      ABC-74: No.80. Francis Surgett, Wm. B. Duncan and John Kerr to Stephen Duncan, Deed. 26 Dec. 1835, John Kerr and Francis Surgett of Adams Co. MS and William B. Duncan of Territory of Arkansas, to Stephen Duncan of City of Natchez, MS, the above parties have been jointly concerned in the purchase of lands in the Territory of Arkansas and as an equitable division of the lands purchased as above, a certain tract purchased by said company in the name of William B. Duncan, Stephen Duncan, Francis Surgett and John Kerr has been allowed and apportioned by common consent to Stephen Duncan and John Kerr to be equally divided between them ... in Monroe Co. Territory afsd, at a place usually known and designated as the lower Surrounded Hill, containing by survey 2,000 arpents equal to about 1701 acres and 56/100 of an acre, more or less, being the grant of land by the US in the name of John B. Deplace but not yet patented in consequence of the adjoining public lands being as yet unsurveyed, which tract of land was purchased of George W. Ferebee per deed 11 Dec. 1835 and purchased by said Ferebee of William Russell per William Russell's deed 4 May 1835 now on record in Monroe Co. in Record Book A, pg.91 and 92; now the said John Kerr, Francis Surgett and William B. Duncan transfer to said Stephen Duncan their right etc. to one equitable undivided half of said tract of land, and execute any further transfer, assignment or deed which may become necessary after said land shall be patented ... /s/ F. Surgett, John Kerr, Wm. B. Duncan. Wit. Sam. H. Lambdsie, Alfred Cochran. The grantors appeared in Adams Co. MS 26 Dec. 1835 before James Carson, J.P. Certified in Adams Co. MS 26 Sept. 1835, recorded in Monroe Co. AR Feb. 6, 1837.

AR: Fractional Sec. 24, Twp.1N Range 4E, containing 553 acres and 18/100. The following tracts in Twp.2S Range 3E, the SW 1/4 Sec.11 containing 160 acres, the E 1/2 Sec.11 containing 320 acres, the SE 1/4 Sec.10 containing 160 acres, the whole of Sec.14 containing 640 acres, and the SE 1/4 Sec.15 containing 160 acres. Also tracts in Twp.3S Range 1E, the E 1/2 Sec.28 containing 320 acres, the E 1/2 NW 1/4 Sec.21 and W 1/2 of NE 1/4 of Sec.21 containing together 160 acres, the E 1/2 of NW 1/4 Sec.33 and W 1/2 NE 1/4 Sec.33 containing together 160 acres, which lands were entered at Land Office at Helena in the name of Wm. B. Duncan and have been regularly transferred to said Wm. B. Duncan by Stephen Duncan, John Kerr and Francis Surget, the partners composing said company, and I, Wm. B. Tapp the W 1/2 Sec.24 Twp.2S Range 1E containing 320 acres for $1,000, $500 paid and a note for $500 due 1 Nov. next, 1837. Now Willis Duncan to make a good quit claim deed to NW 1/4 Sec.24 Twp.2S 1E, donated by Arkansas to Abraham Duncan 29 Jan. 1851, whose legal surviving heir I am, and also the SW 1/4 Sec.24 Twp.2S 1E, donated to William J. Duncan whose legal representative I am, 29 Jan. 1851, containing jointly 320 acres more or less, embraced in the ..
