      Affidavit of Catharine Duncan: "State of Illinois, Saline County} SS On this 2nd day of February AD 1889. Personally appeared before a Notary Public in and for said County and State. Catharine Duncan of said County, who after being duly sworn on her oath says. That she is 48 years of age and her Post Office is Mitchellsville, Ills. that on the 2 day of January 1888, she was lawfully joined in marriage to one Robert Duncan in the County of Saline and State of Ills. That at the date of then said marriage the decd. Robert Duncan was a late Private of Co. "F" 29th Regiment of Illinois Vols. That at the time of then said marriage and until the 30th day of September 1888 the said Robert Duncan, her husband as aforesaid was a Pensioner of the United States duly enrolled at the Pension agency at Chicago Ills. at the rate of Eighteen ($18.00) per month, under Pension Certificate the Number of which is not known to her for the reason that said certificate is now lost or mislaid by one James B. Borden, who last had the same in his possession. And now says he has lost the same. And that she has no knowledge of its whereabouts. That the said Robert Duncan her husband was drawing a Pension for disease of his lungs. That on the 30th day of September 1888, the said Robert Duncan died of said disease. That at the date of his death, there was a pension due him at the rate of Eighteen (18.00) dollars per month as aforesaid from the fourth day of September 1888 to the 30th day of September 1888. That she makes this declaration for the purpose of obtaining the said accrued pension. That she has not remarried since the death of her said husband. That she hereby appoints Jacob Hayes of Stone Fort Ills as her true and lawful attorney to prosecute this claim. Attest J.A. Shelton, J.L. Dunn} Catherine Duncan. Also personally appeared before me J.A. Shelton and J.L. Dunn residing at Mitchellsville Ills. persons whom I certify to be respectable and entitled to Credit and who being by me first duly sworn, on their oaths say. That they and each of them have every reason to believe and do believe from the appearance of said Claimant and their acquaintance with her, that she is the identical person she represents herself to be and that they nor either of them have any interest in the prosecution of this claim.       Widow's Application: "[3-012] WIDOW'S DECLARATION FOR PENSION. State of Illinois, County of Saline, SS: ON THIS 13th day of February, 1889, personally appeared before me, a Clerk of a Court of Record in and for the County and State aforesaid Catharine Duncan a resident in the County of Saline and State of Illinois aged 48 years, who being duly sworn, makes the following declaration, in order to obtain the Pension provided by the Act of Congres granting pensions to widows. That she is the widow of Robert Duncan who was a Private in Company "F" commanded by Capt. Peter Belford in the 29th Regiment of Ills Infty Vols. in the War of 1861-5 that her maiden name was Catharine Stiff and that she was married to said Robert Duncan on or about the 2nd day of January 1888, at Harrisburg in the County of Saline and State of Illinois by R.N. Warfield, J.P. and that she knows of no record evidence of said marriage except that of which a true copy is herewith annexed. SHE FURTHER DECLARES that said Robert Duncan her husband, died at Saline County in the State of Illinois on or about the 30th day of September 1888, of disease of lungs, that at date of his death he was a pensioner under Certificate No. 230.704 at the rate of $18.00 per month Enrolled at Chicago Pension Agency. She also declares that she has remained a widow ever since the death of said Robert Duncan, and that she has not in any manner been egaged in, or aided or abetted, the rebellion in the United States; and she hereby appoints Jacob Hayes of Stone Fort Ills. as her lawful Attorney, with power of substitution, and authorizes him to present and prosecute this claim, and to receive her pension certificates. The following is the name . of all the children of her deceased husband who were under sixteen years of age at the time of his death to wit. Esra Duncan, by former wife of Robert Duncan, precise age not known, and who is now in car of his guardian and for whom she does not claim. That she has not abandoned the support of any one of her children but that they are still under her care or maintenance. My post-office address is Mitchellsville, Saline County, Ills. Witnesses - L.S. Hinds, R.N. Warfield. Catherine Duncan (Signature of Claimant). ALSO PERSONALLY APPEARED before me, R.N. Warfield and L.S. Hinds residents of Saline County, and State of Illinois to me well known as credible persons, who being duly sworn, declare that they were present and saw said Catharine Duncan sign her name to the foregoing declaration, and that they have every reason to believe, from the appearance of said applicant and their acquaintance with her, that she is the identical person she represents herself to be, and know that said deceased recognized said applicant as his lawful wife, and that she was so recognized by the community in which they resided; and that they have no interest, direct or indirect, in the prosecution of this claim.       