      Pg. 214/8: (earlier procession recorded 27 May 1822), Sketch of land; In pursuance of an ordered rendered by the county clerk at their June 1823 term on the application of John M. Duncan appointing us Benjamin J. Yane, Thomas Worrall?, and William Berkley commissioners to procession two tracts of land belonging to said Duncan, part of an original tract of 1680 acres that was entered, surveyed and pattented in the name of William Thermion? and agreeable to a notice herewith filed that was published in the western monitor at Lexington, we the aforesaid commissioners and Thomas Hart surveyor of the county, met at the dwelling house of said Duncan on 19 Aug. 1823 and then proceeded to settle? the Beginning corner of a tract of 150 acres whereon the said Duncan now resides which was conveyed by deed from John Payne and wife Betsy to said Duncan, being attended by James Kelly and Clark Thomson, disinterested persons residents of said county; at the beginning the commissioners caused a stone to be planted with the letters JMD engraved thereon which bears S-W 4/10 poles from a walnut remarked with one additional chop above the old corner marks, James Young and Joseph Kelly who claim land adj. being present and said Young admitted stone to be in a line of his land and the Kelly also admitted said stone as being at a corner of his land; from there extending according to the call of said Duncan ... west ... to a stone ... admitted by Joseph Thomson being present to be in a line of his land, said to be a corner of a tract of land belonging to Frederick B. Nicholas, and shewn by Joseph Kelly whose deposition is taken to perpetuate testimony as being at or near the spot where the corner was made between the surveys made for McDonalds and Duncan; from there extending south the calls aforesaid ... corner to Frederick B. Nichols; from thence extending pursuing the calls of said Duncans Deed ... planted a stone ... admitted by Griffin Kelly to be line of his land whereon he now resides and is said to be corner to Frederick B. Nichols land; from thence pursuing the calls of Duncans deed with said Kellys line ... Griffin Kelly admitted as a corner of his land; from thence ... All the lines of the above mentioned survey we remarked by adding one additional chop (on a tree) above the old marks thereon except ... (no date) Wit. James Kelly, Clark Thompson, Benjamin M. Taiel?.

Samuel Arnett decd and arising from the personal estate which Saml. Duncan a Negro girl named Kessy about 17 years of age, also another Negro girl named Lucy about 12 years of age, likewise another Negro girl named Winny about 10 years of age, also 2 feather beads and beadsteads and furniture, the title of which he the sd. Jno. Smith doth forever warrant ..., but it is clearly understood between the parties that the true intent and meaning of this indenture is that it is given in trust to secure to Dillard Collins & Cary K. Duncan the afsd sum of $109.20 which the sd. Jno. Smith has this day executed his note to carry interest from the date ... if not paid off on or before 1 April 1813, Dillard Collins & Cary K. Duncan may sell to the highest bidder at the house now occupied by said Jno. Smith in Clarke Co., the whole or so much thereof of the property as will satisfy the aforesaid note and interest and costs ... if John Smith pay the aforesaid note of $109.20 and interest before 1 April next, then the title is to revert back to sd. John Smith until a tryal can be had thereon in the Clarke Circuit Court, and provided the sd Dillard Collins should be damnifyed by the securityship ... in that case the afsd Trustee Cary K.       9-157/158: Deed of Trust, 5 Oct. 1812, John Smith of Clarke Co. KY to Willis Collins of afsd, for $1 paid, in trust to secure to Dillard Collins and Cary K. Duncan, partners negociating in trade under the firm of Collins & Duncan, the sum of $139.33 for which John Smith executed his note 5 Oct. 1812 payable 1 April 1813 to carry interest, sell to Willis Collins in trust one certain Negro girl named Winny about 10 years of age, ... if on afsd day of April 183? or any time thereafter, the sum of $133.33 or any part or the interest shall be unpaid, then Willis Collins as trustee at the request of said Collins and Duncan or either of them shall sell to the highest bidder ... if payment is made, title reverts to John Smith ... /s/ John Smith. Wit. John Duncan, Thos. (x) Burrus. N.B. The two beds & the two bedsteads was struck out before signing and the within Negro Winny is to remain in the possession of John Smith untill call for.       9-507/508: Deed of Trust, 4 Oct. 1813, John Smith of Clarke Co. KY to Cary K. Duncan of afsd, for $1 paid, and in further consideration of Silas W. Robbins having become the security of John Smith in a writ of replevin in the further proceedings on a distress?? issued in favor of Wm. Hierony? until the matter in controversy and to be determined in the Clarke Circuit Court where the suit is now pending, also in further consideration that sd. Robbins has entered himself Special Bail in two actions in covenant against sd Smith in the Clarke Circuit Court one commenced by Jacob Straughn & the other by Valentine & Michael Fhitty?, had conveyed in trust to said Duncan three Negro slaves, one named Keziah aged about 19 years, one named Lucy aged about 13 years, and the other named Polly Anne aged about 12 months (it being the child of Keziah) to secure & indemnify sd Robbins, and if Robbins should be damnified by the securityship, then Cary K. Duncan at the request of sd Robbins shall sell the Negroes to the highest bidder ... but if Robbins is in no degree or manner damnified by his securityship, this deed is void. /s/ John Smith. Wit. KY, for $1,510 paid, sell parcel of land containing 151 acres in Clark Co. adj. lands of James Young, McDaniel Nicold & Griffin Kelly, beg. on the line of James Young, then ... to corner to John & James McDaniel, then ... to corner to Nicolds & James, then with Nicolds line to a stone on Kellys line, then ... to the beginning, together with appurtenances, warrant title. /s/ John Payne, Betsey Payne. Wit. Griffin Kelley, James Games?, F.B. Nichols. They appeared June 9, 1813, before Carry L. Clarke, C.S.C.C., and Betsy Payne relinquished her right of dower. Recorded Oct. 29, 1813.
