Berry of same, for $800 paid, sell to said Berry a negro man named Aaron aged about 30 years, and being the same sold by said Berry to said Duncan, sell to said Berry said negro, provided this deed is upon the condition that if Henry Duncan shall pay said Berry before 25 Dec. 1840 the sum of $800 with 10% per annum from 25 Dec. next, for which Duncan has executed his single bond of even date herewith and payable as herein mentioned, then this indenture shall be void; said Duncan shall retain possession of said boy until breach of condition of this mortgage. /s/ Henry Duncan. MO, we sell to said Weight & OBryan 3 parcels of land in Cooper Co. state afsd, the SE of NE 1/4 and SW of NE 1/4 Sec.35 Twp.47N Range 16W containing 40 acres each, also 30 acres in NW corner of frl. Sec.1 Twp.46 Range 16, all south of Missouri River, making in the aggregate 110 acres, warrant title. Nevertheless whereas the said Weight and OBryan have this day loaned to the subscriber $157.50 for payment of which I the first subscriber have executed to said Weight & OBryan my note of even date with this deed of trust, and to better secure the said Weight & OBryan, if the subscriber in the bond above will pay to said Weight & OBryan the afsd $157.50 with interest at the time it falls due, this deed of trust to be void, but if the undersigned shall fail to pay at the time of its maturity, then it shall be lawful for said Weight & OBryan to expose to public sale the land before described and apply the proceeds to discharge of the afsd note, with costs, and pay to the subscriber the balance if any. 3 Nov. 1840. /s/ Jephthah Duncan, Mary Duncan. Harris of same, sell to said Harris real estate in Cooper Co. afsd, the W 1/2 SW 1/4 Sec.27 Twp.47 Range 18 containing 80 acres and also N 1/2 of E 1/2 of SW 1/4 same section, twp. & range, containing 40 acres, with appurtenances, but upon the condition that I the said Duncan have this day transfered to said Harris one bond executed by John S.P. Smith to me for $100 payable on or by 1 April 1844 and dated 6 Jan. 1844 with 10% interest, and I have assigned to said Harris a note for $250 made by me to John S.P.Y. Smith due March in 1845 bearing 10% interest from last of March until paid dated 6 Jan. 1844, now I guarantee payment of said bond and note to said Harris to be paid by last day of March 1845, and if said bond and note shall be fully paid and satisfied by last day of March 1845, then this deed to be void, otherwise to remain in full force, and if said bond and note or either of them or any part shall not be fully paid by the time afsd, then said Harris is authorized to sell the lands at public auction in City of Boonville for cash ... to pay the expenses and the bond and note with interest and return the overpluss if any to me. 22 April 1844. /s/ Henry Duncan. MO, that party of first part in 1841 executed a bond for a deed to Thomas Bartlett in consideration of sum of $600 secured, to the following lots or parcels of land, SE of NE 1/4, the SW of NE 1/4 Sec.35 Twp.47 Range 16, also NW 1/4 of NW 1/4 Sec.1 Twp.46 Range 16, and whereas also the bond is yet outstanding and on 8 Aug. 1843 a levy was made by virtue of sundry executions on the above parcel or parcels of land, and the same was sold at public auction on 8 Sept. 1843 and Anderson W. Reaves became the purchaser of the above parcels of land, and from an investigation in the Cooper Circuit Court, Stephen Barlett mortgagee and Thomas Bartlett mortgagor upon petition to foreclose mortgage, that all the interest Thomas Bartlett has to above premises has been passed to and vested in Anderson W.       V-243: 1 Oct. 1857, James Armstrong of City of Boonville, MO, party of first part, and Hiram Duncan of same place, party of second part, for services hereinafter mentioned to be performed for him by party of second part, has this day employed party of second part to carry on the butchering business at the Market House in the City of Boonville, to buy cattle, sheep and hogs for that purpose and to slaughter and sell the same, and altogether to do and perform all that may be necessary for the proper carrying on of the business aforesaid, in consideration of which services to be performed, the party of first part agrees to pay him $50 per month from the date of these presents, and to furnish him a convenient slaughterhouse, butchering tools, wagons and horses, money to furnish cattle and everything else properly appertaining to the aforesaid business, and party of second part for $50 a month to be paid him as afsd, will perform the duties and do all that may be necessary for the carrying on the butchering businss while this agreement shall remain in force, and will render to him at the expiration of every month of his employment a full account of all cattle, meats and other produce of said business sold and pay over the same to party of first part. /s/ J.H.
