Will of PHILIP JEAN


In the name of God amen, I Philip Jean of the County of Guilford and State of North Carolina, being of sound perfect mind and memory, do make and ordain and publish this to be my last Will and Testament in manner and form following.

1) I give and bequeath to my beloved wife, Sally Jean, all my lands, houses improvements thereon and thereunto belonging, to be hers solely and entirely during the term of her natural life. I also give and bequeath to my beloved wife, Sally Jean, as many negroes of my stock of negroes as she may chose to take at the time of my death and her choice of them, my two horse wagon, my ? wagon, and steers, my ? and ?, as many of my horses, cattle, hogs and sheep on hand at the time of my death as she may chose to take and her choice of each, as many of my farming tools and utensils as she may chose to take, all my ? and tools, together with the necessary ? utensils thereto belonging, all my household and kitchen furniture of any name and desceiption whatsoever, all my mowing sythes, all my crop of corn, wheat, rye, oats, hay fodder and tobacco, that may be on hand at the time of my death, to have and to hold all the above bequeathed property for and during the term of her natural life.

2) After my wife, Sally Jean, has chosen and taken her part of my estate as above given and bequeathed, then I will and desire that the balance of my negroes, the remainder of my personal and ? ? be sold by my Executor at public sale to the highest bidder on a credit of ? and ? taken from purchasers, and I will and desire that all my just debts be paid out of the proceeds of such sale, and the balance to be divided in the following manner: one fourth part to my daughter, Nancy McNairy, widow of James McNairy deceased; one fourth part to the widow and children of my son, Smith P. Jean to be equally divided among them share and share alike; one fourth part to the children of my daughter, Betsey McNairy to be equally divided among them share and share alike, and the remaining fourth part to my granddaughter, Sally McNairy, wife of James McNairy, to have and to hold to ?.

3) After the death of my beloved wife, Sally Jean, I will and desire all my real and personal estate herein before given and bequeathed to her for and during the time of her natural life, to be sold at public sale to the highest bidder, upon a credit of twelve months by my Executor. {unreadable} I give and bequeath in the following manner, follow all the just debts contracted and owing by my wife, Sally Jean (if any, at the time of her death to be first paid, out of the proceeds of said sale, and the balance to be divided in the following manner, to wit, one fourth part to my daughter, Nancy McNairy, widow of James McNairy, deceased; one fourth part to the widow and children of my son, Smith P. Jean, to be equally divided among them share and share alike; one fourth part to the children of my daughter, Betsey McNairy, to be equally divided among them share and share alike, and the remaining fourth part of my granddaughter, Sally W. McNairy, wife of James McNairy, deceased, daughter of Wyatt W. Jean deceased, to have and to hold to them their heirs and ? forever.

And I do hereby constitute and appoint, Edmond W. Ogburn and Thomas Warner Executors to this my last Will and Testament to execute the same according to my above wishes and according to law.

In testimony whereof I have hereunto set my hand and seal this 17th day of August 1841.

Will was probated in the November term of 1847.
