      B-207/208: Will of Joseph Duncan, Madison Co. IL, of sound mind and memory, make this my last will, revoking all others; appoint John S. Carigan executor. First, debts be paid if any, that sufficient of my personal property be sold for that purpose. Second, to wife the farm and improvements on which I now live, it being on the NE 1/4 Sec.15 Twp.3N Range 5W, during her life, to take issue and profits as will maintain her and the balance to go towards schooling my son Hugh M. Duncan and after her death or marriage again I bequeath all my right ... to the farm to my son Hugh M. Duncan, and to my daughters Rebecca & Margaret that each of them have as good a horse as Leannia & Sally my daughters that is married ... my wife have the household and kitchen furniture and farming tools ... if my son Hugh should die before he arrives at age 21 or have any heirs, my land & farm after decease of my son Hugh and my wife to sell my land & farm and divide the amount equally between my daughters, but not be sold during the life of my wife without her consent ... my wife judge the amount of what Linnea & Sally have had & give Rebecca & Margaret the same ...       4-137/138: Probate Office, Sept. 25, 1841. Elizabeth Duncan suggested the death of James Duncan late of Madison Co. IL; ordered that proof be taken; said Elizabeth Duncan made oath that James Duncan late of Madison Co. IL died on or about 2 Aug. 1841 intestate to the best of her knowledge. Ordered proof of the value of the personal estate of said deceased be taken, said Elizabeth made oath that the value of the personal estate belonging to James Duncan decd. does not exceed the sum of $600 to the best of her knowledge. Ordered the affidavit be placed on file. Elizabeth then presented a written nunciation of her right to be appointed administratrix of her decd. husband's estate, that William B. Reynolds be appointed; ordered document be placed on file, letters of admin. issue to said William B. Reynolds upon his entering bond with security according to law, penal sum be $600. Said William presented a bond with above ordered penal sum with Elijah Ellison as his security, approved, ordered filed, oath admin. to said William, placed on file, warrant of appraisement issue.       4-359: Probate Office May 22, 1843, This day came the administrator of the estate of Elizabeth Duncan decd, presented an inventory, appraisement bill of said estate of $323.87-1/2, Sale Bill of said Estate of $301.59-3/4, examined, approved and placed on file. (image 205)
      4-370/371: Probate Office August 9, 1843, This day came Benjamin F. Slater and suggested that Ann Maria & Amanda Louisa Duncan minor heirs of Elizabeth Duncan decd have some property coming to them from the estate of their deceased mother, that Ann Maria is over age of 14 years, that they have no parents living or guardian appointed them by law, said Slater made affidavit of the above, ordered placed on file. Proof of the value of property ... does not exceed $200, Ann Maria came into court and chose Benjamin F. Slater as her guardian, Benjamin prayed for Letters of Guardianship, bond of $400, with David Thorpe as security, Letters of Guardianship issued. (image 211)

      5-69: Probate Office April 23, 1844. Estate of Elizabeth Duncan, decd., came the administrator and prayed that settlement of said estate might take place, presented account current by which he stands charged $398.95, and is entitled to credits of $113.64, leaving balance of $285.31, ordered placed on file.       5-78: Probate Office May 29, 1844, Estate of James Duncan decd., came the administrator and prayed that settlement of said estate might take place, presented account current by which he stands charged $884.95, and is entitled to credits of $198.50, leaving balance of $686.45. It appearing the personal estate of deceased is insolvent and administrator is required to make petition to the Circuit Court for an order to sell Real Estate belonging to said estate, ordered that certificate of the situation of said estate be made out for the Circuit Court.       5-254/256: Probate Office, Nov.4, 1845, Estate of James Duncan decd. (marked beside figures throughout: NUL & VOID, G.W. Prickett, P.J.P.) This day came the Administrator of the estate of James Duncan decd and prayed that final settlement of said estate might now take place, ordered accordingly. Account Current, he stands chargeable to said estate $852.95, entitled to credits $38.43, balance in hands of admin. $824.52, subject to be distributed among several creditors, Unpaid debts of first & second class of $24.62, payable to ... Geo. W. Prickett Probate Justice $5.94, & 4 others; debts in fourth and last class of $996.93, distribution shares $786.30, about 25 people, including "Estate of E. Duncan, due $9.27, paid $7.15" After payment the Administrator will still have $3.60. Ordered certificate of settlement be made out. (images 158 and 159)
