      Deposition of W.L. Dillard: "(3-446.) DEPOSITION C, Case of John Duncan, No. 365,307. On this twenty fourth day of November 1885 at Harrisburg, County of Saline, State of Illinois, before me, F.W. Lagenhoff, a Special Examiner of the Pension Office, personally appeared W.L. Dillard, who being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is fifty years of age, by occupation a farmer; post office address, Stone Fort, Saline Co., Ills. I enlisted Aug. 10, 1861, as a private in Co. B, 31st Ill. Vols.; was promoted to duty Sergeant in Sept. 1863; and commissioned as First Lieut. April, 1865. I became acquainted with John Duncan, claimant, in the fall of 1861, when he enlisted in our company. The appeared to be a sound man and able for duty. At Cairo, Ills., in November 1861 he had chronic diarrhea and was treated at hospital there, sent there every morning for treatment for several weeks. He had the mumps also. At Fort Henry, Tenn., in February, 1862, he was left behind in hospital, with chronic diarrheoa, and unable for duty. I don't remember when he was sent. I don't remember him any more until about September, 1862 at Jackson, Tenn. He had another attack of diarrhea there. He was in camp when I saw him affected; don't know whether he was treated in hospital there. In August, 1863, after capture of Vicksburg, he had another attacked chronic diarrhea and a spell some remedial fever. Got very sick there in a month with fever and chronic diarrhea. We left through ? there and were sent to Black River Bridge, Miss. I don't recollect whether Duncan was with us in unit; left on the march from Clifton, Tenn; to Huntersville (?), he was again troubled with chronic diarrhea, unable to march at time. I was wounded about that time and didn't know anything more about him until I came home in 1865. I don't remember of his having rheumatism in the service. I don't recollect ever having him complain of having received any injury to wrist or arm while in the service. I have heard him complain that since his discharge. I met him right after I came out of the service in 1865. I didn't know anything about his disabilities though until 1869, when I moved into his neighborhood. He then complained of rheumatism and chronic diarrhea. I saw him once or twice a month, and sometimes oftener since 1869. And in 1873 he threshed wheat for me, and had to get his machine on account of chronic diarrhea & rheumatism. That was my understanding at that time. He was complaining that much frequency since. My impression is that he has not be able. W.L. Dillard, Deponent.       Deposition of John J. Dunn: "(3-446.) DEPOSITION D, Case of John Duncan, No. 365,307. On this twenty third day of November 1885 at Harrisburg, County of Saline, State of Illinois, before me, F.W. Lagenhoff, a Special Examiner of the Pension Office, personally appeared John J. Dunn, who who being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is fifty five years of age; a farmer by occupation; post office address, Harrisburg, Saline Co., Ill. I enlisted in August, 1861, in Co. B, 31st Ills. Vols.; was promoted to sergeant; and received an honorary commission as Second Lieut. at the ? my service. I was mustered with claimant, and was well acquainted with him at the time of his enlistment His condition then was good. In February 1862, near Fort Henry, Tenn. he complained of diarrhea and rheumatism and I think I sent him to sick call a few times. He was treated by Dr. Lewis, a private of our company. I think he complained of rheumatism in his legs. He was left at Fort Henry, and came to us probably a month thereafter. He still complained of rheumatism and did light duty. About in September or August 1863, he had some wound a fever. (then called it break bone fever) and was treated by old Dr. McCook. He was furloughed for thirty days. He came back to us at Vicksburg, Miss. about Sept. 1863. He was complaining then of his wrist, which he said he had got hurt jumping off a boat or something like that. While coming back from furlough. He complained generally of rheumatism, diarrhea, and of his wrist until he was discharged. Since his discharge, I have lived near him, and worked with him some. I have seen him on an average once a month. His health has been punny. Complaining of pheumatism, diarrhea, and that trouble with his wrist. I am not related to him, and have no interest in his claim for pension. John J. Dunn, Deponent.       