      APPEAL from Muhlenburg Circuit Court.
      Opinion of the Court by Judge Peters:
      It must be apparent from the evidence that the land sought to be subjected to the payment of the debt of appellee was paid for with the money arising from the sale of the slaves of appellant, D. E. Wilson.
      The proof shows that her husband was insolvent when he married her in 1852, and that she then owned three slaves in her own right, two of whom were sold and the proceeds invested in the land directly except $78, with which a horse was purchased, and the horse afterward, as is alleged, was paid to Sparks and wife for the land purchased of them.
      But it is insisted in the argument that the husband sold the slaves and converted them into money, and whether he paid for the land with the proceeds thereof or not, the money for the slaves when he received it was his, and consequently the land paid for therewith was his and subject to his debts.
      The slaves of the wife were sold as is alleged in the answer by the wife; but whether by the husband or wife can make no difference as the proceeds by an agreement between them were invested in the land; this agreement is evidenced by the fact that the conveyance is made directly to the wife, and she became invested with the legal title. There is a very marked and material difference between this case and the case of Hocker, etc. v. Gentry, etc., in 60 Ky. 463, 3 Met. 463. In that case Kelly sold the slaves of his wife, and purchased about thirty-three and one-third acres of land with the proceeds, and took the title to himself, and it does not appear there was even a verbal agreement between Kelly and wife that the land should be conveyed to her. In that case the heirs of Mrs. Kelly sought to divest the husband of the legal title, which he had acquired, as may be assumed, with the consent and approbation of the wife, whose means paid for it, and to whom she might have preferred it should go, rather than to any one else. Here a creditor is seeking to divest the wife of the legal title to the land by the aid of the chancellor, which she acquired by the payment of her own means therefor -- and whose equity is at least equal to that of the creditor, even if she was not clothed with the legal title.
      Moreover, although the statute provides that voluntary gifts, conveyances, transfers, or changes made by a debtor of or upon his estate shall be void as to his then existing liabilities, and will be adjudged void as to prior creditors, it expressly declares that it shall not, therefore, be declared to be void as to such subsequent creditors or purchasers.
      The deed from Page and wife to Mrs. Wilson is dated 5th of March, 1857, and that of Sparks and wife the 22d of October, 1857, and it is not alleged that her husband was indebted to Duncan when said deeds or either of them were made to her. His judgment and execution thereon are all of the proceedings against Wilson that are copied in the transcript before us, and from them, it appears that the judgment was rendered in November, 1858, more than one year after the deeds were executed.
      In either view of the case, it seems to us appellee failed to manifest a right to the relief sought.
      Wherefore, the judgment is reversed, and the cause remanded with directions to dismiss the petition as to Mrs. D. E. Wilson.

      Cataloged under Civil War, 1861-1865, pensions, indexes; does not say if Confederate or Federal, but probably Federal. Negative film, some cards much too faint or dark to read, some cards blurred or faded, particularly the service unit and the dates of application. Most of the very faint or dark cards were in a slightly different format, with space for years enlisted and discharged which were sometimes filled in. Many of these were for service in later years, although one or two were for service ca 1866.
      Name of soldier, alias, name of dependent widow or minor, service (military unit or units), date of filing, class (invalid or widow or minor or other), Application #, Certificate #, state from which filed (sometimes blank), attorney (sometimes blank, MAD: did not usually copy), remarks. Sometimes the "Invalid" or "Widow" class had an "s" added to it before the application #; occasionally the area for the service information included a circled "S". The minor's name was frequently that of the guardian rather than the minor.
      The military unit was frequently the Company Letter, the Regiment Number, sometimes US Vet Vol Inf. (US Veteran Volunteer Infantry), L.A. (Light Artillery), H.A. (Heavy Artillery), US C Inf (US Colored? Infantry), Cav. (Cavalry), Mil. Guards, V.R.C. (?Volunteer Reserve Corps?), etc. Sometimes there were several service units given.
      Cards appear to be arranged by the last name, first name, middle initial if any, and state (including "US") of service.