Marriage Certificate: "CERTIFICATE OF RECORD OF MARRIAGE, STATE OF ILLINOIS, SALINE COUNTY, } SS. I, James H. Pearce Clerk of the County Court of said county hereby that Mr. Robert Duncan was married to Mrs. Catharine Pierson in said county, on the 2nd day of January A.D. 1888 by R.N. Warfield a Justice of the Peace duly authorized to solemnize marriages by the Statute of the State of Illinois, as appears by his return and certificate of Marriage attached to the license granted therefor by the Clerk of this Court, and now on file in my office. In witness whereof, I have hereunto subscribed my name and attached the seal of the said County Court, at my office in Harrisburg Saline Co. Ill. this 2nd day of February A.D. 1889 James H. Pearce, Clerk of County Court."
      Certificate for John H. Lee: "State of Illinois, SALINE COUNTY} SS. I, JAMES H. PEARCE, Clerk of the County Court for said County and State, do hereby certify, that Jno. H. Lee whose name is subscribed to the foregoing declaration was, on the day of the date thereof, an acting Notary Public, within and for said County, regularly commissioned and qualified: that his commission was dated Nov. 28 1885, and will expire on Nov. 28, 1889.       Affidavit of Charles & Jane Turner: "State of Illinois, Saline Co} SS. In the matter of pension claim No. 389.952 Catherine Duncan widow of Robert Duncan dec'd Priv. Co. "F" 29 Ill Infy. Personally appeared before me a Notary Public in and for the County & State aforesaid - Charles W. Turner 55 years of age and Jane Turner 54 yrs. Of age, whose P.O. address is Mitchellsville Illinois, who being duly sworn state that Lewis J. Turner died Jany 8th 1879 and that Milton Peirson died June 5th 1886 and they were each husbands of Catherine Duncan the claimant and that we make these statements from personal knowledge of the facts and we live near neighbors to claimant and are not interested in the prosecution of the above claim. Written to mark, Tad Welch, J.R. Lell. Charles W. his X mark Turner, Jane her X mark Turner. Sworn and subscribed to before me this June 14th 1889.       Affidavit of Leona Lanty and Nancy Carter: "State of Illinois, County of Pope} SS. In the matter of the pension claim of Catherine Duncan widow of Robert Duncan Deceased Co. F 29 Regt Ills Infty Vols, Cert No. 230.704 Orig No. 389.952. Personally appeared before me a Notary Public within and for the County and State aforesaid Leona Santy aged 49 years and Nancy Carter aged 37 years whose P.O. adress is Heroa Springs Ills. well known to me to be reputable and entitled to full credit, who being by me duly sworn according to law on their oath says. We were acquainted with Elvira Duncan wife of Robert Duncan above named. We was present and say her buried. The Decd on or about the 13th day of May 1885.       Affidavit of W.E. Osborn: "State of Illinois, Williamson County} In the matter of pension claim No. 230.704 of Catharine Duncan, widow of Robert Duncan, Private, Co. "F" 29th Regt Ills. Vols. Personally appeared before me a Notary Public in and for said County, W.G. Osborn who after being duly sworn says: he is 51 years of age and his P.O. is Stone Fort, Ills. that he is a registered practicing Physician and has been for more than 25 years. That he was well acquainted with Robert Duncan Private Co "F" 29th Reg.t Ills Vols. That he saw said Robert Duncan and was in his Company almost daily for about one month prior to his death. That about ten days prior to his death he made an examination of the said Robert Duncan and found him suffering in the excess with disease of his lungs. That he then prescribed for him and told him to go to his house and go to bed, which he the said Duncan did. That the said Robert Duncan never again got up, but died on the 30th day of September AD 1888. That he did not see him die, but has every reason to believe he did die on the date aforesaid by seeing his friends and other people going to and from his funeral. That he is well satisfied as a Physician that the said disease of lungs was the remote and immediate cause of the said Robert Duncan's death. That he is in no way related to said claimant and has no interest in the prosecution of this claim. W.E. Osburn, M.D. Subscribed and sworn to before me this 21st day of February 1889 and I certify that the foregoing affidavit was read to and is the hearing of said witness before swearing to the same.       