Last Will and Testament of Charles Inslee
LAST WILL AND TESTAMENT
OF
CHARLES R. INSLEE
    I, Charles R. Inslee of Sharon, Barber County, Kansas, being of sound mind, memory and understanding, do hereby make, publish and declare this my Last Will and Testament and by this instrument revoke any and all former Wills by me made.
     FIRST:  I direct that my executors, hereinafter named, pay all of my just debts Including funeral expenses and the expenses of my last sickness.
     SECOND:  I will and bequeath to my daughter, Bertha Inslee Rucker, all of the personal property I have after payment of my debts, specific bequests and costs of administration and any other expenses chargeable against me.
     THIRD:  I specifically devise to my grand-daughter, Diana Lu Rucker, the following described real property:
      All of Block Fourteen (14) in
      the original town of Sharon,
      Barber County, Kansas,
to be hers absolutely and in fee simple.
     FOURTH:  I will and devise to my daughter, Bertha Inslee Rucker and her husband, Clarence Rucker, or the survivor of them, the following described real property in Barber County, Kansas, to-wit:
      The S/2 of the S/4 of Section 17,
      the NW/4 and the W/2 of the NE/4 and
      the SE/4 of the NE/4 of Section 20
      all in Township 31 South, Range 10
      West in Barber County, Kansas,
for the term of their natural lives, this meaning the natural life of both of them or of the survivor and on the death of the survivor of them, said property to vest in my grand-son Daryl Gene Rucker, absolutely and in fee simple.
     In connection with the life estates vested in my daughter and her husband I direct that they shall have full power and authority to lease for agricultural purposes and to lease oil and/or gas the real estate in which they are vested with a life estate and to make such lease of leases upon such terms and conditions and for such periods of time as they may deem advisable without restriction or limitation although such periods of time may continue or extend beyond duration of said life estates and such lease or leases may be made by said life tenants without the intervention of any Court and without being required to obtain  Court approval, and without the signatures of any remaindermen, the same as if I were alive and had signed the same myself.
     The property is presently producing oil and/or gas and the life tenants shall have and receive the production of either oil or gas or the proceeds therefrom during the term of their natural life or lives, the same as if they owned said land in fee simple, and all bonuses or rentals paid for oil and/or gas leases shall be paid directly to them, or the survivor of them, as life tenants.
     FIFTH:  I specifically devise to my grand-son, Charles M. Inslee, the following described real property to-wit:
      The W/2 of Lots 8 and 9 of the NE/4
      and Lot 7 of the NE/4 in Section 4,
      Township 39, Range 25 in St. Clair
      County, Missouri,
to be his absolutely and in fee simple.
     In the event I have disposed of this property during my lifetime, then I specifically bequeath to my grand-son, Charles M. Inslee, a sum of money equivalent to the amount I receive from the sale of said property.
     SIXTH:  I specifically bequeath to my son, Clifford Dale Inslee, the sum of one dollar ($1.00).
     SEVENTH:  I specifically devise to my grand-son, Merle Dean Rucker, the following descried real property to-wit:
      Lots 5-18 inclusive in Block 21
      in the original town of Sharon,
      Barber County, Kansas
to be his absolutely and in fee simple.
     EIGHTH:  I hereby designate and appoint my daughter, Bertha Inslee Rucker and her husband, Clarence Rucker, as co-executors of this my Last Will and Testament or in the event one of the does not qualify or does not survive me, then I appoint the other and I direct that they serve without bond.
     NINTH:  If any of my heirs shall in any manner, directly of indirectly, contest the validity of this Will or any part thereof, then and in that event, any bequest, legacy or devise I have made herein made in favor of such person or persons shall be void and of no effect and all such bequests, legacies, and devises shall be and are hereby bequeathed and devised to my daughter, Bertha Inslee Rucker.
     IN TESTIMONY WHEREOF, I have hereunto set my hand to this my Last Will and Testament at Medicine Lodge, Kansas, this 9th day of February, 1966.

 WE, the undersigned, do hereby state that the foregoing instrument was at the time and place therein stated, signed declared and published by CHARLES R. INSLEE of Sharon, Kansas, as his Last Will and Testament; that he signed the same in the presence of us, and we subscribed our names therein as witnesses at his request and in his presence and in the presence of each other on the day and year last written.
