      STATE ex rel. WILLIAM DUNCAN, Petitioner, v. JOHN C. PRICE, Judge of the Lawrence Circuit Court, Respondent; Supreme Court of Missouri, Jefferson City; 38 Mo. 382; July, 1866, Decided.
      Petition for Mandamus.
      WAGNER, JUDGE, delivered the opinion of the court. This was a petition for a mandamus against John C. Price, Judge of the Thirteenth Judicial Circuit Court in this State. The petition alleges that on the -- day of May, 1864, David E. Gibson recovered judgment against the relator, Duncan, in the Lawrence county Circuit Court, of which court the respondent was presiding judge, for the sum of three thousand eight hundred dollars and costs; that on or about the 15th day of October, the relator, after giving due notice to said Gibson, presented his application to the judge of the Lawrence Circuit Court praying for an injunction to restrain the said Gibson from enforcing the judgment; that the said judge granted the prayer of the petition and issued a temporary injunction in the cause, and that the same was duly served on Gibson, and that the final hearing was set for the May term of the court, 1866. At the May term Gibson appeared and filed his demurrer to the petition, and then filed a petition for a change of venue in the cause to some other circuit, alleging as a ground of change that the judge of the court was prejudiced against him, and that the security on the injunction bond was a relation of the judge. The court thereupon ordered a change of venue to Greene county, in the 14th Judicial Circuit, and refused to further proceed with the cause.
      The relator contends that no change of venue is authorized or allowed by law in such a case, and that the Lawrence Circuit Court could not divest itself of jurisdiction, but was bound to proceed to hear and determine the cause. A strict literal interpretation of the statute might give some countenance to this position, as it is declared that "proceedings on an injunction to stay a suit or judgment shall be had in the county where the judgment was rendered or the suit is pending, and the summons may be directed and served as summons in ordinary cases" -- R. C. 1855, p. 1248, Sec. 5. But it is also provided that a change of venue may be awarded in any civil suit in any Circuit Court where the judge is interested or prejudiced, or is related to, or has been of counsel in the cause for either party -- ibid. p. 1559, Sec. 1. It cannot be presumed that section five in the Practice Act was intended to deprive a party of his right to a change of venue for any of the causes specified in the general law regulating changes of venue.
      We will not suppose that the Legislature was guilty of the absurdity of compelling a party to proceed and submit his cause to a judge who is so prejudiced against him that he cannot do him justice, or who is related to one of the parties, or who has been counsel against him; or if he refuses to make such submission, that then he must be deprived of all remedy or claim to have his rights adjudicated. We think that the fair and reasonable intendment of the statute is, that proceedings on an injunction to stay a suit or judgment shall be instituted in the county where the judgment was rendered or the suit is pending, and then, if the judge is disqualified, a change of venue may be awarded as in other cases.
      The change of venue was rightfully awarded, and after the order providing for the change was made the Lawrence Circuit Court ceased to have any further control or jurisdiction over the case, and very properly refused to proceed to hear and determine the same.
      The mandamus is refused, with costs. Judge Holmes concurs; Judge Lovelace absent.

      WILLIAM DUNCAN, Respondent, v. DAVID E. GIBSON, Appellant; Supreme Court of Missouri, Jefferson City; 45 Mo. 352; January, 1870, Decided.
      Appeal from Third District Court.
      CURRIER, JUDGE, delivered the opinion of the court. This is a proceeding in equity to restrain a judgment at law. It appears from the record that Gibson, the present defendant, commenced a suit against Duncan, the present plaintiff, returnable to the Lawrence County Circuit Court at its May term, 1864. The suit was instituted in March of that year, and Duncan was personally and seasonably served with process. The petition in the case counted on a promissory note alleged to have been executed by Duncan, and which was alleged to have been lost or destroyed. Duncan did not appear to the action or make any defense, and judgment was in consequence taken against him by default.
      On the 20th of October, 1865, the present proceedings were instituted to enjoin the judgment rendered in the former suit. As grounds for the injunction, it is alleged that the judgment was founded upon a note which had been fully paid, satisfied, and surrendered prior to the commencement of that action, and that the plaintiff therein was well aware of the fact at the time; that, notwithstanding the groundlessness of the suit, the defendant therein (the present plaintiff) was deterred from making any defense thereto, because of "threats of violence to his person; which threats (the petition alleges) were avowed and put forth by persons of dangerous conduct and vicious habits;" whereby, it is further alleged, the defendant (present plaintiff) "had good reason to fear, and did fear, that if he appeared at the May term of the Lawrence Circuit Court, the time when said summons was returnable, his life would be taken." The petition is voluminous, but the foregoing exhibits the substance of its material parts. The defendant demurred to the petition, and thus raises the question whether the plaintiff has shown, by his allegations, a sufficient excuse for not making in the former suit such defense as he might have had thereto while the same was pending. The Circuit Court granted the injunction, and the District Court affirmed its judgment. The defendant brings the case here by appeal.
      It is a well established principle that, in cases of this class, the complainant must not only show that he had a good defense to the suit, in which the judgment sought to be enjoined was rendered, but also that he had used all reasonable diligence in his endeavors to make such defense available in that suit. If the failure of the defense resulted from the defendant's own negligence, inefficiency, and want of care, he is thereby shut out from the remedy by injunction. It has repeatedly been so held by this court, and there is no occasion for a further discussion of the subject at this time.
      An application of the principle above announced, to the facts disclosed in the plaintiff's petition, is fatal to the case. He shows no diligence, or that he made any effort whatever to defend against the suit at law. He does not appear to have even taken the trouble to consult counsel on the subject. His fear of harm, in case he made his personal appearance at the Lawrence Circuit Court, furnishes no excuse for his neglect to employ an agent to look after his interests. The alleged threats, instead of furnishing an excuse for his remissness in this respect, exhibit his negligence in a more remarkable light. There is nothing to show that his personal attendance at court was in any way necessary to the transaction of whatever might be required to be done at the return term of the writ, or that an attorney could not, in the absence of Duncan, have done all that was necessary. But the plaintiff employed no agent or attorney, nor did anything looking to a defense of the suit, so far as appears. He was personally served with process, and thus apprised of the claim being made upon him, but seems, nevertheless, to have treated the process of the court with entire indifference, permitting judgment to go against him by default. He must abide the consequences of his remissness and folly. The case of George v. Tutt, above cited, presents quite as strong grounds for an injunction as appear in the case at bar.
      With the concurrence of the other judges, the judgment will be reversed and the petition dismissed.