      5-356/357: Probate Office, May 30, 1846, Estate of James Duncan Decd, the Administrator of estate of James Duncan decd. prays that final settlement might now take place, ... chargeable to said estate, $852.95, credits $237.78, balance $615.17, paid debts of $12.81, other debts total $1277.68, distribution shares $599.43, (including E. Duncan estate $9.27, paid $4.35) leaving $2.93 in the hands of the administrator. (MAD: Apparently an amended statement by the administrator of the account) (images 209 and 210)
      5-442/443: Probate Office, Nov.10, 1846, Estate of Elizabeth Duncan decd. Comes the Admin. of the estate of Elizabeth Duncan decd and prays that final settlement of said estate may now take place. Chargeable with $285.31, credits of $115.13, balance $170.18, balance to be equally distributed among several heirs of said deceased, there being four of them, dividend made as follows: To John Duncan, Emily Slater, Ann Maria Duncan, and Amanda Louisa Duncan, $42.54-1/2 each, total $170.18. Ordered the Admin. pay the above to said distributees or their guardians, take receipts therefore and file in this office. The claim for $100 is given to and surrendered up by claimant thereof, to wit, Ann McKee, to the three daughters of said decd. as it appears from the letter of said Ann filed among the papers of said estate and made a voucher, the Admin. is ordered to pay to said three daughters of said decd, Emily Slater, Ann Maria Duncan, Amanda L. Duncan, $33.33 each or pay to their guardians, take receipts and file them in the office. Ordered that a certificate of said settlement be furnished. (images 252 and 253)

      A-200: Probate Office, Feb. 9, 1848, Estate of James & John Duncan decd. Charles Cook, Public Admr. of the estates of James and John Duncan's Estates presents an inventory of the personal estate of said James Duncan and John Duncan decd. as found by him in the dwelling and on the premises of said John Duncan deceased, which is appraised, he has not been able to ascertain what proportion of the property belonged to said deceased persons respectively, and asked the inventory and appraisement bill be filed. Ordered, to be placed on file among papers relating to estate of said James Duncan decd. (image 118)
      A-219/220: Probate Office March 4, 1848, Estate of John Duncan decd, William Hadley presents the affidavits of James Keenan and James H. Downey by which it appears that Robert Duncan and James M. Duncan are nephews and the nearest of kin to the late John Duncan of this county. Affidavit placed on file. Said Robert and James M. claim their right to be administrators of said John's estate, ordered that letters of admin. heretofore granted on 7 Feb. 1848 to Charles Cook Public Administrator are hereby revoked and Robert and James M. having appeared in person, they requested letters of administration be issued to Willialm Hadley, Letters of Admin. be issued to Hadley, who makes affidavit the value of the personal estate of said John does not exceed $500, said Hadley entered into bond for $1,000, security Robert Duncan. Letters of administration granted to said Hadley. Warrant issued to 3 persons to appraise personal property of decd. (images 127, 129)
      A-237: Probate Office March 30, 1848, Estate of James Duncan decd, the citation heretofore issued on 24 March 1848 to Wm. Hadley at the instance of Chas. Cook Public Admin. of this county is returned as duly served by Henry Bernius, constable of this county, and said Hadley and Cook appeared, and Cook represents to the court that the creditors of the said Jas. Duncan decd. refuse or decline to indemnify him in any prosecution of a suit or trial to determine the right of the property alluded to in the affidavit of said Cook filed March 24, 1848, and also in the citation, on motion of said Cook it is ordered the citation be quashed and the examination prayed for be dismissed. Now the Admr. of estate of John Duncan decd. prsents Notice of Final Settlement and to creditors to present their demands for adjustment, which notice is certified and placed on file. The Admr. prays a continuance, ordered accordingly. Admin. have further time until (blank) day of (blank) 18 (blank) to finally settle. (image 42)
