This is the last will and Testament of me James Dewhurst of Blackburn in the County of Lancaster yeoman made and published the twenty eighth day of November in the year of our Lord one thousand eight hundred and twenty eight.

I give devise and bequeath unto my three sons James Kirkham Dewhurst Thomas Dewhurst and William Bolton Dewhurst their heirs executors administrators and assigns All and every the Freehold and leasehold messuages cottages or dwelling houses buildings lands tenements rents and heredetainments(?) and all and every the part or share and parts or shares of and in any freehold and leasehold messuages cottages or dwelling houses buildings lands tenements rents and hereditaments of or to which for any person or persons in trust for me shall or may be seized possessed or entitled at the time of my decease and which have power to dispose of by this my will and wheresoever the same may be situate lying and being with their and every of their rights members and appurtenances to hold the same unto them my said three sons James Kirkham Dewhurst, Thomas Dewhurst and William Bolton Dewhurst their heirs executors administrators and assigns for ever according to the nature of the property and for and during all my estate and interest in such property respectively and to hold and take as tenants in common and not as joint tenants Subject nevertheless and I do hereby charge and make liable the same and every part thereof with the payment of all my just debts and funeral and testamentary expenses and the charges of the probate of this my will or what the residue of my personal estate hereinafter disposed of shall of may fall short of and also with and to the payment of the sum of one hundred pounds of lawful British money unto my daughter Elizabeth Dewhurst on her attaining the age of twenty one years with interest for the same after the rate of five pounds for a year in the meantime to be paid and applied unto or for her use and benefit and in case my said daughter Elizabeth Dewhurst shall attain the age of twenty one years in my life time then I direct the said sum of one hundred pounds to be paid to her at the expiration of twelve calendar months next after my decease with interest after the rate aforesaid for the same from the time of my decease. I give and bequeath unto my said daughter Elizabeth all my household goods and furniture books plate linen and china - Also I give and bequeath unto my Grandson James Dewhurst the son of my said son Thomas Dewhurst all my musical instruments and music books And as to the rest residue and remainder of my personal estate and effects not herein before otherwise disposed of I give and bequeath the same unto my said three sons their executors administrators and assigns upon trust that they or the survivors or survivor of them his executors or administrators do and shall as soon as conveniently may be after my decease make sale and dispose of collect get in recover and receive the same and out of the money which shall arise from such sale and be so gotten in recovered and received and after payment and satisfaction of all my just debts and funeral and testamentary expences to pay and divide what shall afterwards remain of such moneys unto and equally amongst all my said sons and my said daughter share and share alike Provided nevertheless and it is my will and I direct and declare that in case my eldest son or his heirs shall at the death of my sister Sarah become entitled in consequence of her surviving me to any part or share of the property she now enjoys under the will of my late mother in exclusion of my other children and of which they cannot participate then that he my said eldest son or his heirs shall have and be entitled to so much less in value of my property herein before given and devised to my said three sons anything herein before contained to the contrary ___withstanding And I hereby revoke all former wills by me heretofore made and do publish and declare this to be my last will and Testament and thereof do nominate and appoint my said three sons James Kirkham Dewhurst, Thomas Dewhurst and William Bolton Dewhurst joint executors And I do hereby direct and declare that each of my said trustees and executors sall be accountable only for his own acts and for the sums respectively received by him and that they shall not be liable to make good any losses which may happen to my estate so as the same happen without their collusion or willful default and that it shall and may be lawful for them and each of them to reimburse themselves and himself out of the money which shall come to them or his hands by virtue hereof all such costs and charges as they shall be at or just unto in or about the execution of the trusts of this my will and also to pay and satisfy to themselves and himself all such sum or sums of money as they or any of them may reasonably deserve for their trouble and loss of time or that of any person or persons to be by them or any of them employed in about or on account of the execution of such trusts or in any wise relating thereto In witness whereof I the said James Dewhurst the Testator have to this my last will and Testament set my hand and seal the day and year first above written

The Twenty Second Day of March, 1830 Thomas Dewhurst .....named, was sworn in (very tough to read) it looks like Thomas acted for James Kirkham and for William Bolton the other executors - to take upon them the execution of the said will, when they shall lawfully request same and he furth made oath that the personal estae and effects of the Testator within ... were under value of Forty Pounds
