[1] Mary died bef. May 1812 as her Will was probated 26 May 1812:
This is the last Will and Testament of me, Mary Dewhurst of Blackburn in the County of Lancaster Widow made and published this Seventh day of April in the year of our Lord one thousand eight hundred and four I give and bequeath my Silver Tankard unto my son Thomas Dewhurst and his child or children provided he have any at the time of his death but should he leave no child or children at his death I give and bequeath such Tankard unto my son John Dewhurst I also give and bequeath unto my said son John Dewhurst the Bedposts Bed Bedclothes and furniturements in the front room of my present Dwelling house. I also give and bequeath all my Books of every description unto and equally amongst my four sons or their several legal representatives share and share alike. I also give and Bequeath my clothes and wearing apparel of every description unto and equally amongst my three daughters and the wives of my sons or their several legal representatives share and share alike And as to all the residue and remainder of my Personal Estate whatsoever and whersoever I give and bequeath the same unto my three sons the said John Dewhurst James Dewhurst and William Dewhurst and my son in Law George Horton Lloyd or Oherlurn? Near Gargrave in the County of York Farmer their Executors administrators and assigns To hold unto them the said John Dewhurst James Dewhurst William Dewhurst and George Horton Lloyd their Executors Administrators and Assigns Upon Trust that they or the Survivors or Survivor of them the said John Dewhurst James Dewhurst William Dewhurst and George Horton Lloyd or the Executors or Administrators of such Survivors shall and do as soon as conveniently may be after my decease sell the said residue of my Personal Estate and effects either by Public Auction or otherwise as to them shall seem meet(?) And after payment of my just Debts funeral expenses and the charges of the probate hereof pay the sum of Twenty pounds unto my Daughter Elizabeth Eccles or her legal representatives. The sum of ten pounds unto my Daughter Ann Leaver (Seaver?) or her legal representatives and the surplus if any I direct the same to be paid to or retained by my four sons the said Thomas Dewhurst, John Dewhurst James Dewhurst and William Dewhurst or their several legal representatives equally share and share alike Whereas I have power reserved(?) in and by my late husbands Will to direct his Trustees to convey to my children and grandchildren three undivided parts or shares the whole into nine parts to be divided of his real estates as I shall by deed or will see proper Now I do hereby __ direct such Trustees or the survivors or survivor of them or the heirs of such survivor to convey and I do give and devise the same three parts the whole into nine parts to be divided of my said late husbands real Estates unto and equally amongst my said four sons and the said Sarah Lloyd their heirs forever equally share and share alike as Tenants in common Yet it is nevertheless my will and mind that in case my said son Thomas Dewhurst or my said Daughter Sarah Lloyd shall happen to die without issue the share of either or both of them of each ----into nine parts