      Among the first settlers of Lawrence Co. MO were Samuel Williams from Tenn., Jesse Duncan, Jesse Williamson from Northern Missouri, Alfred Moore from Ark, and John Patten from Tenn. and Boland Baw from Va.
      Pg.974, Lawrence County: RICHARD THOMAS REED, stockman and farmer, was born in Allen Co. KY, April 25, 1835, and moved to Missouri in 1854. He first located in Jasper County, but at a later period, the same year, came to Lawrence County. He is a son of Richard and Frances (Duncan) Read, and grandson of Robert and Nancy (Browning) Read. They were all born in Virginia, the father being a native of Culpeper County, and a farmer and mill-wright by trade. The grandfather was also a mill-wright and farmer. Richard T. Reed, our subject, was married to Virginia Morris, who was born in Allen Co. KY, October 31, 1842, and by her is the father of the following family: James Henry, Nancy Sarah, Donna Arabelle, Isadora, Mason Theopolis, Charles Sanders (no comma) Ludia Martin, Ida Alice and Abbie Louella. The family are members of the Baptist Church.

Mr. Duncan was married December 28, 1865, to Mary E., daughter of Josiah Mason, Esq. She was born May 7th, 1842. Their union has been blest with eleven children, viz.: Wm. H., born October 26th, 1866; Tennessee M., born February 23d, 1868; Josiah H., born May 25th, 1869; Mary C., born October 19th, 1870; Mattie, born February 16th, 1872; J.K.P., born June 2d, 1873, and died September 26th, 1873; Edward W., born March 26th, 1875, and died May 27th, 1877; Rosa, born July 3d, 1876, and died November 17th, 1876; Cinderilla, born November 25th, 1877, and died February 8th, 1879; Cora A., born January 6th, 1880; and Hale S., born March 21st, 1882. Mr. Duncan and wife are members of the Sac river Baptist church.

      Pg.159: H.S. DUNCAN. ... The number who achieve success (very small, if without family inheritance or extended learning) possess indomitable will power, untiring energy and an unusual amount of native shrewdness and ability. Such a man is H.S. Duncan, the subject of this sketch, who in connection with J.B. Hamplin, is engaged in the abstract and loan business. This company was formed about 1887 and the office was located in the postoffice addition until 1890, when it was moved to the courthouse annex, room 2. Mr. Duncan was born in TN, but as he came to MO with his father when a boy of 3, naturally all his recollections are of this State. His parents, Dennis and Malinda (Hope) Duncan, were among the early pioneers of Lawrence Co. MO and there passed the remainder of their days. Of the family born to this couple, three besides our subject are now living in the neighborhood of Ash Grove, Greene Co. MO. Hugh R., James K.P. and Tennessee E. who married William F. Barham. After the death of her husband, Mrs. Duncan married Thomas L. Wilson who died in 1863. Two children were the fruits of this union: John Wilson and Cordelia, who married R.E. Hudgings. The Duncans were among the early settlers of TN as well as MO, coming to the latter State as early as 1846. The members of this family were of Scotch descent and inherited all the push and perserverance of those of that nationality. The youthful days of our subject were spent in Lawrence Co. and he there received his education. In 1861 he enlisted in Co. E., 16th Reg. MO Volunteers, in Gen. Parson's brigade and served 4 years; some of the engagements in which he participated were Lexington, Lone Jack, Newtonia and others; he was also at Little Rock, was taken prisoner and sent to St.Louis; from there he was sent to Camp Douglas and paroled. After the war he engaged in farming but during the winter season attended school and in 1869 began teaching. This he continued until 1873, when he became a merchant. The year 1882 he was elected county collector and served two terms, 4 years in all. Real estate business ... Home is presided over by his wife, who was formerly Miss Mollie C. Robbins, native of TN and the dau. of Harvey Robbins who died when Mrs. Duncan was an infant. Three children born to Mr. & Mrs. Duncan: Lula, William T. and Ralph, the youngest now in school. ...
