To my nephew Mathew Duncan son of Seth Duncan, 500 acres on Highland Creek, and all my right and title of what is coming to me from the estate of John Carney Decd, a suit being now instituted against said Carney's heirs in Berkley Co. VA, and all estate coming to me in Franklin Co. PA which Mathew Duncan has a power of attorney from me to collect, also my negro woman Lucy and all my personal estate. To Seth Duncan Junior son of Seth Duncan, 500 acres on Clay Creek, "Livington" Co. KY. To "the neice" Eliza Duncan of Seth Duncan, 660 acres in Nelson Co. Appoint my brother Seth Duncan with my friend John Mountjoy Sen. my execs. 19 June 1806. Wit. Alexander C. Lanier, Britain Clay. Proved July 1806 by Alex. C. To my son Charles B. Calvin a negro girl Siller and 50 acres including the land cleared by John Sharp binding on Chas. Sternes line toward Enoch Duncan ('s line). To my dau. Margaret Riddell a negro girl Sibb. To my grandson Gaven Duncan, bed clothes and furniture. Rest to be sold at 12 months credit and proceeds equally divided among aforesaid children. Whereas Elias Duncan now owes me £25 and Willis Duncan owes me $100, the £25 be considered part of my dau. Elizabeth Duncan's dividend, and the $100 be considered part of my dau. Franky's dividend. The other slaves not be sold if my children can agree upon a division, otherwise they be sold. Appoint Elias Duncan, Willis Duncan and Charles B. KY, negro slaves for $900, part of which was paid, $300 paid and he delivered the slaves, the remainder $600 is unpaid and due; to secure the payment I sell to said Willis Duncan the said negro man slave Jim about 40 years of age and said negro female slaves Roar(?) about 40 and Martha Ann about 2 and negro boy slave Alexander about 7 and Thomas about 5 and future increase; promise to pay before 1 June 1831. DUNCAN and Wife vs. FORSYTH; Court of Appeals of Kentucky; 33 Ky. 229; 3 Dana 229; June 10, 1835, Decided.
From the Circuit Court for Pendleton County.
Judge EWING delivered the Opinion of the Court. AN action of ejectment was brought by Robert Forsythe, as lessor, against John Forsythe, as tenant in possession, and at the April term, 1832, Duncan and wife were admitted defendants. At the July Term, 1834, on the calling of the cause for trial, the affidavit of Duncan was exhibited, and motion made for a change of venue, which was overruled by the Court. Whereupon a motion was made for a rule on the attorneys for the plaintiff, on affidavit, that the lessor of the plaintiff had died since the filing of the declaration in ejectment -- "to show and exhibit on record, who in fact the plaintiffs were, who, since the death of the lessor of the plaintiff, carried on this suit against the defendants;" which motion was also overruled by the Court.
The only affidavit which shows the death of the lessor, is contained in the affidavit for a change of venue, and which is in the following language: "That since the institution of said suit, Robert Forsythe hath departed this life; that since his death, John Forsythe, William Forsythe, Peter Forsythe and others, together with Benjamin Forsythe and Thomas Best, who administered upon the goods, &c. of said Robert Forsythe, deceased, appear to take an interest in said suit, and since have taken the management thereof upon themselves, conceiving themselves legally interested in the same, as your petitioner supposes and believes;" and further stated, "that at sundry times, up to the present term of the court, efforts had been made to settle, and adjust, and compromise the matters in controversy.
The practice of staying proceedings in ejectment until security for costs be given, in cases where the lessor of the plaintiff was an infant, was resident abroad, or died during the pendency of the suit, originating with the court of King's Bench, was afterwards adopted by all the courts of England as an established rule of practice, and has, by repeated adjudications, become the law of the land. From these adjudications, it seems, a defendant has a right to ask and demand of the court, a stay of the proceedings upon a proper case made out, until security for costs be given; or, where the lessor is unknown to him, to demand that he be made known.
But this right is for the benefit of the defendant, and may be waived by him.
If a defendant desires security for costs, he should show by affidavit that the lessor is dead, and move the Court, specifically, for a stay of proceedings until security be given. No error is committed in rendering judgment without it.
