      William Duncan of Pontotoc Co. MS; wife Sarah during her natural life that part of Sec. 12, Twp. 8, R. 10E now belonging to me and 100 acres off W. side Sec. 7, Twp 8, Range 10E, Chickasaw survey, MS, being about 300 acres so as to include my present dwelling house; also as many of my negroes as she shall choose to select and as much stock and farming implements during her life, then to descend as below. All my property, subject to above request, to my children Nancy Hardy, Elizabeth Davis, Polly Heargrove, James Duncan, Sally Cole, William M. Duncan, Ivey H. Duncan, Andrew J. Duncan, Malinda Cobb, Sucinder Collims (sic), to be equally divided; if any of them be deceased, then the children to receive share of deceased parent. Except Mrs. Hardy, Mr. Hardy has had an advance of $1020, this amount first to be deducted from interest of the children of said Mrs. Hardy then all to share and share alike.             11-679: 18 March 1859, report of W.M. Bell, "the undersigned administrator of the Estate of Thomas L. Duncan deceased respectfully represents unto your Honor that at the March term 1858 of your Honorable Court he was appointed administrator of said estate being at the time of said appointment Shff. of said County, that since this term of office has expired and as by law required, he begs leave to report progress in said administration and to be discharged from further settlements of said estate. The said Administrator has received nothing and disbursed nothing on account of said estate; he prays your honor to appoint some other administrator and that he be discharged from any payment of cost as he has not realized anything from the assets of said estate, as by law he is exempt from cost in such cases and as in duty bound &c.

      5-135: Petition of Wm. M. Duncan and James W. Duncan for letters of administration on estate of William Duncan decd; that sometime during the month of October last William Duncan late of said county died leaving a will; witnessed by Shelton R. White, C.G. Mitchell and John A. McNeil; that the will appointed his sons executors thereof but that Jeremiah W. Duncan and Andrew J. Duncan have renounced their executorship. That William Duncan died owning a large real and personal estate consisting chiefly of a plantation of land on Oconitahatchie Creek and about 44 negro slaves, stock, etc., said personal estate worth about $25,000. Duncan for resignation of guardianship of George Blackwell et al; that at the last term he was appointed guardian of all the children of Nicholas Blackwell decd late of your county, that he gave his bond as such but that no letters of guardianship were ever issued or at least never came into his possession, neither was he ever sworn in ... he has no property or effects in his hands belonging to said children and none of their property has ever come into his gands as guardian ... he wants to renounce his guardianship. /s/ Jeremiah W.       5-194 to 195: Petition of A.J. Duncan & Jeremiah W. Duncan for sale of the real estate of William Duncan, Pontotoc Co. MS; that in the month of October last William Duncan late of said county died leaving a will which has been duly exhibited, admitted to probate, letters testamentary granted to William W. Duncan and James W. Duncan the persons therein named as executors. That the testator left a widow and ten children of which your petitioners are two, and according to the terms of the will the real and personal estate of said testator, after 300 acres named in the will should be set apart for the widow, was to be equally divided between the children of said testator or their representatives in equal shares except that part of the personal estate which she should select, that the land be divided so divided is all lying in this county, Sec.7 & 8 of Twp.8 Range 3E, the N 1/2 Sec.13 Twp.8 Range 2E less 40 acres belonging to one of your petitioner; also the NE 1/4 Sec.23 Twp.7 Range 2E and the NW 1/4 Sec.34 Twp.8 Range 3E and a fractional part of Sec.12 Twp.8 Range 2, which petitioners believe cannot be divided in such a manner as to render the shares equal in value or in quantity from the fact that some of it is remote from the other and of different grades or value. Petitioners further show ... that should the petiltion for sale be deferred until a later term, that the sale would be necessarily thrown into the ensuing spring of 1851 at which time petitioners believe that it would not be so valuable ... because purchasers would have provided themselves with land suitable for farming before the date of the sale. Duncan, one of the executors of the will of William Duncan decd. late of Pontotoc Co., that the testator devised to his wife Sarah Duncan for life a tract of land of about 300 acres including the dwelling house, known as part of Sec.12 Twp.8 Range 2E then belonging to the testator and 100 acres off the west side of Sec.7 Twp.8 Range 3E of the Chickasaw survey in MS in Pontotoc Co. MS; that parcel of land was to be under the entire possession of Sarah Duncan during her life and at her death to revert to her estate and be divided among her children or their representatives. That said Sarah Duncan died this last spring and the land must now be disposed according to the will, that there are undistributed shares of the estate and from the nature of the land it is impossible to divide it into ten equall portions ... request sale of the land to equally divide the proceeds. Mitchell gdn of Sarah L.A. Duncan, C.C. Jones gdn. of Thomas H. Duncan and Nancy Duncan, 13 Dec. 1867.
