FIRST GENERATION
1. Barnabas ARTHUR was born about 1735
in , Lunenburg Co., Virginia.
He was prosecuted along with others on 9 Nov 1752 in , Caroline Co.,
Virginia.1,2,3 Thomas Lee believed that prosperity depended on strict
enforcement of the laws to limit tobacco produced for export, and in keeping
with his belief ordered county courts to force constables to make oath
that they visited every plantation in their precincts and determined if
the laws stinting (limiting) the number of plants under cultivation and
banning the tending of seconds were being obeyed. Barnabas Arthur
and others were arrested and fined 1,000 pounds of tobacco each. Not sure
if this Barnabas was the son of John or the son of his brother William.
Both were teenagers and probably not married.
Did not serve in the military, but rather in Patriotic Service, much
the same as a soldier. Has descendants that are members of the D.A.R.;
no. 306208.
He died before 4 Nov 1799 in , Wilkes Co., Georgia.5 An instrument
dated 4 November 1799 written before the clerk of court of Wilkes Co.,
Georgia, Barnabas's widow, Martha, and all of his children except William
relinquished all their rights of inheritance for Barnabas's estate to William
Arthur, his son. His estate was probated on 4 Nov 1799 in , Campbell
Co., Virginia.6 Relinquishment of Rights, 4 November 1799, Campbell
Co., Virginia Deed Book 6 (1802 - 1805), page 8, as viewed in LDS microfilm

Mathew participated in the 1832 Gold Lottery, and is in no other census
for 1830, unless missed by the census takers, he is possibly this older
male. This would place his year of birth sometime around 1760, possibly
before. Since no census exists prior to 1820 for Georgia, the task
of determining his age is difficult without other evidence. He served
in the military in 1772 in , Bedford Co., Virginia. Joined when he
was 16, served for 3 months. He served in the military between 1776
and 1783 in , , Virginia. Served in Virginia under Capt. Leftwich,
Regiment Commanded by Col. calloway. Volunteered in Bedford Co.,
Virginia served several tours in Virginia, arresting Tories.

There is no record of their marriage in the Bedford Co. or Campbell Co.,
Virginia marriage records. I have yet to find any record in Wilkes
or Franklin Co., Georgia. Since the records of most Georgia counties
during this period are not complete, it is likely that we may never have
an accurate date or location. The knowledge that we have that Mathew
married Caty ______ is the mention of her name with Mathew's in a deed
for Franklin Co., Georgia in 1795.

moreover that they be furnished with one year provision out of my estate

negroes are
not to be considered or appraised as part of my estate.

Items included horses, cattle, hogs, sheep, wagon, 122 bushels of wheat,

adult slaves, 22 negro boys, 65 barrels of corn, and leaf tobacco.
The widow's
dower as $1,953.77, Negro George 35 acres of land and nine bushels
of corn, and
Barnabas Marcy's legacy left in hands of executor. According
to the will of
Barnabas, 4th child of John and Rebecca of Goose Creek, his wife was
Nancy; from
Bedford County Deeds we find a Barnabas with a wife named Elizabeth
who was
still alive in 1802.
It is believed by some that Barnabas married second to Nancy Williamson,

January 1811, as per marriage records of Bedford County, Va.
Others have stated
that his second wife was Nancy Clayton. I offer no proof for
either claim. It
can be stated for sure is that Barnabas was married first to Elizabeth
who died
after 1802 and then married second to Nancy. There were numerous
Barnabas
Arthurs around Bedford, Campbell, and Franklin Co.'s at the same time,
making
identification of each very difficult.
He was married to Elizabeth (ARTHUR). Elizabeth ARTHUR was born
about 1735.

that indicates it
might be Phebe has to do with a death record of one of the children
of Josiah
and Phebe (?) Arthur Maxey. However, in the will of Barnabas
Arthur, Sr. the
only mention of grandchildren are in reference to Barnabas Arthur Maxey
and
James Maxey. Since the will was written many years after Josiah's
death, one
might assume that since the other children were not mentioned then
they may have
come from another marriage. Josiah's wife's name in his will
of 1793 is given
as Phebe, but it is not known if her maiden name is Arthur.
She was married to Josiah MAXEY Sr. (son of Walter MAXEY and Mary Ann
NETHERLAND). Josiah MAXEY Sr. was born in 1739 in , Goochland
Co., Virginia.
