      Application letter of Thomas Duncan: "Harrisburg, Illinois, June 29th 1892. Hon. Commissioner of Pensions, Washington, D.C. Dear Sir. Pleas Send me Declaration for to Make application as Guardian for Pension. Also declaration to make application for accrued Pension. I am the Guardian of Violet V. Duncan minor child of John Duncan who was a Private of Co. B, 31st Regt Illinois Inft. Vols who is Dead. Certificate No 315998. My Post Office is Mitchellsville Saline County Illinois.       Guardianship of Thomas J. Duncan: "2560 Letters of Guardianship. STATE OF ILLINOIS, Saline COUNTY} SS. In the County Court, June Term, A.D. 1892. The People of the State of Illinois, to T.J. Duncan of said County - GREETING: WHEREAS, At the June Term of the County Court of said County, A.D. 1892, holden at Harrisburg you were, by order of said Court, duly entered of record on the 18th day of said month, duly entered of record on the 18th day of said month, duly appointed Guardian for Violet V. Duncan Minor child of John Duncan deceased. Trusting to your fidelity, therefore, the said Court does by these presents constitute and appoint you to be Guardian unto said Minor _, and authorize and empower you to take and have the care of her person _ and the custody and management of her property, and frugally without waste or destruction, to improve and account for the same for the same in all things according to law. Vols. Infty. (3-015.) F Declaration for Pension of Children under Sixteen years of age. F STATE OF Illinois, COUNTY OF Saline, SS: On this 5th day of August, A.D. one thousand eight hundred and Ninety two personally appeared before me Clerk of the County Court the same being a court of record within and for the county and State aforesaid, Thomas J. Duncan a resident of Mitchellsville, county of Salien, in the State of Illinois aged thirty seven years, who, being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Acts of Congress for children under sixteen years of age: That he is the only legal guardian of Violet V. Duncan, legitimate child of John Duncan enlisted at Saline County, Ills. on the 10th day of August, A.D. 1861 in Company B 31st Regt. Ills. Inft. Vols. in the war of 1861 to 1865, who died at Saline County, Ills on the 18th day of February 1892, of Chronic Diarrhea and Disease of the lungs contracted in the Service aforesaid and who bore at the time of his death the rank of Private, in the Service aforesaid of that he left no widow surviving Divorced from wife Sept. 20, 1882, his first wife Died sometime on the year 1880 that the above named are the only surviving legitimate child of said John Duncan who were under sixteen years of age at the time of his death, of whom that said children were the issue of said soldier as follows, the dates of their birth being as hereinafter stated: Violet V., of soldier by Frances J., born Jany 11th, 1879. That the father was married under the name of John Duncan to Frances J. Wilson, there being no legal barrier to such marriage; that the said children have not aided and abetted the rebellion; and that no prior application has been filed. That declarant hereby appoints Thos. Y. Reynolds of Harrisburg Ills. attorney to prosecute the above claim; that his residence is No. _, _ street, in the Town of Mitchellsville, county of Saline, State of Illinois and his post office address is Mitchellsville, Saline Co., Illinois. Thomas J. Duncan (Claimant's signature). Also personally appeared John K. Lee, residing at No. _ , in _ street, in Harrisburg and A.W. Lewis residing at No. _, in _ street, in Harrisburg, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Thomas J. Duncan, the claimant, sign his name to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with him that he is the identical person he represents him to be; and that they have no interest in the prosecution of this claim.       