Affidavit of Dr. Daniel Bazarth: " State of Illinois, Williamson County} SS. In the matter of Pension claim No. 230.704 of Catharine Duncan widow of Robert Duncan, Private Co. "F" 29th Regt. Ills Vols. Personally appeared before me a Notary Public in and for said County, Dr. David Bazarth who after being duly sworn on his oath says: he is 49 years of age and his P.O. is Stonefort Ills. That he was well acquainted with Robert Duncan and has been for about twenty years prior to his death. That he has during said time at different times consulted with deceased regarding disease of lungs. That he was called to see deceased on about Sept 25, 1888. He saw him about twice, he thinks the 28th of said month was the last time he saw him. And was confident that death was inevatable (sic) owing to disease of lugs. And from the symptoms on my last visit I am satisfied that disease of lungs was the remote and immediate cause of death which case I am creditabily (sic) informed died on the 30th day of Sept. 1888. That he is not related to said claimant and has no interest in the prosecution of this claim. David Bazarth, M.D. Subscribed and sworn to before me the 13th day of February A.D. 1889. And I certify that the foregoing affidavit was read to and is the hearing of said witness before swearing to the same and that said witness is respectable and entitled to credit and in good professional standing.       Affidavit of Dr. J.M. Kelley: "State of Illinois, Williamson County} SS. In the matter of Pension Claim No. 230.704 of Catharine Duncan, widow of Robert Duncan Private Co. "F" 29th Regt Ills. Vols. Personally appeared before me a Notary Public in and for said County. J.M. Kelley, who being duly sworn on his oath says. He is _ years of age and his P.O. is Stonefort Ills., that he is a regular practicing Physician and has been for more than ten years last past. That he was well acquainted with Robert Duncan prior to his death which occurred on the 30th day of September 1888 in Stonefort Ills. That he was called to treat and did treat the said Robert Duncan in connection with Dr. David Bazarth for about two days prior to his death. That he the said Robert Duncan was at the time suffering from disease of the Lungs. That he treated said Robert Duncan during his test illness in connection with Dr. Bazarth as aforesaid. And knows as a matter of fact that disease of the Lungs was both the remote and immediate cause of his death. That he knows the above facts both from theory and his practice and experience in treating such cases. And by making a personal Examination. That he is in no way related to said claimant and has no interest in the prosecution of this claim. J.H.       Ezra Duncan claim: "LETTERS OF GUARDIANSHIP. STATE OF ILLINOIS, Saline COUNTY} SS. In the County Court, January Term, A.D. 1889. The People of the State of Illinois, to James B. Bolden of said County, Greetings: WHEREAS, at the January Term the County Court of said County, A.D. 1889, holden at Harrisburg you were, by order of said Court, duly entered of record on the 18 day of said month, duly appointed Guardian for Ezra Duncan, minor heir of Robert Duncan, deceased. Trusting in your fidelity, therefore, the said Court does by these presents constitute and appoint you to be Guardian unto said minor, and authorizae and empower you to take and have the care of his person and the custody and management of his property, and frugally without waste or destruction, to improve and account for the same in all things according to law.       Affidavit of James B. Borden: "State of Illinois, Saline County} SS. On this 20th day of July A.D. one thousand eight hundred and ninety one personally appeared before me a Clerk of the County Court a court of Record within and for the County and State aforesaid James B. Borden aged 53 years, a resident of Stone Fort, Saline County, Illinois. Who being by me duly sworn according to law makes the following declaration in order to obtain the pension provided by Acts of Congress for children under sixteen years of age. That he is the only legal guardian of Ezra Duncan legitimate child of Robert Duncan who inlisted (sic) as a private under the name of Robert Duncan on or about the 14th day of August 1861, in Saline County Illinois in Co. F 29th Regt. Ill. Vol. in the War of 1861. Who was discharged on or about the 8th day of March 1865. Who died at Stone Fort, Illinois on or about the 30th day of September 1888 of disease of lungs contracted in aforesaid service. That he left a widow surviving to wit: Catherine, who he is informed is now drawing a pension as the widow of said Robert Duncan. That his said ward Ezra Duncan does not now nor has not resided with or been supported by or under the control of the said widow. Catherine Duncan since the death of his father Robert Duncan. That the above named is the only surviving legitimate child of said Robert Duncan who was under sixteen years of age at the time of his death except Matilday who died on or about the 15th day of Oct. 1888 and Ellen, who died on the 5th day of Oct. 1888. That the children of said solder were the issue of soldier, as follows. The dates of their birth being as herein after stated. Matilday of Soldier by Elvira (nee) Gibbs born July 9th 1875, Ezra, of said Soldier, by Elvira (nee) Gibbs born May 17th 1878; Ellen, of said soldier by Elvira (nee) Gibbs born July 16th 1880. That the mother was married under the name of Elvira Gibbs to said Robert Duncan in Hardin Co., Ill. There being no legal barrier to such marriage. That the said child has not aided or abetted the rebelion. That said children's father was a pensioner of the United States. The