Subject: BAILY VS. WITHERS: My ancestor can whup your ancestor

The recent separate inquiries about the Baily and Withers families lead me to
post the following because of its historical flavor. The extensive ancestry
of Thomas Withers, including that of his father-in-law Jeremiah Collet, is
covered in my book *Withers-Davis Ancestry*, as well as some of his
descendants.

Sept 1685 -- Thomas Wither (sic) was the defendant in a suit brought by Joel
Bayly, for wages. A jury was impanelled and testimony taken, but the outcome
is unknown. One witness was Thomas Rawlenson, who deposed that:

". . . Thomas Wither's maid speaking contemptably of Jeremy Collett, Joel
Bayly undertooke to correct the said maide in words for abusing the
reputation of the said Jeremy Collett, whereupon the said Thomas Wither fell
violently with blowes upon the said Joel & beate him soe that he fell to the
ground and bled all that night, and afterward att certain seasons for a
weeke's time.

"Robert Jefferies, being attested, declareth the same.

"Richard Rudman & Robert Jefferies did further declare that Joel Bayly did
usually bleed before he had any difference with Thomas Wither, and further
saith not."