Deposition of John D. Choat: "(3-446.) DEPOSITION L. Case of John Duncan, No. 365,307. On this twenty fourth day of November, 1885, at Harrisburg, County of Saline, State of Illinois, before me F.W. Pagenhoff, a Special Examiner of the Pension Office, personally appeared John D. Choat who, being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is forty eight years of age; a farmer by occupation; post office address, Stone Fort, Saline Co., Ills. I served in Co. B, 31st Ill. Vols. from 1861 to 1865 as a private and corporal. I knew claimant John Duncan before his enlistment. He was in good health when he enlisted before as I know. I don't know much about his condition in the service. I can't recollect whether he complained of any disease in the service. Since his discharge he has lived within two or three miles of me nearly all the time, and I have worked with him at times. When I came home from the service I heard him complain of some disease of his back - rheumatism or something like that. He complained of the diarrhea too. He has complained of rheumatism and diarrhea quite often. I have been at his house and called for him, and he could hardly walk. He seemed to limp and walk crippled, and complained of rheumatism. I never heard him complain of his wrist or arm having been injured. In my opinion he has been able to do one one-third the work of an able-bodied man since 1865. I am not related to claimant and have no interest in his claim for pension. John D. Choat. .       Deposition of John N. Rolan: "(3-446.) DEPOSITION P. Case of John Duncan, No. 365,307. On this twenty fourth day of November, 1885, at Harrisburg, County of Saline, State of Illinois, before me F.W. Pagenhoff, a Special Examiner of the Pension Office, personally appeared John N. Rolan, who, being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is fifty-one years of age; a farmer by occupation; post office address is Mitchellsville, Saline Co., Ills. I have been personally and intimately acquainted with John Duncan, claimant for the last eleven years. I have met him often, visited him at his house, and have at mine. When I first met him his condition was pretty much what it is now. Most every time I met him he had some complaint very often. He complained of his bones and further whining. I suppost it was rheumatism; and I heard him complain of the diarrhea very often. I have heard him complain of his arm too; thou I don't recollect which arm. I don't know what is the matter with it. From what I have seen of him he has been disabled about one half. Anyway, I wouldn't have him as a half a hand if he was working for me. I have lived about two or two and a half miles from him in the last eleven years; and have been with him more or less all the while. I have no interest in his claim for pension. John N. Rolan. .       Statement of John Duncan: "(3-590.) CLAIMANT'S STATEMENT. Ex. 2. Case of John Duncan, No. 365,307. On this twenty- fifth day of November, 1885, at Shawneetown, County of Saline, State of Illinois, before me, F.W. Pagenhoff, a Special Examiner of the Pension Office, personally appeared John Duncan, the applicant in the aforesaid pension claim, who says: Q. If it should become necessary to further examine your claim, by taking the testimony of witnesses elsewhere, do you desire to be present or be represented by an attorney, or both, at such further examination? If so, you will be notified as to the place and time when it is to be made. A. No. Q. Should you change your mind and desire to be present, or be represented by an attorney during any further examination of your case, will you at once address a letter to the "Commissioner of Pensions, Washington, D.C.," giving the name and number of the claim, informing him that you have so changed your mind, and desire to be notified when your claim is to be further examined? A. yes. State the name of the person or persons and their post-office addresses, instrument in the prosecution of your claim for pension. A. James S. Finney, Golconda, Pope Co., Ills. is the only attorney I have had. Q. State what contract or contracts your have made with such person or persons for their services in prosecuting your claim for pension, whether such contract or contracts were written or verbal. A. I agreed verbally to pay him ten dollars if my claim was allowed. He hasn't done anything in my claim for four or five years. Q. State the amount of fees paid by you or at your instance, to whom paid, and all the circumstances connected with the transaction. A. I paid him $6.50. I just held a note against him; I don't remember how much. It turned the note over to him, and I am satisfied there was $6.50 due me on the note. Q. Please give me the names of all witnesses that you desire examined elsewhere, with the post-offices addresses, and also state what you expect to prove by each witness. A. have none. Q. Have you any complaint to make as to the conduct, manner, or fairness of the examination of your claim? If so, state specifically what it is. A. None. Q. Do you desire to introduce any more testimony before me? A. Dr. S.L. Cheaney, Harrisburg, Ills. John Duncan, claimant.       