MO, 16 Feb. 1826, the following order was made as will appear in Record Book A, pg.97, to wit, on the motion of William Duncan who has proved here in court that a mistake was committed by Green Dewitt former Sheriff of Ralls Co. on 20 August 1822 when he inserted or caused to be inserted in a deed by him made to William Duncan and acknowledged on 21 Aug. 1822 for certain lands adjacent to Palmyra and for certain lots in the Town of Palmyra sold by said Sheriff as the property of Joel Shaw decd. to said Duncan as the highest bidder, lot No.1 in Block 8, whereas he ought to have inserted Lot No.5 in Block No.8, therefore it is ordered by the court that the Sheriff made a deed to said William Duncan for Lot No.5 in Block No.8 in the town of Palmyra in Ralls Co., now therefore I, Joseph Wright, Sheriff of Ralls Co. MO, ... per afsd order and for consideration money paid by said William Duncan to said Green DeWitt former sheriff, $276.81-1/2, being the purchase money paid for the afsd lot in town of Palmyra and for other lots and lands as will appear by reference to the deed of said Green DeWitt former Sheriff of Ralls Co. to said William Duncan dated 20 Aug. 1822 and recorded in Deed Book A, pg.136, and following, in Ralls Co. Brown, both against Benjamin Duncan, the first for $47.50 with interest at 6% per annum from 1 Oct. 1830 until paid, besides costs, the other for $32.87-1/2 besides costs, which executions were directed to the Sheriff of Marion Co. afsd and put into the hands of said Joshua Gentry as Sheriff on 21 Jan. afsd, and said Joshua Gentry as Sheriff in virtue of said executions did on 21 Jan. afsd levy upon all the right, title, ... of said Benjamin Duncan to the lot or parcel of ground in town of Palmyra in county afsd, Lot No.3, block No.1, Range 1W, with appurtenances, and said Joshua Gentry as Sheriff did on 31 Jan. 1831 advertise ... and on 25 Feb. 1831 sold to highest bidder, Abraham Huntsberry became purchaser for $60. Now this indenture, the said Joshua Gentry for $60 paid, sell to said Abraham Huntsberry the interest of said Benjamin Duncan to the afsd lot or parcel of ground, with appurtenances, subject to the lien of all prior judgements and decrees to the ones rendered herein against Benjamin Duncan in favor of said Huntsberry & Brown and John Vannoy ... MO at July term 1858 and on 31 July 1858, proceedings were had on a petition for partition wherein James H. Roland and Sally Anne his wife formerly Sally Ann Reynolds, Enoch Beand??? iof (too dark) ... Jane Reynolds, John M. Reynolds and Woodward ?. Reynolds were plaintiffs and Martha Ellen Reynolds by her guardian at litem? Keefus E. Anderson was defendant, this cause coming on to be heard ... petition of plaintiff's answer of guardian ad litem and proofs in the cause, the court found that Eliza Ann Reynolds, the maternal ancestor of the plaintiffs and defendant died seized in fee in her own right of lot No.4 in Block No.31 in City of Palmyra, Marion Co. MO, 66 feet front by 127 feet back, and upon the death of said Eliza Ann Reynolds the said lot descended to her said children in fee in equal shares, being 1/5 part of said lot to each of said children. The Court found that partition of said lot should be made between the heirs according to their interests as herein declared, and ... partition in kind cannot be made without great prejudice to the owners. It was decreed by the court that the sheriff of Marion Co. sell the lot, for 1/3 cash in hand, 1/3 in 6 months and 1/3 in 12 months, to bear interest from date at 105 per annum until paid, with security, withhold title until purchase money be fully paid. Order of sale issued on 23 Sept. 1858, ... Sheriff exposed to public sale to highest bidder, 15 March 1859, John C. Duncan being highest and best bidder became purchase at sum of $155 and the further sum of $7.74, being the interest on the purchase price of said lot, paid by said John C. Duncan, sell to said John C. Duncan the claim of said James H. Roland and Sally Ann his wife, Enoch Brandenburgh and Eliza Jane his wife, John M. Reynolds, Woodward J.
