      A1-1: County Court 23 Feb. 1835. William L. Duncan, admin. of John Duncan decd, came into court and after ... his accounts, he is allowed a credit of his account on the Probate Ledger of $29.75 and charged or debit in amount of $56.19 per reference to Intestate Ledger.
      A1-15/16: November term 1836, Court met, ... On motion Green L. Renfro Admin. of the Estate of James Renfro Decd. and makes settlement with the court and waves the nessity of a notice and admits the justice of an account against said estate in favor of John Duncan Esq. an amount five dollars and the same placed in the fifth class.
      A1-18/19: February term 1837. On motion William L. Duncan Administrator of the Estate of John Duncan deceased makes settlement with the court and files the clerk's receipt for 18 cents and the same ordered to be placed on the probate ledger.
         On motion William L. Duncan Administrator of the estate of John Duncan deceased makes settlement with the court and files accounts of notice and accounts due said estate Adkins Spratling Boyers and Harris which he could not collect in amount $30.37-1/2 and the same ordered to be placed to his credit on the probate ledger.
         On motion William L. Duncn Admin. of the estate John Duncan deceased makes settlement with the court and files an account for 3 days February term 1836 to make settlement in amount $3 and the same ordered to be placed to his credit on the probate ledger.
         On motion William L. Duncan Admin. of the Estate of John Duncan deceased makes settlement with the court on a ?? to be indebted to the estate of $50 for interest on money loned and ordered to be charged in the Probate Ledger for the same.
         On motion William L. Duncan Admin. of the Estate of John Duncan deceased makes settlement with the court and is ordered the sum of $4 for attending this court to make final settlement of his said administration on the same ?? to his credit on the probate ledger.
         On motion William L. Duncan Admin. of the Estate of John Duncan deceased makes settlement and files the clerk's receipt for $5.68-1/3 for fees this term of the court.
         On motion William L. Duncan Admin. of the Estate of John Duncan deceased makes settlement with the court and is allotted the sum of $52.59? percent for collecting money belonging to said estate and the same to be placed to his credit on the Probate Ledger.
         On motion William L. Duncan Admin. of the Estate of John Duncan deceased makes final settlement of his said administration and is found to be indebted to said estate the sum of $804.86-1/4.
         (next pg) February term 1837. On motion William L. Duncan Adms. of the Estate of John Duncan deceased and presents the court for an order of distribution among the legatees of (John S. Duncan crossed out) said Estate and upon calculation it appears that each legatee of the number of five is entitled to $134.14-1/2 including the widow.
         On motion Robert B?. Duncan comes here into court and choses John Duncan as guardian over his person and property until he arrives to age of 21 years and interdian? to court in the sum of $500.

      DUNCAN v TRAVIS; Supreme Court of Missouri, Third Judicial District; 4 Mo. 369; June, 1836, Decided.
      Appeal from Crawford Circuit Court.

      (opinion) WASH, J. Duncan commenced an action of debt against Travis, before a justice, and got a verdict and judgment, from which Travis appealed to the Circuit Court; much difficulty and delay attended the prosecution of the appeal, which was refused by the justice, on the ground that the affidavit and bond required by the statute, were not given or tendered; finally it came up under a mandamus from the Circuit Court. In the meantime, it appears that the constable had collected the amount of the judgment, recovered before the justice; but whether the money had been paid over to the plaintiff in the cause, did not appear. When the cause came up to the Circuit Court, that court reversed the judgment of the justice, and entered up judgment against Duncan, the appellant, for the amount which appeared from the return of the constable to have been made by him upon the execution against Travis; to reverse which judgment, Duncan has appealed to this court.
      On the trial in the Circuit Court, several questions were raised, growing out of the sufficiency of the original affidavit of the plaintiff, on which the warrant was issued by the justice. The time and manner of praying the appeal of the defendant, the want of notice as required by the statute, &c., which need not now be considered; the appearance of the parties before the justice of the peace and the proceeding to trial upon the merits, without objection to the affidavit on which the warrant was issued, cured every defect, if any existed therein. The Circuit Court in reversing the judgment of the justice and in entering up judgment against Duncan for the amount which appeared to have been collected by the constable, most clearly erred. The proper course was, to have proceeded to a trial de novo. The judgment of the Circuit Court, is therefore reversed, with costs, and the cause remanded.

      Pg.547: Judges of election in the various townships were appointed at the May term, 1836, as follows: ... Skaggs (twp) -- Lewis Bridges, John Duncan Sr., and Samuel Brown.
      Pg.548: The County Court. The first records of this court cannot be found, but it is believed that William Montgomery, Barney Lowe and John Duncan were the first justices of the court, commissioned on the same day the act organizing the county was approved, January 29, 1829. The first entry upon the records that is to be found is as follows: ... last Monday (23d) of February, 1835, present ... and James Harrison, clerk. ...       Pgs.58-59 contain the information that on January 23, 1829, Crawford County was formed from all the territory which had been attached by law for civil and military purposes to the county of Gasconade. On the same day Gov. John Miller appointed William Montgomery, Barney Lowe, and John Duncan as judges of the court for four years.
