James CRANFORD Estate Papers Pt 2

In Motion P.C. SANDERS, a Justice of the Peace, and George COGGINS, Eli DAVIS & James DAVIS free holders are appointed Commissioners to view the estate of James CRANFORD deceased and to allot & set a part to his widow Ruthe CRANFORD so much of the crops, stock & provisions belonging thereto or near, be adequate to the support of herself and family for one year & if these be not enough on hand to afford such Allowance there to assess the deficenceny as money.  Said Commissioners are to report to this next Term of this Court under their hands & seals.~

In motion it is ordered by the Court that a writ be issued to the Sheriff of Montgomery County commanding him to summon a Jury of five free holding to allot to the Petitioner her dower of her deceased husband the land described in the Petition according to the act of General Assembly in such case made & provided-

Whereas D.C. MCAULAY Sheriff of said County hath filed a petition at the present Term to sell  certain Lands for the taxes amery which is a tract listed by James CRANFORD Decd containing 225 acres on Barnes Creek.

The Tax due on said Land amounts to (1) Dollars - cents The Sheriff of Montgomery County you are hereby commanded to make known to the said CRANFORD or agent that unless hr hr and appear on or before the first Monday in July next and Settle said Tac therein will be an order granted to sell said land for the tax & costs due therein.  Witness C.C. J.A.H. SANDERS Shff of said County attended the following July of good and lawful men.  I.M. MULLINX, Eli DAVIS, James DAVIS, Joseph HURLEY and Joseph HAMILTON who after being sworn according to law proceeded on the 15th day of Decr 1862 in ???? to the annex trust to lay off and allot to Ruth CRANFORD her dower and thirds of the lands of (word "her" crossed out) Jas CRANFORD deceased as described in said writ according to the following notes and bounds as follows

Beginning at a white oak in Danl HAGAN old line run Wt 80 poles to a small mountain oak dogwood & white oak pointers then SO 120 poles to a stak in the old line hen Et 65 poles to a black oak on the side of MW ROACH thence north agreed t?ne to the Beginning containing fifty acres and part hir in possession of the sam & all of which respectfully report given under our hands & seal.

To the Sheriff of Montgomery County greeting:

Whereas Ruth CRANFORD widow of James CRANFORD lately filed her petition in our court of Pleas and Quarter Sessions against - HARDISTER & wife Elmeachor - HULIN & wife Eliza - BEAMAN & wife Malinda, BEAMAN & wife Mary & W.W. CRANFORD heirs at law of her said husband and it was ordered by the court that a writ of dower should be issued to the sheriff in her behalf as to the following lands ten acres ??? and here detaments in said County of which her said husband died seized & possessed to writ: About two hundred acres adjoining the lands of Thomas J. BRIGHT, Richard CRANFORD & others.  These and therefore to command you to summon five free holders connected the Rurtr neither by consanqunity nor affinity and entirely disinterested who after being sworn by you an to allot and set off to the said Ruth CRANFORD by  proper notes and bonds one third of all the said lands turnments and heridetaments including therein the dwelling house and all offices - out houses buildings and improvements therewith belonging or in any way appurtaining during the term of her natural life and to writ her in possession of the same - and the allotment of dower made by the said Jury after being ordered unto writing and signed by them, You are to return to our next court of Pleas & Quarter Sessions to be held for the county of Montgomery at the court held in Troy on the 1st Monday in January next together with this writ -  Witness J.J. SPENCER clerk of said Court at office in Troy the 1st Monday of October A.D. 1862
