      APPEAL from Marshall Circuit Court. C. P. Div.
      Opinion of the Court by Judge Lindsay:
      This court by its decision in the case of Watts v. Pettit's Heirs, 64 Ky. 154, 1 Bush 154, clearly recognizes the power of the county court under the provisions of the Act of March 10th, 1856, 1st Vol. Stanton's R. S., 581, by requiring new bonds from statutory guardians to release the surety or sureties upon existing bonds from all liability on account of the same.
      In this case the guardian of the appellees upon his own motion was allowed to execute a new bond for the express purpose of releasing Duncan from liability as his surety upon his original bond.
      A new bond was executed and approved and accepted by the court and it is recited in the order itself, "That Samuel Duncan can be and he is hereby forever released from any further liability as one of the sureties in said bond."
      The language of the statute is that "When the security of a guardian wished to be released as such, he shall apply to the county court," &c., and it is insisted that because of the fact that in this case the application was made by the guardian and not by the surety, that it does not come within the provisions of the statute and that Duncan's representative cannot claim that his intestate was absolutely released from liability, but only that the new bond was cumulative in its legal effect. We think that it may be safely assumed that the guardian made the application because of the fact that his surety Duncan wished to be released, and this fact of itself brings this case clearly within the reason of the statute.
      We are of opinion that the appellants exceptions should have been sustained as to the claim of the appellees, and the action of the court below is reversed and the cause remanded for further proceedings consistent with this opinion.

      Cataloged under Civil War, 1861-1865, pensions, indexes; does not say if Confederate or Federal, but probably Federal. Negative film, some cards much too faint or dark to read, some cards blurred or faded, particularly the service unit and the dates of application. Most of the very faint or dark cards were in a slightly different format, with space for years enlisted and discharged which were sometimes filled in. Many of these were for service in later years, although one or two were for service ca 1866.
      Name of soldier, alias, name of dependent widow or minor, service (military unit or units), date of filing, class (invalid or widow or minor or other), Application #, Certificate #, state from which filed (sometimes blank), attorney (sometimes blank, MAD: did not usually copy), remarks. Sometimes the "Invalid" or "Widow" class had an "s" added to it before the application #; occasionally the area for the service information included a circled "S". The minor's name was frequently that of the guardian rather than the minor.
      The military unit was frequently the Company Letter, the Regiment Number, sometimes US Vet Vol Inf. (US Veteran Volunteer Infantry), L.A. (Light Artillery), H.A. (Heavy Artillery), US C Inf (US Colored? Infantry), Cav. (Cavalry), Mil. Guards, V.R.C. (?Volunteer Reserve Corps?), etc. Sometimes there were several service units given.
      Cards appear to be arranged by the last name, first name, middle initial if any, and state (including "US") of service.

KY on waters of Highland Creek containing 61 acres, beg. at John Duncan's line, then ... corner to Duncan, then ... corner to James L. McClenden's survey, then ... another of McClenden's lines, then... to the beginning, being the tract granted to party of first part by patent 5 Dec. 1854, and the sale to John Duncan decd. was evidenced only by assignment endorsed on the original patent which is now lost, NOW the party of the first part sells the tract of land afsd to the parties of the second part with all appurtenances. /s/ Henry (X) Stone.       Pg.223-4, Marshall Co. ELIJAH C. DYCUS, MD, now among the pioneers of Marshall Co., is a son of John and Nancy (Isaacs) Dycus; both parents natives of KY, both born in 1797. They removed to Edmonson Co. to the Purchase in 1830, and that year settled near the village of Briensburg, Marshall Co. John Dycus was a farmer and civil officer, and died when about 47 years old. His widow survived him many years, and died in 1877. Dr. E.C. Dycus is the 3rd child of a family of 11 born to these parents. He was born in 1820 in Hart Co. KY, and was age 10 when the father came to Marshall Co., then Calloway. ... Dr. Dycus began his practice in 1846 ... Dr. Dycus was married in New Providence [Montgomery Co.], TN, in 1849, to Miss Atlanta G. Duncan, dau. of James W. and Ann Duncan, of (MAD: Accomack Co.) VA. They have a family of seven children: Francesca J., John W., Ella C., Ann Eliza, Emmett C., Emma G. and Mary A. Dycus. ...
      Pg.227 (pg.337), Marshall Co. JAMES H. JOHNSTON, farmer, merchant and postmaster at Sharps, Marshall Co. KY, one of oldest citizens of his county. One of the first settlers in this portion of the county where he lives was his grandfather, Absalom Johnston, who with his family came to this county about 1817. Isaac Johnston, the son of Absalom and father of our subject, was at that time a man of family, and was born about 1792 in SC, but in early life immigrated to KY, settling east of the Tennessee River, thence to Marshall Co. as above stated. He served as a soldier in the war with the Seminole Indians, and married Miss Charlotte Baker, had 9 children: Alfred, Isaac O., Dunning B., Elizabeth who married O. Grifith, Ira, Christina the wife of C.V. Bailey, James H., Henry who died in Mexico while a soldier in the Mexican war, and Ambrose Johnston. Of this family, all are dead except two: Mrs. Bailey and the subject of this sketch. Isaac and Charlotte Johnston, the parents of this family, both died in 1837. James H. Johnston was born in Marshall Co. KY in 1822, and has lived in the immediate vicinity of his birth(place). In 1841 he married Drusilla, a dau. of Joseph Staten, she died in Oct. 1871, the mother of ten children: Nancy M. (wife of R.J. Hill), Joseph O. (deceased), William H. and Mary C. (both of whom died in infancy), Elizabeth (wife of W.J. Miller), Isaac, Felix F., Bell A. (wife of J.M. Bradley of NM), Jennie C. and Eulalia Johnston, the last named died in infancy. In 1872 Mr. [James H.] Johnston married his present wife, Adeline, dau. of John and Jane (Duncan) Grubbs, born in Calloway Co. KY in 1838. Three children: Alfred, Lucy and James B. Johnston. Members of Cumberland Presbyterian Church, Mason.

      Williamson Co. Biographical Appendix, pg.879: JOHN H. DUNCAN, county superintendent of schools, born in Marshall Co. KY on June 27, 1858, son of Samuel and Ruhamah (Frizzell) Duncan, natives of TN. Father to IL in 1864, locating in Franklin Co., a year later to this county, farmed until death which occurred while he was away from home in Johnson Co., Sept. 14, 1867. Politically prominent in Marshall Co. KY, where held various county offices ... commanded Co. A, 15th KY Cavalry in war. Our subject was reared on farm, attended Shurtleff College, Madison Co. IL, 2 years, then taught ... 1882 elected to present position, re-elected in 1886; Republican. ... Newspaper. Aug. 26, 1883, he married Mary M., dau. of W.J. Spiller of this county; they have a son and daughter. He is a Mason, an Odd Fellow, member of the Christian Church.