George Gordon sailed from England, Aug. 23, 1856; landed in NY Oct. 2, went immediately to Fall River, MA, where he took charge of 48 looms; he was a weaver. In April 1857 he moved to Perry Co. IN and took charge of 75 looms at Cannelton; remained 9 years. Jan. 11, 1862, enlisted in Co. G, 53rd IN Volunteer Infantry, commanded by W.O. Gresham; discharged as a Sergeant Dec. 1862 at St.Louis on account of disability ..., returned to Cannelton until April 1865, then went to Gallatin, TN, until July ... in 1870 to where he now resides in Central City, KY.       Pg.135-6 (pg.947), Ohio Co. DAVID DUNCAN, born March 6, 1842, Ayrshire, Scotland, immigrated at age 11 with his parents to Schuylkill Co. PA, until 1858, then to Muhlenburgh Co. KY, engaging in mining. In 1861 enlisted as a private in Co. A, 17th KY Infantry, served 3 years 4 months, wounded 3 times, promoted to Captain. His father David Duncan, native of Scotland, was a soldier in the 3rd PA Cavalry in the late war, and died about 1868. His father was also named David. Subject's mother, Jane (Malise) Duncan, was born in Glasgow, Scotland, about 1805, and is now living. Her marriage with subject's father was blessed by birth of Andrew, Robert M. (a soldier in an IL regiment), David (subject), Daniel M. (soldier in the 4th NY Heavy Artillery) and Jane (married to James Kelley, who served in a PA Regiment). In 1865 subject married Mary, dau. of John and Jane (Miller) McDugal, of Muhlenburgh Co., and to them have been born David J., Jane, Daniel M., William G., Annie, Neil, Robert and Andrew. Mr. Duncan is a member and superintendent of the coal mining company at Echols, Ohio Co. KY ... Presbyterian, Republican, member A.F. & A.M.
      Pg.136 (pg.948), Ohio Co. WILLIAM G. DUNCAN, superintendent of McHenry Mines, postmaster and express agent, Ohio Co., is the son of Andrew Duncan, a native of Glasgow, Scotland, who came to America in 1855 and first settled in Pottsville, [Schuylkill Co.] PA. He remained there a short time, then to Airdrie, Muhlenburgh Co. KY; then to Butler Co., Aberdeen. Twelve years ago he came to McHenry ... and was superintendent until his death, May 25, 1877. His widow is still living at McHenry. They had 8 children, of whom William G. Duncan is the eldest, and was born in Hollytown, Scotland, Sept. 4, 1851; Mary, wife of Oliver C. Roll; Jennie, wife of W.D. Hamilton; D.S. Duncan, druggist at McHenry Mines; Andrew J., late superintendent of Echols Mine, killed at age of 21, Oct. 23, 1882; Jennette, Ella and Maggie. Mr. Duncan was married May 10, 1878, to Mary H., youngest dau. of William Hamilton, also of Glasgow, Scotland. Mrs. Duncan was born in Airdrie, KY, Oct. 12, 1860. They have two children: Katie Belle, born May 13, 1879, and Andrew Wallace, born July 27, 1880. ...

      Pg.228: Andrew Duncan and his brothers Robert and David Duncan left Scotland for America in the early part of 1855 and a few months later [Robert] Alexander sent for them to come to Airdrie [Muhlenberg Co. KY]. They were practical miners and Alexander gave them a contract to sink a shaft. One of the brothers managed the day shift and the other the night crew. William G. Duncan, now the best-known mine operator in KY, is a son of Andrew Duncan, and David John Duncan, the well-known insurance man of Greenville, is a son of David Duncan.

      Pg.396-7: The largest coal-producer in the county is the Graham-Skibo mine. This mine was opened in 1903 by the W.G. Duncan Coal Co. of Greenville, who in 1900 opened the Luzerne Mine. ... The officers of the W.G. Duncan Coal Co. are William G. Duncan, president; Charles W. Taylor, vice-president and manager, and Andrew W. Duncan, secretary and treasurer. William G. Duncan Jr., is the mining engineer. A.W. and W.G. Duncan Jr. are sons of William G. Duncan. The four men here referred to live in Greenville and in many ways have done much toward the advancement of the interests of both the county and the town. Muhlenberg Co. coal mines and their output for 1911 are given in the official report as follows: Mine: W.G. Duncan Coal Co., Graham-Skibo, Graham, 333,757 tons; (2 mines in between); W.G. Duncan Coal Co., Luzerne, 190,395 tons (other mines with lesser tonage)
      Pg.401: The three leading coal-mine operators residing in Muhlenberg to-day are William G. Duncan, James W. Lam, and William A. Wickliffe. William G. Duncan, the Coal King of Muhlenberg Co. (photo, 1912), was born in Scotland Sept. 4, 1851; in 1855 his parents moved to PA and the same year came to Airdrie, to which place his father, Andrew Duncan, a practical miner, had been invited by Alexander. After the Airdrie Furnace was abandoned Andrew Duncan operated coal mines near Paradise and Airdrie, where William G. Duncan spent his youth. After operating a number of mines in Ohio Co. and other places, William G. Duncan returned to Muhlenberg in 1900 and opened the Luzerne Mine. In 1903 he opened the Graham-Skibo Mine, which is the largest and best-equipped mine in Western KY. ...
