descendants of Creek Indians are entitled to share in this fund. This idea was spread in certain sections of the south by some attorneys and claim agents, who were themselves under the impression that Eastern Creeks are entitled to share in this fund. Powers of attorneys have been received by the Special Commissioner, which provide for the payment to attorneys of a certain per cent of any money recovered from these claims of "The Eastern and Emigrant Creeks." There is absolutely no connection between any of these claimants and the Eastern Cherokees and no such connection is claimed by them. They never lived within the Cherokee domain. They were filed under the erroneous opinion that this fund was for Eastern and Emigrant Creeks instead of Cherokees. These cases have all been grouped together and for convenience marked "Creek file." As they are not in any way connected or related to the Eastern Cherokees, and as most of them do not even claim to be so connected and related, of course none of them were ever enrolled with the Eastern Cherokees, nor were any of their ancestors parties to the treaties of 1835-6 and 1846. For particulars see "Creek Testimony" pp 1-12, taken Feb., 1908. For the reason above stated, all of these cases (in what is marked the "Creek file) are rejected.

CREEK TEST. P. 1, 2, &3. Capt. Dixon Bailey Reed: Continuing, D. B. Reed, deponent above, further states "that the massacre at Fort Mims took place in 1813. My uncle, Dixon Bailey, commanded the white forces against the band of Creeks commanded by Billy Weatherford. My grandmother, Peggy Bailey, was out of the fort at the time, picking blackberries, and learning that the Indians were coming, she found 30 or 40 women across the River from the Fort without protection. She swam the River, got a flat boat and took it across, and the women got upon SIGNED: D. B. Reed, Feb 4, 1908, Pensacola, Fla.

She was born at Gainesville, Miss. Her mother was an Indian squaw. Before her marriage her name was Mayo. My mother was born in 1818 in Mississippi. My grandmother was a full blooded Choctaw. Mrs. Richard Touart is my full sister. Mrs. Isaac Shields, #17905, is a sister of Richard Touart. I know Victoria Shanks, #17903. She is a first cousin of mine. SIGNED: Mary E.