Application for accrued Pension: "(3-561.) APPLICATION FOR ACCRUED PENSION. (MINORS.) State of Illinois, County of Saline, SS: On this 5th day of August, 1892 personally appeared Thomas J. Duncan Guardian of Violet V. Duncan, who, being duly sworn, declare that John Duncan, deceased, was granted a pension by Certificate No. 315,998 payable by the Pension Agent at Chicago, Ills, which Certificate is herewith surrendered (if not, why not) _; that said pensioner died on the 18 day of Feb., 1892, having been last paid to include the 4th day of January, 1892, and that application is hereby made for the pension which had accrued up to the date of the pensioner's death. He further swear to the truth of the following statements: The said John Duncan had not been paid or emploid in the Army navy or marines Service of the United States subsquent to January 4th 1892. He further swear that the following are the names, with the dates of birth, or the dates of death, of all children left by the deceased pensioner, who were under sixteen at pensioner's death, viz: Violet V. Born January 11th 1879. The affiant's residence is (give street and number) Mitchellsville Illinois, and his post-office address is Mitchellsville Saline County Illinois. Signature of affiants;{ Thomas J. Duncan. Also appeared John H. Lee, and A.W. Lewis residing at Harrisburg Ills., who, being duly sworn, make oath that they were present and saw Thomas J. Duncan sign his name to the foregoing declaration; that they know that the widow is dead, and that the above-named children are the legitimate children of John Duncan, who died on the 18th day of February, 1892, and the dates of birth and death of said children to be as above stated; and that their means of knowledge as to the date of the pensioner's death, as to the fact of the widow's death, and as to the legitimacy, ages, and death of the children, are as follows: that we were personally well acquainted with John Duncan & wife in their lifetime.       Affidavit of Dr. John W. Mitchell: "GENERAL AFFIDAVIT. State of Illinois, County of Saline SS: In the matter of Claims of Thos. J. Duncan Guardian of Violet V. Duncan minor child of John Duncan Late Co. B 31st Regt. Ills Vols. ON THIS 5th day of August A.D. 1892, personally appeared before me a County Clerk in and for the aforesaid County in and for the aforesaid County and State, John W. Mitchell aged 67 years; a citizen of City of Harrisburg, County of Saline, State of Illinois well known to me to be reputable and entitled to credit, and who being duly sworn declares in relation to aforesaid case as follows: That he is a physician and has practiced medicine in said County & State for forty years. John Duncan late private Co. "B", 31st Regiment Ill. Vol. Inf. was treated by him during last winter for Tuberculosis and chronic diarhea. Said pensioner was much emaciated when first seen by me and died about the last days of February from axhaustion produced by said diseases. I further declare that I no interest in said case, and am not concerned in its prosecution. J.W.       Affidavit of Dr. David Bozarth: "GENERAL AFFIDAVIT. State of Illinois, County of Saline SS: In the matter of Claims of Thos. J. Duncan Guardian of Violet Duncan minor child of John Duncan Late Co. B 31st Regt. Ills Vols. ON THIS 8th day of August A.D. 1892, personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths David Bozarth aged 53 years, a resident of Stone Fort, in the County of Saline, and State of Illinois whose Post Office address is Stone Fort Ill. well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: I treated John Duncan in several bad astacts (sic) of Lung disease at various times soon after his return from the army also Rheumatism and chronic Diarrhea. I cannot now give the dates, but remember well that his diarrhea generally grew worse until something near a month prior to his death I was called to see him. He was coughing & execting profusely with constant diarrhea and very much inaciated. I was confident I could do nothing to stay the disease and he excused my self & I resided some 10 miles from him was never called again to see him, but feel confident from symptoms manifest on my last visit that the alone disease was the cause of his death. I further testify that I am a regular practicing physician and have been for 27 years last past. I further state that his death accured about the 18 day of February 1892, reason of knowing was by Telegram. I further declare that I have no interest in said case and I am not concerned in its prosecution.       