Frederick HINSON 1853 Will Transcribed

In the name of God Amen.  I Frederick HINSON of the county of Stanly in the State of North Carolina, being of sound and perfect mind and memory (blessed be God) do this twenty ninth day of September in the year of our lord Eighteen hundred fifty three, make and publish this my last will and testament, in manner following that is to say.

First I give and bequeath unto my beloved wife, Nancy HINSON for and during her natural lifetime or widowhood, all of the plantation whereon I now live, containing three hundred acres of land, with appurtenances thereunto belonging or in any wise appertaining and also all of my other property money & notes of every kind and description which is not herein after particularly disposed of otherways by me.  I also will & bequeath unto my beloved wife Nancy HINSON a certain tract of land five acres lying on the waters of Bear Creek adjoining the lands of Martin HINSON, Jacob COBLE, and John POPLIN to have and to hold as her own property with full power to sell and make a good title whenever she wishes to dispose of it.

Secondly I give unto my daughter Rhody HINSON one bed, bedstead and furniture, one red chest, and one table.

Thirdly I give unto my daughter Elizabeth HINSON, one bed, bedstead and furniture and one red chest.

Fourthly I give unto my daughter Lucy HINSON one bed, bedstead and furniture also one chest.

Fifthly I also will that after the decease or marriage of my wife, that my three daughters who are now at home with me, namely Rhoda HINSON, Elizabeth & Lucy HINSON, shall have all the plantation with the appurtenances thereunto belonging, whereon I now live containing three hundred acres of land to share and share alike or equal in it, provided that they stay with me and their mother as long as either or both of us shall live, and take care of us in health and sickness.

Sixthly I also will that after the decease of my wife or her marriage that my three daughters namely Rhoda HINSON, Elizabeth HINSON and Lucy HINSON shall have my wheat thresher with all that belongs to it, my two corner cupboards and my house clock, provided they stay with me and their mother as long as both or either of us lives and takes care of us in sickness and in health.

Seventhly I will that after the decease of my wife all of my personal property that remains and is not particularly disposed of in this will shall be sold at public sale on a reasonable credit by my executors (hereinafter to be appointed and the proceeds to be equally divided among all my heirs at law to share equally in the whole amount namely Samuel HINSON, William HINSON, Jordan HINSON, Rhoda HINSON, Jeremiah HINSON, Elizabeth HINSON, Mary POPLIN, Lucy HINSON, Sarah CURLEE, Martin HINSON, and Doctor Isaiah HINSON.

And I hereby make and ordain my worthy sons Samuel HINSON and Jeremiah HINSON Executors of this my last will and testament.

In Witness whereof I the said Frederick HINSON, have to this my last will and testament set my hand and seal.  The day and year above written.

Signed sealed published & declared by the said Frederick HINSON as his last will and testament in the presence of us who are present at the time of signing & sealing thereof}   Frederick (his H mark) HINSON {Seal}

The foregoing last will & testament of Frederick HINSON was produced in open court & offered for probate and the execution thereof proved on the oaths of Alexander M LESTER & Martin REAP the subscribing witnesses thereto whereupon it is ordered by the court that said Will be recorded & filed and Samuel HINSON & Jere HINSON the Executors therein  named came into open court & took upon themselves the burden of executing said will and letters testamentary issued to them.