date and number of his certificate is unknown to declarant. That he hereby appoints with full power of substitution and revocation D.W. Choisser of Stone Fort Illinois his true and lawful attorney to prosecute this claim. Walden aged 45 years whose Post office address is Herod Springs Ill. and who being by me duly sworn upon her oath in regard to aforesaid claim both depose and say: That she was well and personally acquainted with Robert Duncan in his lifetime and also with Elvira his wife in here life time. That on or about the 16th day of July 1880 the said Elvira gave birth to a female child which said child was named Ellen: that knows the foregoing to be true by reason of being on eof the attendants on said Elvira and by being present and witnessing said birth: that she is in no way interested in the prosecution of this claim. Martin aged 58 years whose Post Office address is Rose Clare Ill. and who being by me duly sworn upon her oath in regard to the aforesaid claim doth dispose and say that she was well and personally acquainted with Robert Duncan in his life time and also with Elvira his wife in her life time: that on or about the 17th day of May 1878 the said Elvira gave birth to a male child which said child was named Ezra. That she knows the foregoing to be true by reason of being one of the attendants on said Elvira and by being present and witnessing said birth. Joseph Martin, aged 63 years and Deaney Martin, aged 31 years whose Post Office addresses are Stone Fort Illinois and who, being by me duly sworn upon their oaths in relation to aforesaid claim doth depose and say, each of them: That they were well and personally acquainted with the above soldier Robert Duncan and were well and personally acquainted with all the members of his family at the time of his death. That he left a widow Catherine and three children. Matilda, Ezra and Ellen. That said Ellen died on the 5th day of October 1888; that they and each of them saw her when a corpse soon after death. The the said Matilda died on the 9th day of October 1888; that they and each of them witnessed her death. That the said Ezra is still living. That Elvira Gibbs, mother of the above named children had never been married previous to her marriage to the said Robert Duncan on the 7th day of August 1874; and that neither of them are interested in the prosecution of this claim.       Affidavit of Jane Shaw: "State of Illinois, Williamson County} SS. In the matter Pension widows Certificate No. 257.662 of James B. Borden as guardian of the minor of Robert Duncan, Co. "F" 29th Reg't Illinois Infantry Volunteers. Personally appeared before me, a Notary Public in and for the county and State aforesaid. Jane Shaw aged 43 years, whose Post Office address is Stone Fort, Illinois and who, being by me duly sworn upon her oath in relation to aforesaid claim doth depose and say: That she was well and personally acquainted with the aforesaid soldier, Robert Duncan in his life time and was also acquainted with Elvira Duncan, one of his wives, whose maiden name was Gibbs in her life time. That said Robert Duncan and said Elvira Gibbs were married in Hardin County Illinois on or about the 7th day of August 1874; that said Robert Duncan had been previously married to one Betsy Ann Whittaker, who died on or about the 13th day of May 1872. That said Elvira had never been previously married; that she makes the foregoing statement derived from acquaintance and from being a sister of Elvira Duncan. That she was well acquainted with all of the children of said Robert Duncan of any age or marriage for who survived him and that their names were: Matilda by Elvira Gibbs. Ezra by Elvira Gibbs. Ellen by Elvira Gibbs. That Matilda was born on the 9th day of July 1875; that she was present as an attendant on said Elvira at the bird of said Matilda; that Ezra is the only child of said Robert Duncan who is now living and that she has no interest in the prosecution of this claim. No. 257662 ON THIS third day of October A.D. 1892; personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths Harriet Borden aged 29 years, a resident of Stone Fort in the County of Saline and State of Illinois whose Post Office address is Stone Fort, Illinois and Deaney Martin, age 33 years, a resident of Stone Fort in the County of Saline and State of Illinois whose Post Office address is Stone Fort, Illinois well known to me to be respectable and entitled to credit, and who being duly sworn, declare in relation to the aforesaid ease as follows: That _ have been well and personally acquainted with _ for _ years, and _ years respectively, and that they and each of them are half sisters of Elvira Duncan, whose maiden name was Gibbs who is the mother of the said Ezra Duncan. That the said Elvira was married to the said soldier, Robert Duncan at their, the affiants father's residence in Hardin County, Illinois on the 7th day of August 1874 by one L.F. Plater, then a Justice of the Peace of said Hardin Co. That they and each of them were present and witnessed the ceremony at said marriage at said time and place as aforesaid.
