
            And the Court having at said September Term AD 1845, seen and inspected said petition and exhibits & proofs in the cause and considered and advised of and concerning the premises, did find and adjudge that there was equitably due to said petitioner in the premises, the sum of $692.70.9; and did order, adjudge and decree that said real estate be sold to satisfy said sum so found and adjudged to be due him; and that Jacob Trebar, John Oliver and Daniel M. Bryan, three disinterested freeholders of said county, appraise said real estate under oath, and return their appraisment at said September, or the next Term, of said Court.
            And at said September Term of said court, said freeholders made return to said court of an appraisement of said real estate, under oath, and said court having seen and inspected, approved said appraisement and thereupon at said September Term did order and decree that the Sheriff of said county, for the time being as special commissioner, should proceed to sell said real estate at the court house in West Union, on terms in said decree specified, first giving thirty days notice of said sale as in cases of real estate sold under execution, and not selling said real estate for less than two thirds of its appraised value. And afterwards, at the March Term of the said court, 1846, Fields Marlatt, late Sheriff of said county, reported to said court, that he had duly offered and exposed said real estate for sale as required by law and the order of the court, and that said John Dunkin, the petitioner, being the best bidder, became the purchaser of said real estate at $4.34 per acre, that being full two thirds of the appraised value of said real estate, and amounting to the sum of $558.23-1/4.
            And said Court having seen and carefully examined said late Sheriff's report of sale of said real estate, and being satisfied that said sale had been fairly, regularly and legally made, did at said March Term 1846, approve and confirm said sale, and ordered that the present Sheriff of this County execute to said purchaser and his heirs, a deed of conveyance of and for said real estate which was bounded and described as follows, to wit:
            105 acres, a part of Benjamin Goodin's survey #3824, on a hill side, adj. Robert Rankin's survey and line, deeded to said John Dunkin, Senior, by said John Dunkin, the petitioner & his wife.
            Also 23 and 5/8 acres, part of Survey #2470, deeded to said John Dunkin, Senior by Valentine Fear & wife.
            Now William Smith, present Sheriff of said County, in consideration of the several premises aforesaid, ... to said John Dunkin, the petitioner, the two parcels of land aforesaid, with the profits and appurtenances thereto belonging or appertaining. To have and to hold said two parcels of land with the profits and appurtances, to the said John Dunkin, his heirs and assigns. /s/ 5 March 1846, Wm. Smith Shff of Adams Co.; wit.
