A-144/145: 31 Aug. 1837, Thomas J. Bounds as Commissioner of the Seat of Justice of Shelby Co. MO to Robert Duncan of Shelby Co. in said state, that Robert Duncan on 31 May 1836 in compliance with the terms of sale per Order of the Shelby Co. Court made at May term of said court, became the purchaser of Lot or parcel of land for $10.37-1/2, and in consideration of $10.37-1/2 paid, the Commissioner sells to said Robert Duncan certain lots or parcels of land in Shelby Co. in the town of Shelbyville laid off as the seat of Justice of said county, and known and designated on the recorded plat of said Town as Lot No.2 in Block 28, with appurtenances, warrant title. /s/ Thomas J. MO, to Anthony Blackford of afsd, that whereas certain writ of fieri facias execution was issued by the clerk of the circuit court for afsd Shelby Co. 13 Feb. 1841 to said sheriff in favor of Thomas J. Homer against Robt. Duncan, reciting that Thomas J. Homer on 24 Nov. 1840 at Circuit Court for Shelby Co. recovered against Robt. Duncan, William J. Holliday, William B. Broughton and Obadiah Dickerson for debt the sum of $281.67 and $18.75 damages by reason of the detention of the said debts, and also $8.42 costs, and the writ commanded said sheriff that of the real estate of said Robert Duncan, William J. Holliday, William B. Broughton and Obadiah Dickerson should cause to be made the debt etc. ... and the afsd Moss sheriff should have the same before the Judge of our court on 4th Monday in March 1841, ... writ came to the hands of afsd Russell W. Moss, Sheriff, on 17 Feb., and sheriff levied upon the interest of said Robt. Duncan to all that real estate in Shelby Co. MO, the NE 1/4 Sec.28 Twp.57 Range 9 containing 148 acres, and said sheriff after notice, sold at public sale on 28 March 1841, and Anthony Blackford the highest bidder became purchaser for $402, now for $402 paid by said Blackford to said Moss, sheriff, the said Russell W. MO, one of 360 acres and the other of 80 acres, conveyed to me by Russell W. Moss, Sheriff of Shelby Co., refer to deeds of record in last mentioned county, ... to the sole use and benefit of my daughter Polly Broughton during her natural life, not subject to the debts, liabilities or control of her husbnd whomever he may be, and after her death the tracts of land are to go to and be equally divided between all of her children or their legal heirs, and the will appointed Anthony Blackford, Nathan Blackford and William Duncan the executors thereof, and the two latter of whom have heretofore qualified as such in the County Court of Jessamine Co. KY, ... now, we Nathaniel Blackford and William Duncan, executors of said will of Jessamine Co. KY, reposing full confidence and trust in our friends William B. Broughton of Shelby Co. MO and husband of said Polly Broughton, appoint him our attorney to hold said tracts of land and apply the proceeds, proffits and issues to the use of his said wife Polly as directed in said will, and we hereby give to said William B. MO, one of 360 acres, the other of 80 acres, conveyed to me by Russell W. Moss, the Sheriff of Shelby Co., ... to hold said tracts of land ... to the sole use and benefit of my daughter Polly Broughton during her natural life, not subject to the debts, liabilities or control of her husband whomsoever he may be, and after her death said tract of land to be equally divided between all of her children or their legal heirs. Fourth, I authorize my executors to sell the balance of my estate and convert the same to money and give 1/10 to my daughter Desire Gosch?, 1/10 to my son Anthony Blackford, 1/10 to my daughter Nancy Duncan, 1/10 to my daughter Polly Broughton, 1/10 to my son Nathaniel Blackford, 1/10 to my son Hardin Blackford, 1/10 to my son Isaac Blackford, 1/10 to my son James Blackford, 1/10 to my daughter Catharine Vanordall and 1/10 to the children of my son John Blackford decd. Fifth, I have kept and intend to keep a book of charges against my children in which I will charge them with all the advancements, ... they shall be responsible for the same in said division. Sixth, whatever of my estate shall fall to my dau. Polly Broughton under the 4th item shall be held by my executors in trust for her sole use and benefit as the estate left her in the third item ... Seventh, whatsoever of my estate shall fall to my dughter catharine Vanardall shall be held by my executor in trust for her sole use ... not subject to the payments of the debts of her husband, ... and if she dies without issue and any of her estate shall be left, it shall be equally divided as in the fourth item. The balance of my estate is directed to be divided among my children and grandchildren but if she have issue living, at her death, then whatever of my estate may be remaining shall go to said issue. G-95/97: 11 June 1855, Tandy Gooch as administrator of estate of Robert Duncan decd. of Shelby Co. MO to Mildred Duncan of same county, that a petition for sale of the real estate of said decd, for the following reasons, it appears that deceased bought a tract of land from Hill Shaw and died leaving $270 still unpaid of the purchase money, the County Court having jurisdiction of the administration of the estate of said deceased; the County Court on 8 May 1855, proving said petition for the purpose of raising funds for the payment of the debts of said deceased, the personal estate being insufficient, made an order requiring the administrator to sell at public auction for cash all of said deceased's interest and title to the following real estate, part of E 1/2 of NW 1/4 Sec.28 Twp.57 Range 9W containing 60 acres more or less, in Shelby Co. MO, ad J.B. Hardy, Henry Dill and J.E. Utry?, 3 disinterested householders on 23 May 1855 apapraised the tract of land at the aggregate sum of $180 ... proceed to sell on 11 June 1855 at public auction to highest bidder the above tract of land for cash, and said Mildred Duncan was highest bidder for $30 and became purchaser thereof and paid the purchase money, and actions of administrator were reported to County Court and at June term 1855 duly approved, Now the said Tandy Gooch as administrator for $30 paid, sell to said Mildred Duncan the interest of said Robert Duncan decd. to the said tract of land, with appurtenances. /s/ Tandy Goody, Admr. of the Est. of Robert Duncan, decd.