Affidavit of Mary Vinyard: "GENERAL AFFIDAVIT. State of Illinois, County of Saline SS: In the matter of Claims of Thos. J. Duncan Guardian of Violet Duncan minor child of John Duncan Late Co. B 31st Regt. Ills Vols. ON THIS 12th day of August A.D. 1892, personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths, within and for the county and state aforesaid, Mary Vinyard aged 43 years; resident of Mitchellsville, County of Saline, and State of Illinois, well known to me to be reputable and entitled to credit, and who being duly sworn according to law, state in relation to the above named claim as follows: That I was present at the birth of Violet V. Duncan who was born Jany. the 11 AD 1879. I further state that Rhoda Land who was "Mid Wife" is dead and that I am the only person now living who was present at the birth of said child. Trovillion Clerk of the County Court of said County, hereby certify that Mr. John Duncan was married to M. Francis J. Wilson in said County on the 12th day of March A.D. 1865 by John Wertz a Justice of the Peace duly authorized to solemnize marriages by the Statute of the State of Illinois, as appears by his return and certificate of marriage attached to the license granted therefor by the Clerk of this Court and now on file in my office. In Witness Whereof, I have hereunto subscribed my name and attached the seal of said County Court, at my Office in Golenda Illinois this 25th day of July AD 1892. Buss V. (stamped, PENSION US OFFICE, SEP 13, 1892). TRANSCRIPT OF PROCEEDINGS IN SUIT. United States of America. STATE OF ILLINOIS, Saline County,} SS. In Circuit Court, September Term A.D. 1882. PLEAS, before the Honorable Oliver A. Harker one of the three Judges of the First Judicial Circuit of the State of Illinois, and presiding Judge of the Circuit Court of Saline County, in the State of Illinois, and presiding Judge of the Circuit Court of Saline County, in the State aforesaid, at a term thereof, began and held at the Court House, in the Town of Harrisburg in said County, on the Eleventh day (being the Second Monday) of September in the year of our Lord one thousand eight hundred and Eighty Two and of the Independence of the said United States the one hundred and sixth. Present, Honorable Oliver A. Harker one of the three Judges of the First Judicial Circuit of the State of Illinois. Wm V. Choisser State's Attorney. Thos. Y. Reynolds Clerk. Wm. M. Gregg Sheriff. Attest. Thos Y. Reynolds, Clerk. At which said term of Court the following proceedings were had to wit: John Duncan vs. Martha J. Duncan} Divorce Wednesday Sept 20th A.D. 1882. And now on this day comes the Complainant by Miss Gregg and Parish Solicitors for the Complainant and Moves the Court for a default in this Cause and it appearing to the Court that the defendant has been duly and legally served with process from this Court for more than ten days prior to the first day of the present term of this Court and it further appearing to the Court that the defendant herein has neither plead ausurrea or denurren to the complainants bill herein and said complainant bring now three times solemnly called in open Court to plead ausurr or denurren to the complainants bill herein comes not nor any one for but herein makes default. It is therefore ordered by the Court that a default be and the same is hereby entered against the said defendant. And that said bill filed herein be and the same is taken for confessed against the said defendant. And now on this same day this cause comes again in Court for a final hearing upon the file of complainant default of defendant and oral testimony produced in open Court and the Court being fully and sufficiently advised in the premises finds that all the material allegations in said bill contained are true as therein stated. And that the said bill is therein stated sustains the charge of adultery and the Court finds that the said defendant is guilty of adultery as therein charged. It is ordered adjudged and decreed by the Court that the bonds of Matrimony now and heretofore existing be and the same is hereby disolved and for naught esteened. Ordered that Complainant pay all cost of this proceeding and that execution May issue &c. I, Thomas Y. Duncan, minor of John Duncan dec. Co. B, 31 Reg't Illinois Inft. Vol's No. 559248 (stamped, PENSION US OFFICE DEC. 8, 1892). GENERAL AFFIDAVIT. State of Illinois, County of Pope, SS: In the matter of Thomas J. Duncan Claim as Guardian of Violet V. Duncan Claim No. 559248 Minor Child of John Duncan Co. B 31 Reg. Ills. Vol. personally appeared before me, a Justice of the Peace within and for the county and state aforesaid Robert S. Barger aged 42 years; and Mary E.S. Barger, aged 40 years; residents of Golando, County of Pope, said State of Illinois, well known to me to be reputable and entitled to credit, and who being