Duncan, that whereas Fleming Georges in his lifetime filed his bill in chancery against William L. Pope, now deceased, and such proceedings were had, a decree was pronounced by the Lincoln Circuit Court directing a sale of the tracts of land, and for the purpose of effectuating said sale, William W. Bridges was appointed a commissioner, ... sold to Henry Hampton, the highest bidder, at $753.37-1/2, and said Henry Hampton on 27 Feb. 1847 assigned the benefit of said purchase to Benjamin F. Duncan and William Bruce, and by a decree by the Lincoln Circuit Court, Edmond B. Smith was appointed a comr. to convey the land ..., and by another decree at Sept. term in 1848 it was ordered that Thomas Helm be appointed a commissioner in place of Edmond B. Smith, ... NOW this indenture of sale between James H. Pope and Helena Pope, heirs of William L. Pope decd, by Thomas Helm, commissioner, to William Bruce and Benjamin F. Duncan, for $753.37-1/2, receipt acknowledged, sell two tracts of land in Garrard Co. on Dicks River, one containing 50 acres and the other 30 acres as will appear by a deed from Alamander Sutton to William L. Pope 9 Feb. 1838, also one other tract in Garrard Co. on waters of Dicks River, being the same tract of land conveyed by Charles Bland to said William L. Pope by deed 10 Feb. 1834, warrant title. /s/ James H. Pope by Thomas Helm Commissioner, Helena Pope by Thomas Helm Commissioner. At a Circuit Court for Lincoln Co. on 27 Sept. 1848, Thomas Helm Commissioner exhibited the deed from said James H. Pope and Helena Pope to Willis Bruce and Benjamin F.       R-184/185: #3520. Deed of Partition. 16 March 1850, between William Bruce and Benjamin F. Duncan, both of Garrard Co. KY, that some time since said Duncan and Bruce made a joint purchase of a tract of land in Garrard Co. and since that time Thomas Habon? as a commissioner of the Lincoln Circuit Court conveyed the land to them by a deed he executed on behalf of James H. Pope and Helena Pope, which deed is of record in the clerk's office of the Gerrard County Court and should be referred to for a description of the land, and the said Duncan and Bruce have since divided the tract of land between them in the following manner, said Duncan to have the land or tract beg. at a beach tree on the side of the road leading to Blandwell?, then ... corner to William Ponce, then to Steels Branch, ... which boundary contains 58 acres 2 roods and 23 poles, and said Bruce by the division is to have that part not embraced in the above boundary, now the parties to this deed, in order to make the division binding, make the following conveyance, to wit, said Bruce conveys to said Duncan all his claim to that portion of the land described as Duncan's part, and said Duncan in like manner releases to said Bruce all his claim to that part which Bruce gets by the division. /s/ B.F. KY, being the same conveyed to James Nickolson by Samuel G. Tellett Commissioner appointed by Garrard Circuit Court in case of James Dodd against Robt. Smith and by said James Nickolson to said Samuel Perren, supposed to contain 50 acres, together with appurtenances, warrant title. /s/ Samuel Perrin, Elizabeth Perrin. They ack. deed before Francis P. Vedder, Clerk of County Court of Green Co. IL, 25 Feb. 1854. Recorded 10 July 1854, Garrard Co. KY.
      T-298/299: #4652. 5 Feb. 1855, John O. Duncan and Sarah Duncan his wife of Lincoln Co. KY to Joseph McQuery of Garrard Co. KY, in consideration of an exchange of land and $540 in money paid, sell all their right to the tract of land in Garrard Co. on the waters of Drakes Creek owned by Daniel McQuery at the time of his death and the same purchased by said Daniel McQuery decd. of Elizabeth McQuery and supposed to contain 131 acres, and for the consideration afsd, the said Duncan and wife sell to said Joseph McQuery all that tract in Garrard Co. on the waters of Drakes Creek sold by Samuel Perrin & wife to said Duncan by deed recorded in Garrard Co. Deed Book T pg.171 and supposed to contain 50 acres, the land exchanged by said McQuery to said Duncan is conveyed in a deed from said McQuery and wife to said Duncan dated 27 Jan. 1855 and this day delivered to him to be recorded in Lincoln Co., the whole of the tracts lately occupied by said Duncan supposed to contain 50 acres, together with appurtenances. /s/ John O. Duncan, Sarah Duncan. Wit. W.B. Mason. They appeared 5 Feb. 1855 before William B. Mason, Clerk of Garrard Co. Court.

Suthard, James McQuery, Polly A. Suthard, Daniel H. McQuery and David McQuery, all formerly of Lincoln or Garrard Co. KY our attorney to receive ... our distributive share of the estate of Thomas Tracy, decd, from Thomas Tracey, admin. of the estate of said Thomas Tracy, decd. /s/ James Duncan, Sally (X) Duncan. They appeared 15 Nov. 1854 before Thomas McCarty, Clerk of County Court of Clay Co. MO. Recorded 24 Dec. 1855 in Garrard Co. KY.
      U-267/269: #5216. 21 Jan. 1854, George R. McKee, Alexander R. McKee, Benjamin F. Duncan and Jane L. Duncan his wife late Jane L. McKee, heirs of Martha McKee decd, to Jacob Robinson of Garrard Co. KY, that Samuel McKee made his will in Hickman Co. KY devising his estate to said Martha McKee and appointed said Martha McKee and George Robertson to be executrix and executor of said will, and they sold to Jacob Robinson a tract of land in Garrard Co. near Dicks River and adj. ?? branch, for a portion of which land conveyed to Samuel McKee in his lifetime by Thomas Pope, said Robinson has already received a deed of conveyance, but for another portion purchased from Samuel K. Nelson and which said Nelson in his lifetime failed to make any deed but for which said Martha McKee, executrix and devisee, filed a bill in chancery in Lincoln Circuit Court against Reed Nelson the heir of said Samuel K. Nelson and obtained a decree for a title and the said land not having been heretofore conveyed to said Jacob Robinson during the lifetime of said Martha McKee, NOW in consideration of the premises, do hereby convey to said Jacob Robinson the above portion of land purchased by Samuel McKee of Samuel K. Nelson, which tract is bounded on north by land conveyed by Thomas Pope to Samuel McKee, on the south and east by said Robinson's home tract of land, and on the west by the land purchased by said Robinson of William G. Pollard, to him the said Robinson, warrant title. /s/ Geo. R. McKee, Benjamin F. Duncan, A.R. McKee, Jane L. Duncan. I hereby join in the foregoing conveyance as the surviving executor of Samuel McKee decd. but I am in no way to be responsible for the warrantee in the deed should the title prove defective, Nov. 17, 1855, /s/ G. KY owned by Isaac Burchill at the time of his death, and supposed to contain 56-1/2 acres more or less, the interest hereby conveyed being inherited by Elizabeth Duncan as the daughter and heir of said Isaac Burchill, together with appurtenances, warrant title. /s/ Elizabeth (X) Duncan.