Medical Examination: "DUPLICATE FOR MEDICAL REFEREE. Insert character of Claim. Original PENSION (FOR A BOARD.) Claim No. 365307. Name of claimant John Duncan. Rank, Private Company, B. Regiment, 31 Ills. Vol. Inf. Claimant's post- office Stone Fort, Saline Co., Ill.} ADDRESS OF THE BOARD: Post Office, Shawneetown County, Gallatin State, Illinois Date of Examination Nov. 25, 1885. WE HEREBY CERTIFY that in compliance with the requirements of the law we have carefully examined this applicant, and find that he is now disabled to 1/2 degree for earning the subsistence by manual labor. His pulse-rate per minute is 92; his respiration 25; his temperature 98%; his height 5 feet and 10 inches; he weighs 124 pounds, and he states that he is 45. He makes the following statement upon which he bases his claim for Original Pension. That at Cairo, Ill. November 1861 for incurred chronic diarrhea. Had pain in stomach and bowels and being down in pain when at stool. Diarrhea has continued since that time. Attacks some on six times a year and last a week. At Fort Henry Tenn, February 10, 1862 he incurred a fever with swelled joints. Feces are first affected, then pain in loins supercurred. Was sent to Cairo and then home on parole. Now has pain in joints nearly all the time. Returned to Regiment after three months and did active duty till term of service expired. Incurred injury of wrist by falling on steamer May Duke. Upon examining this applicant we find the following objective conditions which, in our judgement, do entitle him to the rating given below: Tongue broad and furred. Liver slightly enlarged. Spleen normal. Stomach and bowels leuder and tyupastic. General ematiation very marhed. Mlisenlar tonisity very much below standard. There is a small Hemorhoid on right margin of arms, not tender, irritable etc. We find no physical evidence of rheumatism. Wrist is flattened and ulna subtracted at lower md. Heart normal. He says he can not substantiate this injury as witnesses are dead. Positions and supination of hand limited. Styloid process of ulna very prominent. From the existing condition and the history of this claimant, as stated by himself, it is, in our judgement, _ probable that the disability was incurred in the service as he claims, and that it has not be prolonged by aggravated by vicious habits. He is, in our opinion, entitled to 4/8 rating for the disability caused by chronic diarrhea, oo for that caused by rheumatism, and 2/8 caused by injury to wrist, the sum of which aggregates to 6/8 of total.       Deposition of Dr. David Bozarth, M.D.: "(3-446.) DEPOSITION L. Case of John Duncan, No. 365,307. On this twenty seventh day of November, 1885, at Harrisburg, County of Saline, State of Illinois, before me F.W. Pagenhoff, a Special Examiner of the Pension Office, personally appeared David Bozarth, M.D. who, being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is forty six years of age, a practicing physician; post office address, Stone Fort, Saline Co. Ill. I have been in the practice of medicine thirty years. I have known John Duncan for twenty four years; but did not become intimately acquainted with him until ten or twelve years ago. I don't remember anything about his physical condition previous to the year 1882. I might have subscribed for him previous that year; but I don't remember. About 1882, I called on to treat him. He had pneumonia then; and recovered slowly. After that it seemed his spleen was affected. Abdominal (?) inflammation and fever. He had rheumatism at that time, affecting his back and the muscles of his breast; and I treated him for that up to about June of the same year. I have given him several prescriptions for rheumatism since that time; but don't remember the dates. I have a fair recollection of treating him for chronic diarrhea tensions at the time of treated him for pneumonia, but was only a faint recollection; and I am not positive about it. I don't remember treating him for diarrhea since treating him for pneumonia. He has not been able to do manual labor over one- fourth at least since he has been under my medical care. He has been in very poor health due probably to rheumatism. I have that on the shrinkage of his muscles more than on anything else. I am not related to him; and have no interest in his claim. (Appant ? July 3, 1883 (Ex.vvy being shown to him, he states:) I presume there were other symptoms ? than rheumatism. I am since I treated him for chronic diarrhea. Since I treated him for pneumatism. It seems to me I treated him for rheumatism, but I was not sure. My recollection since is that my last treatment of him was for rheumatism. Evidence thu six or seven months. I don't know whether he is afficted with chronic diarrhea at present. David Bozarth, Deponent. Sworn to and subscribed before me this 27th day of November 1885, and I certify that the contents were fully made know to deponent before signing. F.W. Pagenhoff, Special Examiner."