duly sworn according to law, state in relation to the above named claim as follows: That we was personally well acquainted with John Duncan and his wife Frances J. Duncan and affiants State that they lived a Neighbor to the said John Duncan at the time of the Death of his wife Frances J. Duncan and that She died on or about the 20th day of February AD 1881. And that they know that Violet V. was the child of the said Frances J. Duncan for the reason that they had frequently seen this said Frances J. Dunken (sic) nurse the said child and call her, her child. We know the foregoing facts for the reason that we lived a Neighbor to the said John Duncan and his wife Francis J. Duncan. When the said Violet V. Duncan was a small child and at the time of the Death of the said wife of the said John Duncan Frances J. Duncan. The said affiant Robert S. Barger states that he was there whe said deceast Frances J. Duncan died and Mary E.S. Barger states she was there in after minets (sic) after the said Francis J. Duncan died and helped lay her out.       Affidavit of William B. Land: "GENERAL AFFIDAVIT. State of Illinois, County of Saline, SS: In the matter of Claim No. 559248, Guardian of Child of John Duncan Co. "B" 31st Regt. Ills. Vols. personally appeared before me a Notary Public within and for the county and state aforesaid, William B. Land aged 51 years; a resident of Mitchellsville, County of Saline, and State of Illinois, well known to me to be reputable and entitled to credit, and who being duly sworn according to law, states in relation to the above named claim as follows: That there is no other children living under the ages of 16 years at the death of John Duncan except Violet V. Duncan and to my certain knowledge. The above named child Violet V. Duncan is still living. Affiant further states that he has no interest in said case, and is not concerned in its prosecution. T.J.       Request from Commissioner for records: "(3-060.) H. West Div. M.V.A., Ex'r. Minor 559,248. John Duncan Pvt. Co. B, 31st Ill. Vols. Washington, D. C. Apl. 11, 1893. It is alleged that John Duncan enlisted Aug. 10, 1861 and served as a Pvt. in Co. B, 31st Reg't Ill. Inf. also as a _ in Co., _ Reg't._ and was discharged at _ on or about _,_,18_. It is also alleged that while on duty at _ on or about , 18 _, he was disabled by incurring chronic dirrhea and disease of lungs and was treated in hospital of which the names, locations, and dates of treatment are as follows: none eventioned. In cas of the above-named soldier the War Department is requested to furnish an official statement of the enrollment, discharge, and record of service so far as the same may be applicable to the foregoing allegation together with full medical history. Please give the rank he held at the time he is claimed to have incurred the disability alleged, and if records show that he was not in line of duty during that period, let the fact be stated. Vols was enrolled Aug. 10, 1861 and M. O. Sept. 18, 1864. From En., 186_, to M.O., 186_ he held the rank of Pvt. Corp, & Sgt. Corp. Nov 17/62. Sgt. Apr. 63 and during that period the rolls show him present except as follows: Feby. 28/62 in Saline County, Ill on sick furlough. Aug 31/63 absent in camp at Vicksburg Oct. 31/63 at home in Saline Co. Ill. on sick furlough. Other records furnish nothing additional bearing upon this case. The medical records show him treated as follows: As John Duncan, Sgt., Co. B, 31 Ill.       Affidavit of Thomas J. Duncan: "GENERAL AFFIDAVIT State of Illinois, County of Saline, SS. In the matter of Claim No. 559248 minor heir of John Duncan Co. B, 31st Regt Ills Vol. personally appeared before me a Circuit Clerk within and for the county and state aforesaid, Thomas J. SIR: In reply to your request I have to state that I think it was in the fall of 1865 that John Duncan 1st applied to me for treatment. I have no dates (my books being destroyed) my best recollection is he was suffering from disease of lungs and chronic diarrhea. I was personally acquainted with him often giving him medical advice something like 10 years ago he was confined to his bed several months. After his partial recovery he visited me quite often for something near a year after which time I did not see him as often until some few days prior to his death. The last few days prior to his death the last 10 years he was to do him justice he was totally disabled from manual labor.
