WILL of John HART

Henderson Co., KY 1821

(John Hart was the husband to Patience Lane, daughter of Jesse Lane & Winifred Aycock)

In the name of God Amen. I John Hart of the County of Henderson and state of Kentucky do ordain this my last Will and Testament revoking all others.

Item the 1st I give to my wife Patience Hart the following negroes Prince, Signal, Ben, Squire & Lucy which is to be intirely at her disposal during her life time. Which property after her death shall be disposed of the following manner. Lucy and her increas to be equally divided between Rhoda Hart and Polly Hart. Ben and Squire to be equally divided between Thomas Hart and John Hart.

Item 2. I give to my son Thomas Hart a negro Boy named Martin.

Item 3. I give to my son John Hart a negro boy named Hayden and a Bed and furniture.

Item 4. I give to my daughter Rebecca Hart a negro Girl named Harriet with a Bed and furniture.

Item 5. I give to my daughter {Rody (?)} Hart a negro Girl named Hannah with a Bed and furniture with a good Saddle.

Item 6. I give to my daughter Polly Hart a negro Girl nameed Melinda with a Bed and furniture and good Saddle.

Item 7. I give to my daughter Susanna Floyd one negro Girl named Eliza a Bed and furniture and Saddle which is already in her possession.

Item 8. I give to my two Grandsons John H. Standley and Nathaniel G. Standley two negroes named Bartlett and Aggy which negroes I purchased with their money and is to be taken in place of said money when they arrive of full age.

Item 9. I give to my daughter Nancy Jordon a negro Boy Shelby in addition to what I have already given her.

Item 10th. I give to my daughter Kiziah Sugg a negro Boy named Prince Edward on her paying to Lucy Standley a balance due from me to her of about Thirty Dollars.

Item 11th. I desire all my stock of every kind with the plantation Tools Kitchen furniture with the plantation to remain in possession of my wife Patience Hart her life time then is to be entirelly at her disposal.

Item12th. After the death of my wife Patience Hart I desire my land to be divided in the following manner. To run a line from the creek through the center of the land and Thomas Hart to have the South end and John J. Hart the other half.

Item 13th. I give all I own and intrest to a Legacy which is coming to me after the death of my brother Lemuel Hart to my two sons Thomas Hart and John Hart and their heirs.

Item14th. I do hereby appoint my two sons Thomas Hart and John J. Hart my Executors to this my last Will and Testament. In witness whereof I have set my hand and seal the 29th day of June 1821.

Item15th. Since signing of this will I have determined the negro boy Shelby willed to Nancy Jordon Shall be for her own proper use her lifetime and after her death to her children and to on be in any manner under the controle of her husband or to be taken in any way to pay his debts as witness my hand and seal this 16th day of October 1821.

The last will and Testament of John Hart decd was exhibited in Court and being proven as the manner is by the Oath of Edmund Talbott and John Miller subscribing witness thereto to be the Last Will and Testament of the said deceased and ordered to be recorded.