      Undated Affidavit of David Bozarth: "PHYSICIAN'S AFFIDAVIT. TAKE NOTICE. - The affidavit should, if possible, be in the handwriting of the affiant; the marginal instructions must be carefully observed before writing out the statement. All the facts in possession of affiant as to the origin and continuance of the disability should be fully set forth, and the dates of treatment should be specifically given. If the affidavit is prepared from memoranda in possession of the physician, that fact should be noted. State of Illinois, County of Williamson, SS: In the Pension Claim No. 315,998 of John Duncan of _ (Company and regiment of service, if the army; or vessel and rank in the navy.) Personally came before me, a police magistrat in anf for the aforesaid County and State David Bozarth a citizen of Pope County whose Post Office address is Stonefort Saline County Ills. well known to me to be reputable and entitled to credit, and who, being fully sworn, declares in relation to aforesaid case as follows: That he is a Practicing Physician, and that he has been acquainted with said soldier for about 20 years, and that I remember of Claimant consulting me soon after his return home from the U. S. Service, but do not remember enough to definitely state the symptoms. I have a record of treating him as follows for Disease of Chronic inflamation of the lungs, but had assumed an accute form according to my memoranda Dec. 20th & 21st 23-24 = 27 and Jan 17th 1882. After which I gave him medical advise (sic). Occasinally (sic) until about 4 years ago when he moved from my neighborhood during the time of my Professional Acquaintance I would say to do him justice he was not able to perform manual labor at all."
      Deposition of Dr. S.L. Cheaney: "(3-446.) DEPOSITION. Case of John Duncan, No. 365,307. On this twenty eighth day of November, 1885, at Harrisburg, County of Saline, State of Illinois, before me F.W. Pagenhoff, a Special Examiner of the Pension Office, personally appeared S.L. Cheaney, M.D., who, being by me first duly sworn to answer truly all interregatories propounded to him during this Special Examination of aforesaid pension claim, deposes and says: that he is fifty yearsof age, a physician by profession; post office address, Harrisburg, Saline Co., Ills. I have been in the practice of medicine about 28 years and was Surgeon of the 29th Ill. Vols; in the late war. I have treated John Duncan, claimant, since 1868 and was his father's family physician before the war. I often saw the claimant before the war; even not called upon to treat him before his enlistment So far as I remember now - If I did treat him it was for some slight thing. I saw him frequently during his service, as we were brigaded together; but I never treated him. I know nothing as to his physical condition while in the service. I treated him in 1867. He applied to me for treatment of pain in his breast, which I diagnosed as intercostal rheumatism. I cannot be certain about the year I first treated him. I think it near in 1867 or 1868. I can't say positively that he was affected with anything else at that time. It strikes me that he complained of diarrhea, which he said had followed him during the war; but I did not treat him for that. I made prescriptions for him for rheumatism after that, from time to time, down the years 1870 to 1872. If I treated him for anything else during that year period, I don't remember it now. I remember that I treated him for something else, at one time, too, but don't remember what it was; believe it was for a cough, or something like that. I can't state how frequent his attacks of rheumatism were. I think I remembered from his soundless for that every year for the time mentioned. According to my best judgement he hasn't been in perfect health at anytime since his discharge. Meet him when your would, he was complaining of something. My impression is that my diagnoses of intercoastal rheumatism in war based upon the fact that he was afflicted with rheumatism in other places, joint, etc. I suppose one half would be a fair estimate of his disability for manual labor during this period of my treatment of him. I am not related to claimant, and have no interest in his claim for pension. S.L. Cheaney, M.D. Deponent. Sworn to and subscribed before me this 28th day of November 1885, and I certify that the contents were fully made known to deponent before signing. F.W. Pagenhoff, Special Examiner."
