(separate page) The Commonwealth of Kentucky to the Sheriff of Green County, Greeting. You are hereby commanded to summon Dudley Retherford and Catharine his wife to appear before the Justices of our Court of Quarter Sessions for the aforesaid County at the Courthouse on the third Tuesday in October next to answer a Bill in Chancery exhibitted against them by James Davis and Susannah his wife, and this they shall in no wise omit under the penalty of law and have them there this Writ, Witness Jas. Allen, Clerk of our said Court at the Courthouse aforesaid this 28th day of August 1800, and 9th year of the Commonwealth. /s/ James Allen.
(separate two pages) To the honorable the Justices of the Court of Quarter Sessions for Green County in Chancery sitting, your Orator and Oratrix James Davis and Susannah (his wife) humbly complaining showeth to your worships, that Robert Duncan late of the state of North Carolina died leaving your Oratrix and her brother Charles Duncan his heirs at law who were then minors; and further that said Robert died possessed of a considerable estate both real and personal undisposed of which by the laws of the state of North Carolina descended in equal portions to your Oratrix and her only brother Charles Duncan. And your Oratrix and Orator further shew that the Relicts of the said Robert retained possession and use of the estate aforesaid (without there ever having been any administration thereon as these complainants have been able to find out) during her widowhood (which was some time) when she intermarried with a certain Dudley Rutherford (who these complainants prey must be made Defts to their bill of complaint - Your Complainants further shew that an agreement has taken place between them and Charles Duncan by which your Complainants are entitled to the whole interest in the Decedents Roberts personal estate. Your Complainants further shew that the defendant together with his wife (blank space) Rutherford who they prey to be made defendant also to their bill, has so secluded the personal estate that it is not comattable? by your complainants; your complainants further shew that they are well informed and believe that the following things at least came into the hands of the defendant Dudley Rutherford two horse beasts (blank) cows four of which were milch cows and a considerable quantity of household furniture part of which is yet in his custody, nevertheless the defendants combining &c have refused to account with your complainants for the estate aforesaid or any part thereof declaring that should your complainants sue them that it go hard with them. In tender consideration and for as much as your complainants are without remedy at law and only relieveable in equity, may it please your worships to grant your Compts. the commonwealth Supr. and respondendum by which the Defts may true and perfect answer make to all and singular the premises as if the same were herein again repeated and interogated, But more particularly if the statements in this Bill are not true and that the Deft (blank space) may on her corporal oath say what property she received into her hands after Robert Decedent's Death the property of said Robert, and further, and further how the (blank space) has disposed of the same and that the Defendant Dudley may on his corporal oath say what he has had of the said Robert's estate and how he has disposed of it, and thirdly what he has at present of said estate in his hands. And by a decree of this worshipful court the Deft. Dudley may be decreed to pay your Complainants the real value of your Complainants ancestor's personal estate with interest thereon and to grant to your complainants such other and further relief as to equity shall appertain and they will ever pray.

Born June 10, 1755, Pittsylvania Co. VA; d. May 3, 1844, Jackson Co. AL. Applied 1834 in Jackson Co. AL; enlisted early 1776 in Camden [Co.], SC, under Gen. Lincoln, Col. Thompson, Maj. Perdue, Capt. Hopkins, served 18 months; volunteered again under Gen. Morgan, Col. Shelby, Capt. Small in VA and served 6 months; entered again under Col. Preston and Capt. Chadwell for 3 months; entered again under Pickens, Col. Anderson, Capt. Key; age in father's family bible burned with house shortly after war before he married; lived in Camden Dist. SC about 10 years after end of war; moved to Hawkins Co. TN; then to Greene (now Adair) Co. KY; then to Jackson Co. AL. Married 1780-81 Ann, who d. Nov. 23, 1846. Witnesses Rev. Steven Donathan and Jesse McElyea of Jackson Co. AL. Listed in 1841 census of pensioners age 83, Jackson Co. AL residing with Robert Duncan. Affidavit of Peter Duncan and David Chadwell 20 Feb. 1835 in Jackson Co. AL re service. Deposition of brother Peter Duncan of Marshall Co. AL on 8 April 1843, age ca 77; home in Hawkins Co. TN burned 47-48 years before; Peter age 10-11 when John entered service, age ca 13 when discharged. Deposition of Greenbury Middleton 27/29 March 1843, age ca 1868, of Jackson Co. AL; knew John Duncan ca 40 years ago in Adair Co. KY. Deposition by Absalom Coffee on 28 March 1843, age ca 55, knew John more than 20 years, later 30 years; mentions John and aged wife. Witnesses Daniel M. Martin and Philip Henry Armbruster. Deposition by John Duncan on 30 Sept. 1843, age ca 88.
Children: David, Robert, Peter. There were other children but all died before their parents. Aug. 17, 1854, Absolum Coffee testified his wife Jane was a granddau. of John Duncan. William Duncan of Jackson Co. AL filed power of attorney 9 June 1854. Deposition by Absalom Coffee, adm. of estate, that when Ann d. 23 Nov. 1846 she left survivors David, Robert and Peter her only legal heirs; since her death David and Robert are both dead.

Cataloged under Civil War, 1861-1865, pensions, indexes; does not say if Confederate or Federal, but probably Federal. Negative film, some cards much too faint or dark to read, some cards blurred or faded, particularly the service unit and the dates of application. Most of the very faint or dark cards were in a slightly different format, with space for years enlisted and discharged which were sometimes filled in. Many of these were for service in later years, although one or two were for service ca 1866.
Name of soldier, alias, name of dependent widow or minor, service (military unit or units), date of filing, class (invalid or widow or minor or other), Application #, Certificate #, state from which filed (sometimes blank), attorney (sometimes blank, MAD: did not usually copy), remarks. Sometimes the "Invalid" or "Widow" class had an "s" added to it before the application #; occasionally the area for the service information included a circled "S". The minor's name was frequently that of the guardian rather than the minor.
The military unit was frequently the Company Letter, the Regiment Number, sometimes US Vet Vol Inf. (US Veteran Volunteer Infantry), L.A. (Light Artillery), H.A. (Heavy Artillery), US C Inf (US Colored? Infantry), Cav. (Cavalry), Mil. Guards, V.R.C. (?Volunteer Reserve Corps?), etc. Sometimes there were several service units given.
Cards appear to be arranged by the last name, first name, middle initial if any, and state (including "US") of service.
