Z-433/440: Will of Joseph Duncan, sound mind but much affected in body, (1) give my soul to God, (2) payment of my honest and just debts and funeral expenses. Item, My wife and children being provided ample estate and income by her father and there grandfather the late James R. Smith I do not desire to do a great deal more for them, therefore I give my wife in trust for the joint use of herself and my children, the household and kitchen furniture, the carriage & horses, a two horse wagon & harness & horses therefor, six milch cows and three domestic animals necessary for the use & support of my family with power to convert it or any part into other property of like or different nature, and be reserved from the sale hereinafter ordered. Item, after the (above), my executors to support my aged and beloved mother during her natural life. Item (after the foregoing), should my sister Polly Ann Linn be in indigent circumstances, $1000 be invested by my executors in a tract of land for her sole and separate use and yearly support. Item (after the foregoing), my executors pay some $10 or $15 to Arnett. Item, when the foregoing provisions have been satisfied, my executors, if my estate is not exhausted, to convey in fee to the heirs of Joseph Cooley then being, 1/4 Section of my land in the Military bounty tract, Illinois. Item (after the foregoing), my executors pay $1000 to trustees of (blank) in Jacksonville in the erection of a new house to worship Almighty God. Item (after the foregoing), $2000 to estabish in neighborhood of Jacksonville an institution for relief and education of the blind, and like sum ... a lunatic asylum. Item, the suit of the United States now pending against myself and others as sureties of William Linn, late ?receiver? of public moneys at the land office, Vandalia, IL, be defended, and if my estate is forced to pay, my executors try year after year to recover the money so unjustly collected. Item, I have put up a bundle of notes to pay sums due by me to William Brown & William & Harriet B. Brown as execs. of William Brown decd, to remove incumbrances on the lands in Morgan Co. IL bought by me of David Ingalls. Item, the residue of my property be equally divided between my children and the offspring of any who may have died leaving such. Each boy as he arrives at 21, and each girl at like age or marry, shall be entitled to an equal share of my estate, provided that Court of Probate of Morgan Co. may order that share be paid the child's guardian. Appoint my brother James M. Duncan and my friend William Brown executors, without security. My remaining personal property be sold at public auction ... Item, my executors be agents to lease out the property secured to my family ... investment of trust funds which came to my hands from the executor of the will of the late James R. Smith. Conditioned that Joseph Duncan, upon payment of $450 according to 4 promissory notes bearing even date, shall deliver to said James M. Scott a deed and warranty for Lot 1 in Block 2 in Laporte Co, town of Michigan City, with appurtenances, this obligation to be void. I-210/211: 11 Feb. 1839, Shubal Smith to Perry Dunkins, have Dunned grants ?? and to farm lot ?? to Perry Dunkins and wife Mary Ann Dunkins 10 acres of land in Laporte Co. IN, to be taken off from E end of 80 acre lot now owned and occupied by sd? Smith in Sec.8 Twp.38N Range 2W, the premises to be 20 rods wide and 80 rods long, including all public roads, with all appurtenances, from the date hereof for the natural lives of said Perry Dunkins and Mary Ann his wife aged about 60 years, and said Smith warrant to said Dunkin and Mary Ann his wife against claims of others ... as long as Perry Dunkins and Mary Ann Dunkins shall continue to reside on said premises, and it is further agreed that if Perry and Mary Ann Dunkins move off from the premises, then the premises is to revert back to said Smith with all improvements and Perry and Mary Ann Dunkins shall not demand or receive any pay for the lot, neither is the sd.