      A-376: Probate Office, June 11, 1849, Estate of John Duncan decd. Now the Admr. of the estate of John Duncan decd. presents an inventory of the estate, which is examined, approved, and ordered filed, and also an appraisement bill of goods and chattels of said decd, examined, approved and ordered filed, and also a sale bill of personal estate which amounts to $975.01, being $69.96 more than the appraisement bill, which is examined, approved and ordered filed.       B-330: Estate of John Duncan, Feb. 7, 1852. The Admr. of the estate of John Duncan prays that a partial settlement of said estate may now take place, ordered, Admr. charged with $989.01, payments made on account of claims of $225.29, balance of assets of $762.72, approved, Admin. authorized to pay to Davis & Edwards their fee as attorneys in attending to legal business for said admr, $10.00, balance of assets $753.72. Admr. paid or mostly paid the demands filed and allowed by Probate Court within 2 years from time Letters of Admin. were granted, believing the personal assets in his hands would be abundantly more than sufficient to pay demands in full, and be authorized to pay balance, list of accounts: Stephen Johnson $5.60, Robert Duncan $68.42, James Duncan $54.50, Johnathan Duncan $68.60, 6 others; that Robt. Mc O'Blenis by his attorney J.S.D. Morrison filed a note against John Duncan on 20 March 1851, more than 3 years after letters were granted, and it was allowed, said McO'Blenis being as it appeared "a person beyond the seas" which note with interest amounts to $526.00. The personal estate or proceeds remaining in the hands of the admin. after paying the demands filed and allowed within 2 years are insufficient to pay said McO'Blenis claim in full, the personal estate is declared insolvent and the Admr. take necessary steps to effect a sale of real estate to pay the balance of debts, and admin. asks to retain $42.45 to be applied towards expenses to sell the land and have further time.       B-334/335: Estate of Joseph Duncan decd, Feb. 13, 1852. Comes Hugh M. Duncan and suggests the death of Joseph Duncan late of Madison Co. IL, and makes affidavit that Joseph Duncan died on or about 9 Feb. 1852 leaving a will, Hugh presents document purporting to be the will of said Joseph Duncan, the two witnesses George Cuddy and Thomas B. Savage made oath, the will is proved and admitted to record, Hugh M. Duncan prays that letters testamentary to said will be granted him, ordered, he entered bond according to law. Hugh makes affidavit that the personal estate does not exceed $500, and presents his bond for $1,000, George Cuddy as security. Ordered letters be issued, warrant to appraise the personal estate be issued to Alexander Forrester, George Cutty and Thomas B. Savage. (image 203)

      E-282: Madison Co. Court, Jan. 14, 1864. Hugh M. Duncan decd. George Cuddy filed affidavit that Hugh M. Duncan late of Madison Co. IL died on or about 26 Nov. 1863 intestate, the value of his personal estate does not exceed $1,000, leaving a widow Mary Duncan and 5 children, viz: Mary Ann, Margaret M., Sarah E., Amy A. & Oliver H. Duncan all minors. He presented a relinquishment in writing of Mary J. Duncan and Joseph Duncan, the one the widow and the other the brother of deceased, and the recommendation by the widow of George Cuddy as admr. of decd. Ordered he be appointed upon his filing bond for $2,000; bond filed with Joseph F. Duncan security, letters issued. Garrett Crownover, William Hazenaur and Frederick Fritz be appointed to appraise the personal estate of decd. (image 169)
      E-328/329: Madison Co. Court, Tuesday, April 19, 1864, Hugh M. Duncan decd. The admr. of the estate of Hugh M. Duncan decd. filed inventory of the estate and appraisement bill of $1784.29 and allowance to widow of specific articles $540.10 and sale bill amounting to $1147.30, and report of articles kept by widow at appraisement. Admin. shows that he has given notice by publication in a public newspaper published weekly in Madison Co. and by posting notice on the bulletin board in the court house and 5 other public places, of his intention to appear for an adjustment of the claims of deceased. Therefore an adjustment and settlement is had and the judgment of the court is passed upon all claims prosecuted. (image 194)
