Last Will and Testament of Job Armstead
1897

I, Job Armstead, of Tecumseh, Johnson County, Nebraska, being of sound mind and memory and being conscious of the uncertainty of life and the certainty of death, do hereby make publish and declare my last will and Testament in the words and figures following:-

First: It is my will that all my just debts, expenses incurred during my last sickness and funeral expenses, be first paid out of any money that I may have or that may be due me at the time of my death, and in case there be no money the same to be paid out of the personal and real property which I may own at that time.

Second: I give and devise unto my wife Rachel Armstead, and I bequeath unto her all of my estate both real and personal left after the payment of the debts and expenses mentioned above, and the costs of the administration of my estate, the same to be hers for and during her natural life only, the same to be in lieu of dower.

Third: I give and bequeath and devise unto my two daughters Rebecca Armstead and Susan Armstead share and share alike to each of them an undivided half of lot Three (3) in Block Fourteen (140 in Kershaws second addition to Tecumseh, Johnson County, Nebraska. I give and bequeath to said last named two daughters share and share alike all my household goods and furniture of every description (except my organ which I bequeath to said Susan Armstead) and all wearing apparel and my horse Julie, and my carriage and harness. I also give and bequeath unto my said two Daughters Rebecca Armstead and Susan Armstead the sum of $800.00 to be said amount paid to each of them, and to be paid out of any money that may belong to my estate remaining after the death of my wife Rachel Armstead, in case there should be less than $1600.00 belonging to my said estate after the death of my said wife, then in that case said last two named daughters to each have one half of such sum as was left at the time of the death of my said wife belonging to my estate at that time. The above real and personal property to be the property of said two named daughters after the death of my said wife above named and not before, and in case of the death of either of said named daughters without children then the above named property belonging to her to go to the daughter named above who survives the other.

Fourth: I give and bequeath unto my daughter Mrs. Catherine Waterworth the sum of $200.00 to be paid to her out of my estate after the preceeding conditions of this will are complied with, said sum to be paid her within one year after the death of my said wife herein named, said sum to be hers after the death of my said wife and not before.

Fifth. I give and devise unto my son Horatio Armstead the South East quarter of Section Thirty Three (33) Township Five (5) Range Twelve (12) East of the Sixth Principal Meridian in Johnson County, Nebraska, the same to be his after the death of my said wife Rachel Armstead, and after he pays the amounts bequeathed herein to my daughter Mrs. Catherine Waterworth of $200.00 heretofore mentioned, and the sum of $1000.00 to Alexander Armstead and the sum of $1000.00 to William Armstead as hereinafter proveded as to each of them.

Sixth. I give and bequeath unto my son Alexander Armstead the sum of $1000.00 to be paid to him after the death of my said wife Rachel Armstead within two years after her said death, to be paid by my son Horatio Armstead out of my real property, said sum to be paid without interest, said amount to be his after the death of my said wife above named and not before.

Seventh. I give and bequeath unto my son William Armstead the sum of $1000.00 to be paid to him to be paid by my son Horatio Armstead out of my real property named herein within two years after the death of my said wife named above without interest, said sum to be his after the death of my said wife and not before.

Eighth. It being my intention to devise and bequeath all of my said property both real and personal as herein stated the same to be devised and bequeathed to my wife Rachel Armstead during her natural life, and after her death to be divided as fully herein set forth.

Ninth. In case of the death of either of my sons heretofore named without children, then in that case their portion herein willed to such son or sons to go to the sons and daughters of mine herein before named who are living at that time, share and share alike.

Tenth. The conditions on which the farm heretofore described and which is herein devised to Horatio Armstead, is that he pay out of the proceeds of such farm, or out of money he may have of his own to Mrs. Cathering Waterworth, Alexander Armstead and William Armstead the amounts hereintofore directed for him to pay them, said farm herein described being the real property refered to for him to pay them out of within the time mentioned heretofore.

Eleventh. I hereby nominate and appoint my said wife Rachel Armstead and my said son Horatio Armstead to be executrix and executor of this my last will and testament and authorize them or either of them to sell or dispose of so much of my farm herein described to pay the bequests to Mrs. Catherine Waterworth, Alexander Armstead and William Armstead and the debts and expenses herein before mentioned in case there is not sufficient money to pay same after my daughters Rebecca and Susan have been paid $800.00 each as mentioned heretofore, it being my intent for such debts and expenses to be paid out of money that I may have or that may be due me providing their (sic) is sufficient to do so after they have been paid said $800.00 each.

The above and foregoing contianed upon three sheets of type written paper and to each sheet I have signed my name, I declare to be my last will and testament, hereby revoking and declaring null and void any and all wills and testaments heretofore made by me, Witness my hand and seal the 4th day of September, 1897. Signed, sealed and declared to be his last will and testament by said Job Armstead in our presence and at his request and in his presence and in athe presence of each other we have hereto set our hands as attesting witnesses thereto.