No motion was made in the present case, for a stay, for want of security. It is true, he asks for an exhibition of the names of the persons who are carrying on the suit. But his affidavit does not show that they are unknown to him. And indeed his affidavit shows clearly, that he is well apprised of the individuals who were concerned. He must have known who were the heirs and representatives of Robert Forsythe, deceased, who lived and died in his neighborhood; and who were alone interested in prosecuting the said suit, and upon whom all the interest of said Robert devolved; and who would have a right to be put into possession of the land, under the direction of the Court in case of success. He set forth the names of several, if not all of them, in his affidavit, as well as the names of his administrators; and swore that propositions for compromise had been passing, before and since the death of the lessor, up to that time. He could not have been ignorant of who they were. The motion seems to have been made more in the spirit of vexation, and with the intention to procrastinate, than with a view to be informed of their names or persons; and was properly overruled by the Court.
On the trial of the cause, the Court instructed the jury, that if the defendant Cynthia purchased the land when sold under Arnold's execution, for the purpose of hindering, delaying or defrauding the creditors of John Forsythe, that in such case, said purchase was void as to such creditors, and as to purchasers, and judgments and executions in favor of such creditors.
The defendant Cynthia claimed under a prior deed, made in pursuance of a sale made under execution in favor of Arnold. The lessor of the plaintiff claimed under a subsequent deed, or on a subsequent sale under execution.
There is evidence in the cause to justify the jury to conclude, that the sale under which she claimed, was brought about by a fraudulent arrangement concocted between John Forsythe, the defendant in the execution, her father, and herself, and the sheriff, to shift the land out of his hands into the hands of his daughter Cynthia, with the intention to hinder, delay and obstruct creditors in the collection of their debts. That the sheriff was used as a mere instrument to accomplish this object. If so, the sale would not stand upon better ground than a sale made for that purpose by John Forsythe himself. And it has been repeatedly settled by the English courts, in the construction of their statute of frauds, as well as by this Court, in the construction of our statute, that a sale made with such intention, is void, not only as to prior creditors and purchasers, but also, as to subsequent creditors and purchasers.
It is, therefore, considered by the Court that the judgment of the Circuit Court be affirmed.

Mr. Duncan is a member of the firm of Ogdon & Duncan, composed of Bela Ogdon and Joseph Duncan. They have many business interest besides their store, which is the largest in the county. The mother of our subject was Nancy Davis, who was born in 1789, and was the daughter of George Davis, who emigrated from Virginia to Kentucky and died there. Of the eight children born to the parents of our subject, only himself and Mrs. Cynthia A. Duncan, of Ursa, remain. He was born in Pendleton County, Ky., February 24, 1815, and was reared to manhood on a farm. He afterward learned the trade of a cooper, and came to Illinois in 1838. Her books contain an index also to the witnesses and neighbors and beneficiaries, and should be consulted. They show heirs, migrations to other counties, and other pertinent items. They also show the presence of Seth Duncan from 1802 to 1807 when he moved to Bourbon Co. KY; William Duncan in 1802 when he removed to Harrison Co. KY; Archibald Duncan of 1809 Harrison Co. KY and 1810 Nicholas Co. KY; and in Order Book C, pg.192, in 1817, a possible connection between Joseph Duncan (wife Nancy Stevens) of Clark Co. KY whose daughter Polly Stevens Duncan mar. Vivion Daniel 3/19/1805 in Pendleton Co. KY, to Willis and Elias Duncan who were appointed guardians to two orphans of John Sharpe, bondsman Vivion Daniel.
"KY Court and Other Records" Vol.II, by Julia Hoge Spencer Ardery, under Bourbon Suits, on pg.117, Jas. Duncan vs. Joseph Duncan's Hrs., Box 312, May, 1809, names many heirs, and includes a Deposition of Mary M. Laughlin taken in Franklin Co. PA, deposeth she went to house of Capt. Seth Duncan in Pendleton Co. KY about 6 days before death of Sarah Duncan. Another suit was filed in Barren Co. KY Equity Court, Bundle 380, #1827, J. Duncan heirs vs. Sarah Bell, filed March & June 1827 (Judgments on FHL film 209,800), but there was no mention of Pendleton Co. KY.
