KY, the said Joseph Duncan of Illinois was appointed commissioner in behalf of the heirs of Joseph Duncan decd. to sell land on Boyds Creek in Barren Co.; sold to Joseph Duncan of the 2nd part; by Thomas A. Duncan his attorney hereby conveyed to Joseph Duncan of Barren Co. the land on Boyds Creek belonging to heirs of Joseph Duncan decd, 158 acres adj. lands of Christopher Tompkins, John O.       K-46: 24 March 1823, whereas Joseph Duncan of Illinois is possessed of a number of tracts of land in Barren Co. KY & of a lot in town of Paris, KY; that I appoint Thomas A. Duncan of Nashville [Davidson Co.], TN, attorney to dispose of the lands; my affairs in Bourbon Co. or Barren Co. KY, and to make deed for land sold to Joseph Duncan of Barren Co. KY which was the property of the estate of Joseph Duncan decd, sold under an order of Bourbon Co. Circuit Court. Joseph Duncan appeared in Davidson Co. TN 28 March 1823.       N-382/383: 28 July 1834, Bartlett L. Graves, Sheriff of Barren Co. KY by John L. Graves, Deputy Sheriff, to Joseph Duncan of said Barren Co., that two executions of Fiere Facias issued from the Barren Circuit Court Clerk's Office on 23 Nov. 1833 against the estate of Charles Perkins, one in favour of William Porter for $125.21 with interest at 6% until paid and $5.71 cost, the other in favour of Robt. L. Gatewood for $78 with interest at 5% with interest from 27 March 1832 until paid and $7.55 cost, both returnable on Saturday preceeding 3rd Monday in January next ... which execution was placed in the hands of John L. Graves, Deputy Sheriff for Bartlett L. Graves then acting Sheriff of Barren Co., and John L. Graves levied on a tract of 110 acres on waters of Swearingin's fork of Beaver Creek, being the tract of land whereon said Charles Perkins now lives and which was on 6 April 1833 given in mortgage to Joseph Ewbank Junr. for $332, which tract of 110 acres was sold at public auction on 16 Dec. 1833 under the incumbrance of the afsd mortgage to Joseph Ewbank Jr., and Joseph Duncan was highest bidder at $7 which has been paid, now Bartlett L. Graves, John L. Graves his deputy, transfer and convey to said Joseph Duncan the afsd tract of land with its appurtenances against the claim of said Charles Perkins subject to the incumbrance of the mortgage. /s/ B.L.       N-392/393: 28 July 1834, Joseph Duncan of Barren Co. KY to Joel S. Perkins of same, for $20 paid, sell tract of land on the waters of Swearingin's fork of Beaver Creek containing 110 acres, the same tract which was given in mortgage by Chas. Perkins to Joseph Ewbanks Jr. for $332 on 5 April 1833, being the tract on which said Chas. Perkins now lives and which was sold by the sheriff of Barren Co. under two executions and which said Duncan purchased at Sheriff's sale under the incumbrance of the mortgage to Joseph Ewbanks Jr. at $7.00, warrant title and interest he has under the deed from Bartlett L. Graves ..., nevertheless the said Joel S. Perkins receives the conveyance under the incumbrance of the mortgage from Charles Perkins to Joseph Ewbank Jr. for $332 and releases the said Duncan from all damage that may accrue by a deficiency of title in consequence of the mortgage. /s/ Joseph Duncan. North bank of the creek and corner to Duncans Galloway tract, then ... corner to Bridgewater on Mr. c? Gillock's line, then ... Wm. Days line, then to the creek (1) ... (2) ...       R-174/175: That at the March term 1844 of the Barren Circuit Court on the Chancery side, a decree was rendered in a suit of H.P. Curd complainant and Nathan Bowles defendant, which ordered the tract of land in complainants bill containing 100 acres be sold to highest bidder, and Robert B. Hall was appointed a Commissioner to make the sale and convey the land to the purchaser, and on 15 April 1844 the sale was made after advertisement and Thomas Duncan was the highest bidder and purchaser of the 100 acres at $46.07, now R.B. Hall Commissioner sell to Thomas Duncan 100 acres in the bill mentioned be it more or less, free from claims of said Bowles, 20 June 1844. /s/ R.B. Hall, Commissioner. Crump agst Betsy Lowry at March term 1845 of said Court, it was ordered that the land mentioned in Complt's bill be sold or so much thereof as would satisfy and pay off said decree, and said Curd was appointed to make the sale and convey the land, which sale was made on 21 April 1845 when Thomas Duncan became the purchaser of 27 acres to be laid off on the west end so as to include the improvements on said tract of land at the sum of $53.77, now H.P. Curd Comss. as afsd, convey to Thomas Duncan the interest of the said Betsey Lowry to the land containing 27 acres, free from the claim of all and every person. /s/ H.P. Curd, Commissioner.       S-149: Whereas a decree was rendered by Barren Circuit Court at Sept. term 1846 in a suit in Chancery wherein Abigail Marshall &c are Complts and Joel S. Perkins &c defts. by which decree Robert B. Hall was appointed commissioner to sell the land in the bill, and sold the land on 16 Nov. 1846 to Thomas Duncan, the purchaser of one of said tracts of land, now 30 March 1847 said Hall as Commissioner afsd to said Duncan, for $127.50 paid, sell to said Duncan one of the tracts of land containing 105 acres, to hold said land free from the claim or claims of all and every person. /s/ R.B.       T-62/63: 21 March 1849, Joseph R. Garnett, Commissioner appointed by Barren Circuit Court, to Thomas Duncan, that said Barren Circuit Court at Sept. term 1848 in suit in chancery in which Thomas Duncan was complainant and William Pursley defendant, ordered that a tract of land on Glovers Creek in Barren Co., supposed to contain by survey 22 acres more or less, being the tract on which James W. Foster then lived adj. the lands of Thomas Duncan, or so much as would be necessary for that purpose, be sold for cash to pay off the sums in the decree, and that Joseph R. Garnett was appointed a Commissioner to make the sale, and after advertising, on 20 Nov. 1848 sold the tract of land to the highest bidder, and Thomas Duncan who was the complainant being the highest bidder, became the purchaser at the sum of $71. Therefore, Joseph R. Garnett ... conveys to said Thomas Duncan the afsd tract of land. /s/ J.R. Garnett. Duncan and Aaron Thomas Kinslow, my grandson, for $1 and love, all of whom are children save Aaron Thos. Kinslow who is a grandson; four young negroes; Martha about 10 or 11 years old, Sam about 7 years old, Dolly about 5 years old, & Parka about 3 years old; household furniture except three beds, kitchen furniture, farming tools, animals except a young brown mare & a little dun horse colt; also cattle, etc.; the negros having been alloted to Judith as part of her dower in the estate of Thomas Duncan decd.