      Letter of F.W. Lagenhoff: "Harrisburg, Saline Co., Ills., November 30th 1885, Hon. John C. Black, Commissioner of Pension, Washington, D. C. Sir: Herewith I have the honor to return the paper in Original Invalid Pension Claim (No. 365,307) of John Duncan late a private of Co. B, 31st Ills. Vols. with testimony taken by me in the Special examination of said claim and my report thereon. Claimant's present post-office address is Golconda, Pope Co., Ills. The claim is made in chronic diarrheoa, rheumatism, and injury to right arm. Alleged to have been contacted and received while in the service and line of duty. Declaration filed May 14, 1880. Paper filed in Special Examination on February 26, 1880 for special examination to determine origin of disability since discharge. Claimant was duly informed of time and place of examination. He was present in person at the examination of all the witnesses except that of Dr. S.L. Cheaney and Dr. David Bozarth, whose testimony was subsequently read to him. Special medical examination in board of Ex. Surgeon at Shawneetown, Ills. rates claimant disability for rheumatic diarrhea at 4/8 and from injury to wrist at 2/8. Certificate of Board is filed with the paper in the Drawer - Although the Board found no physical evidence of rheumatism. I am of the opinion that the testimony is sufficient to establish origin of said disease in service and continuous since discharge. The claimant experiences his inability to furnish evidence of origin of injury to right wrist in the service and line of duty. He states that there are no persons living who were present when the injury was received. From the testimony before me, I am of the opinion that the claim for rheumatism and chronic rheumatic diarrhea is virtuous, and I recommend its admission. Very Respectively, F.W. Lagenhoff, Special Exr."

      Affidavit of John Duncan: "State of Illinois, County of Saline} SS. On this 6th day of September A.D. one thousand and Eighty six personally appeared before me, a Clerk of the County Court, the same being a Court of Record, for the County and State aforesaid John Duncan aged 45 years. A resident of the County of Saline and State of Illinois, who being duly sworn according to law, declares that he is a pensioner of the United States, duly enrolled at the the (sic) Chicago Pension Agency at the rate of Eight - Dollars per month, by reason of disability incurred in the Military Service of the United States while a sergeant in Co. B 31st Ills Infty. Vol. That his present physical condition is such that he believes himself entitled to receive an increased Pension. Further he declares he is disabled in the following manner to wit. Chronic Diarrhea and Rheumatism. His Post-Office address Colorado, Pope County, Illinois. Will attend to the business himself. John Duncan. Attest L.F. Pickering, W. W. Largent. Also personally appeared L.F. Pickering and W.W. Largent both residing at Harrisburg, Saline Co., Ills. persons whom I know to be respectable, and entitled to credit and who being by me duly sworn, say that they were present and saw John Duncan the claimant sign his name to the foregoing declaration. That they have every reason to believe from the appearance of said claimant and their acquaintance with him, that he is the identical person he represents himself to be and that they have no interest in the prosecution of this claim. Cheaney, Pres. N.S. Hudson, Sec'y, J.C. Mathews, Tres.} BOARD. Post Office, Harrisburg. County, Saline. State, Ill. (3-111.) Attention is invited to the outlines of the human skeleton and figure upon the back of this certificate, and they should be used whenever it is possible to indicate precisely the location of a disease or injury, the entrance and exit of a missile, an amputation, etc. The absence of a member from a session of a board and the reason therefor, if known, and the name of the absentee, must be indorsed upon each certificate. My bowels act not less than six to eight times every 24 hours even when I take astimgents or something to check them. The Rheumatism is affects the joints mostly especially left hip joint is worse then the other. Can't sleep on left side at all. Upon examination we find the following objective conditions: Assurance shows a depraved condition of nutrician with weakened vital power. Tongue pale pointed with a fur in custer. Muscullar system exacuted. Skin, lungs, heart