Will of Capt. Pike M. Thomson

In the name of God, Amen:

I Pike M. Thomson Sr. of Saline County Missouri being of sound mind and disposing memory do make this as my last will and testament, hereby revoking all former wills by me made.

First.
I will that at my death my just debts and funeral expenses be paid out of my personal property and real estate which is bequeathed under this will in section two (2) and three (3).
Second.
I will that at my death all my personal property left by me after paying my just debts and funeral expenses shall go to my beloved wife Elizabeth E. Thomson absolutely if living.
Third.
I give devise and bequeath to my beloved wife Elizabeth E. Thomson the south half of the south east quarter of section thirteen (13) township fifty one (51) range twenty (20) Saline County Missouri for and during her natural life and at her death said land to go to my son Lloyd Thomson.
Fourth.
Having given to my son John Thomson the farm on which he now lives in Saline County Missouri about thirty five years ago, I charge him with the same as an advancement and now give him one dollar to equalize him with my other children and full of his part in my estate real and personal.
Fifth.
I have in my life time made a deed of certain lands to my daughter Ruth Bush, I give her said lands as her part of my estate in fee simple and I have delivered the deed in my life time to my daughter Laura Saltonstall as a delivery to my daughter Ruth Bush.
Sixth.
I have in my life time made a deed of certain lands to my son Lucian Thomson and give him said lands as his part of my estate, and I have delivered said deed to my daughter Laura Saltonstall in my life time as a delivery to my son Lucian Thomson.
Seventh.
I have in my life time made a deed of certain lands to my son Lloyd Thomson and give him said lands as his part of my estate and I have delivered the deed in my life time to my daughter Laura Saltonstall as a deed to him.
Eighth.
I have in my life time made a deed of certain lands to my son Pike M. Thomson Jr. and give him said lands as his part of my estate and I have delivered the deed in my life time to my daughter Laura Saltonstall as a delivery to him.
Ninth.
I have in my life time made a deed of certain lands to my daughter Lizzie Richardson and I give her the said lands as being her part of my lands and I have delivered the deed in my life time to my daughter Laura Saltonstall as a delivery to her, my daughter Lizzie Richardson.
Tenth.
I have in my life time made a deed of certain lands to my daughter Laura Saltonstall and I give her said lands as her part of my estate and I have delivered the deed to her in my life time.
Eleventh.
I will that in the event any of my children shall refuse to take under the deeds delivered as aforesaid, then I give to that child or children who refuse, one dollar each and his or her part of my estate shall be equally divided with those who shall take as directed under this will and deeds aforementioned and described.
Twelvth.
I will that if any child or more than any one of my children shall attempt to break this my last will or make any trouble about my estate or affairs in any way, that said child or children shall be cut off with one dollar.
Thirteenth.
I will that the remainder of my property left at my death shall be equally divided between all my children excepting John Thomson, the one dollar I gave him in section four of this will shall make him equal with my other children.
Fourteenth.
The reason I give to my daughter Ruth Bush less land than to my other children is because I have advanced to her and her husband amounts of money as follows, at one time I paid a note of $770.00 with interest and they had the use of said money for fifteen years. I let them have at different times amounts of money in sums of $5.00 to $50.00 and $100.00 dollars.
Fifteenth.
I will that if any of my children shall claim to hold any claim against me, such as due bills, notes or accounts, or any other evidences of debt, and shall attempt to enforce it against my estate after my death, then I will that he or she shall take the land given under this will in payment of said claims or alledged indebtedness, and in the event of a refusal to take the land in full payment, then I will that he or she shall take one dollar and no more of my estate.
Sixteenth.
I appoint as executors of this my last will and testament my sons Lloyd Thomson and Pike Thomson Jr., and in the event of the death of either of my said executors, I desire and name my son in law Samuel Saltonstall to act with the survivor.

In the name of God, Amen:
I, Pike M. Thomson Sr. do make this as my condicil, this the 12 th day of May 1902, hereby revoking my former codicil made on the 8 th day of October 1901 and attached to my last will and testament of date November 18th 1900.
I reaffirm my will of date November 18 th 1900 with the changes as herein set forth in this my codicil to my said last will, to wit:
First, I will that at my death the farm I recently purchased from Benjamin Gaines in Cambridge township Saline County Missouri shall together with the rents issues and products go to my beloved wife Elizabeth E. Thomson, in addition to what is given her in sections two (2) and three (3) of my will, during her natural life and at her death the said farm shall be sold by my executers Lloyd G. Thomson and Pike M. Thomson Jr., and the proceeds of said sale shall be equally divided among all of my children.
I give to my executers full power and authority to sell said farm publicly or privately for the division as they may think best.
Second. I give to my beloved wife Elizabeth E. Thomson for and during her natural life in addition to what is given her in sections two (2) and three (3) of my will dated November 28 th 1900 and the first section of this codicil a small farm consisting of thirteen and one half acres of land now being situated in section 29 township 49 range 19 Saline County Missouri, said land being known as the W.D. Bush residence, near or at Nelson Saline County Missouri, and I further will that at the death of my wife this thirteen and half acres tract of land shall go in fee simple to my daughter Lizzie Richardson on account of her being so faithful and true in my old age and for her care of me and my wife and for waiting upon me when I was injured and sick.
Third, I will that the description in the deeds refered to in my last will of November 18 th 1900 and given to my daughter Laura Saltonstall shall be the respective childs part as therein given and each childs part shall be ascertained by said deeds when recorded in the Recorders office of Saline County Missouri.

This my codicil made this the 14 th day of July 1902.

First.
I hereby reaffirm my will and former codicils.

Second.
I will by this codicil that my beloved wife Elizabeth E. Thomson shall in addition to what is given her under my will, after the payment of my debts, have absolutely all moneys, notes and bonds and evidences of debts left by me at my death.

In 1851, Pike M. Thomson of Saline County, Missouri, received from General Land Office of the United States, a Certificate (#28048) of the Register of the Land Office at Fayette, the South West quarter of the North east quarter of Section twenty four in Township fifty one of Range twenty, in the District of Lands Subject to Sale at Fayette, Missouri, containing forty Acres. It was signed by Millard Fillmore the first day of December in the Year of our Lord one thousand eight hundred and fifty one.
