      Know all men by these presents that we, James Davis and Nathan Davis, are held and firmly bound unto his Excellency the Governor of Kentucky in the sum of Fifty pounds current money to the payment of which well and truly to be made to the said Governor and his successors, we bind ourselves, our heirs &c jointly and severally firmly by these presents sealed with our seals and dated this 22d day of October 1798. The condituon of the above obligation is such that whereas there is a marriage shortly intended between the above bound James Davis and Susan Rutherford for which a license has issued, now if there be no lawful cause to obstruct the said marriage, then this obligation to be void or else to remain in full force. /s/ James Davis, Nathan Davis.       This is to sertify that I the intitled farther and the mother of Seusan Dunkin do give our consent to the marriage of the said Seusan and James Davis. Duncan] for $74 dated Dec. 1851 and due Dec. 1852, and one other note for $8 payable to said Gregory and assigned to said Duncan due Dec. 1851, to secure payment to Peter B. KY, for $150 paid, sell parcel of land with all the appurtenances in Washington Co. on Louse Run waters of the Beech fork, beg. at a stone corner to Lot No.3 in the division made among the heirs of Andrew Young by decree of Washington Circuit Court in case of said Young's heirs against Stumpff's heirs, ... containing 27-1/2 acres for which a deed of partition has been made to the said Duncans and wives, and all their interest, warrant title. /s/ William Duncan, Mary Jane Duncan, Peter Duncan, Julia Ann Duncan.       T-97/98: That Peter B. Duncan executed to Jetson Moore, W.B. Moore and Alfred Benham a mortgage on three negro slaves on 15 April 1851 as securities for Duncan in a note to Samuel B. Mourfield, Admr. of David Beam decd, and said Duncan having paid off the mortgage, we release whatever claim we may have on said slaves afsd by reason of said mortgage, 16 Sept. 1853. /s/ W.B. Dungan is plaintiff and said heirs of said David Beam are defendants, and proceedings being had on the petition of the plaintiff which was filed 30 March 1853, and a decree rendered thereon at the September term 1853 in which it was ordered and decreed that the defendants, the heirs of David Beam decd, do before 12th day of this term convey to Plaintiff the legal title to the land in the bond and platt of survey ..., now for $2500, the parties of first part by the commissioner have sold and released to said Peter B. Dungan a parcel of land with appurtenances in Washington Co. KY described in the title bond executed by said David Beam to said Peter Dungan dated 16 Jan. 1852 ... bounded in a survey by Thomas S. Nantz for a conveyance of the land and for $28 per acre therefore $2,000 of which is paid, the balance of $800 for which Duncan hold the said William G. Nantz note of this date, and for which a lien is reserved, do hereby sell to said William G. Nantz both in his own right and as sole devisee of Thomas W. Nantz, a parcel of land in county & state afsd on the road from Springfield to Bloomfield, corner to Lydan and with his line to ... Piles line, Gragory's line, Lydan's line, containing 100 acres with all appurtenances, warrant title. It is understood there is now pending a Suit in Equity in Washington Circuit Court in the name of said Duncan against the heirs and exors of David Beam to obtain from them a title to the herein conveyed land by which suit the heirs and executor is given until 1st day next term of said Court to convey said land, now this deed is to have the same effect upon the said Duncan and is to convey his title and his wife's "wright" to the same ... 3 Oct. 1853. /s/ Peter B.       V-321: Nelson Reed and W.H. Duncan of Washington Co. KY bought at the same time from Joshua B. Hopkins the tract of land known as the Tom Hughes place on the Little Beech fork in Washington Co. KY, now the part of said place bought by said Duncan is so situated that he cannot get from it to Springfield the County Seat without passing through the part bought by said Reed, and when said purchase was made it was agreed between the undersigned and said Duncan that he should have the right of passway ... Now I hereby grant to said Duncan the right away to pass through that part bought by me the way the road now runs and is used from the land bought by him to the ford of the Beech fork at the Mouth of McCord's branch, and I also give him the use of the right away from said ford to the Turnpike road at the Bridge and he is to assist in keeping the same in repair. /s/ Nelson Reed.       Deed Book H-477: Know all men by these presents that whereas John Woods late of Franklin County in the State of Tennessee and formerly of Madison County in the State of Kentucky having departed this life leaving the following persons his children and heirs to wit: Marian Woods who intermarried with Charles Duncan, Susannah Milum formerly Susannah Woods wife of Jarvis Milum, James Woods, Sarah Woods who intermarried with William Evans (the said Sarah having died leaving three children viz: Minerva, Jane, and Wallace E. Evans), Rebeckah Hazelrig formerly Rebeckah Woods wife of William Hazelrig (the said Rebeckah having also died leaving five children viz: Elizabeth Dillard, Abigail, John, and Mary Anne Hazelrig) and whereas the said John Woods the ancestor of and previous to his death had claims to about thousand acres of land lying in Washington County in the State of Kentucky on the waters of Salt River which descended to his said heirs, the said John Woods having left his land lying in Washington County in Kentucky undevised. Now know all men by these presents that we Charles Duncan and Marian the wife of said Charles, Jarvis Milum and Susannah his wife, James Woods, William Evans, and William Hazelrig for and in consideration of the confidence which we have in the said Charles Duncan have made constituted and appointed and by these presents do make constitute and appoint the said Charles Duncan our true and lawful attorney for the following purpose that is to say the said Charles Duncan is authorized for himself and his wife, Jarvis Milum and Susannah his wife, and James Woods to sell and dispose of all their interest which they have to any lands in the State of Kentucky in Washington County devised to them as the representatives of said James (DDS: mistaken - means John) Woods deceased and to make titles in fee simple to the purchaser or purchasers there of, but not with general warranty but only to defend against the claims of ourselves and all persons claiming under us and the said William Evans and William Hazelrig also authorize the said Charles Duncan to sell and dispose of their interest which the children of the said Evans and Hazelrig have in said lands and to give an obligation binding the said Evans and Hazelrig and their heirs to cause to be made a title in fee simple to their interest and the interest of their children in said lands whenever arrive at the age of twentyone years ? that is they authorize the said Charles Duncan to sign an obligation by which said Evans and Hazelrig shall undertake for their children that each child will convey his interest to the purchaser but not with general warranty and in the event that our said attorney can not sell and dispose of said lands we then authorize him to lease the farm to bring suits for the recovery there of or to do anything else for our use and benefit in relation to said lands that we ourselves could do if we were physically present. And whereas the said lands were located by James Kincaid who is entitled to one fourth part thereof as locator and we authorize our said attorney to settle with said locator and make partition with him so as to allot said locators interest in severally and we further authorize our said attorney to appoint an agent under him and to confer on said attorney all or any part of the powers hereby vested in himself.