normal. Stomach and bowels flat & elastaty in appearance. There is marked andinnep on salautiver over stomach and bowels. No congestion of mucous membrane of rectum, or the hermorrhoidal vessels. Joints display no evidence of Structured lesion. Except the left hip joint, which is ? swollen, and very tender on pressure. Nothing abnormal with tendon. He contractions in duration. From the existing condition and the history of this claimant, as stated by himself, it is, in our judgement, _ probable that the disability was incurred in the service as he claims, and that it has not been prolonged or aggravated by vicious habits. Has suffered from Dis. of lungs, & Rheumatism this Winter to an Extent that disables him from any manual labor, whatsoever. Upon examination we find the following objective conditions. This applicant us very thin and anemic. Tongue very pale, greatly exaited. Muscles flabby & soft. Skin of a tawny unhealthy tone. Abdomen flat & slightly tympanitre (?) over descording colon. Tenderness of epigastrian. Upon examination of rectum, we note the vessels turgid micelles membrane purblished & fissured bleeding freely upon slight manipulation his turdors disevend. His joints are not swolen (sic) at this time, but they are large and boney & he lives a fit subject for rheumatic attacks. His heart is very much enfeebled, the sound bring almost inaudible. Examination revels normally shaped chest. Rates stooped, but up on ausculation we fixed the respiratory ?. Never diminished & the vocal resonance greatly. From the existing condition and the history of this claimant, as stated by himself, it is, in our judgement, _ probable that the disability was incurred in the service as he claims, and that it has not been prolonged or aggravated by vicious habits. That he is a Practicing Physician, and that he has been acquainted with said soldier for about 25 years, and that he was called to see him professionally Feb. 5th 1865, found him suffering from double Pneumonia for which I treated him. Said treatment lasted about two weeks. The case had a typhoid tendency. Some two or three years after I remember advising him for some chest trouble, but did not treat the same so can give no dates. Think he was about him for about one year after the case of fever mentioned. Then moved to Saline County, Illinois. He further declares that he has been a practitioner of medicine for 25 years, and that he has no interest, either direct or indirect, in the prosecution of this claim. June 5th 1890 John R.       Affidavit of Daniel Farmer: "State of Illinois, County of Saline} SS. In the Claim for Increase & Additional Pension of John Duncan. Late Sgt - Co. "B" 31st Ills. Inf. Vol. Certificate No. 315.998. Personally came before me a County Clerk within & for the State & County aforesaid Daniel Farmer aged _ years & well known to me to be a credible witness, a citizen of Raleigh, County of Saline & State of Illinois, & whose P.O. address is Raleigh, Saline Co., Ills. Who after being duly sworn according to law, under his oath makes the following statement in reference to the Claim aforesaid. To wit. Affiant has known John Duncan since the year 1861 & served in same company and regiment from Aug 1861 to Sept 1864. Affiant remembered that claimant was sick while at Ft. Donaldson (sic) with a cold & cough. About the middle of February 1862, & that he heard Claimant complaining of his lungs and breast from time to time during the three years of service. Further that claimant & he came out service at the same time & that the foregoing facts are known to him from having had to assist him along on marches by Carrying his ? or knap sack when Claimant was unable to get along and carry them. Affiant further declares that he has seen said Duncan frequently since the war & has conversed with him about his health, & knows he (Claimant) has told him from time to time up to present date that he still suffered with his lungs and also from Rheumatism. He further declares he has no interest in the successful prosecution of this claim, whatever & is in no way related to claimant. Daniel Farmer. Personally appeared before me a Notary Public one John Duncan well known to me and after being duly sworn disposes and says in Pension Claim of himself No. 315,998 that said disease of right lung was contracted on or about February the 7th 1862 from exposure in lake taken Ft.
